Spouse visa IR/Cr1 do not allow for dependents ( know in immigration terms as a ‘derivative’ ) You will need to file an I130 for him , in order to apply for an IR2 for your stepson. As you stated, your intent was to visit, your circumstances changed. You may be asked a question or two at the AOS interview , but you simply tell the truth. Most people find they can do the AOS without a lawyer. Just read the forms and instructions very very well and take the time to make sure you have everything needed. But if you can submit the AOS before the end of your allowed stay period, that will keep you in authorized stay while your application is processing

GC can come weeks or months ( up to 1 year) after entering. No rhyme or reason. You will be told you are with in normal processing at 90 days so don’t even bother. The receipt number is the IOE number you were given when you the GC fee online . Use your stamped visa as that is your temporary I551 GC, good for everything the plastic GC is good for, and valid for 12 months from every.

yes i encounter this every time i fly to aust. Was actually simple as an lpr with GE. But I’ve finally worked a way around both ends of the entry.

You cant check in on a passport which doesnt automatically give you the right to enter your destination country unless you have the required visa. And being a citizen of the destination country you cannot get a visa. Check in is about matching ID and having documentation that allows you to enter your destination. The US CBP has no formal process for exiting passengers. You will have to check in on the passport that gives you entry into the destination. My flight to Aus from Us is always on my Aust passport otherwise i wont nt able to board. . On the return trip I check in on my US passport but give both US and Aus passports at the exit Border control desk .. smartgate cant be used as the system doesn't link the 2 passports Keep you boarding passes as evidence of the outgoing flight

Moved to AOS from a student visa as this reflects OP question

You are only eligible for naturalization if , at the time of both your interview and oath, you 1 Remain in a bonafide cohabitating marital relationship to the spouse who petitioned for you AND 2. You have been a lpr for 3 years AND 3 You have completed ROC and are now an unconditional LPR Filed divorce papers wipes out 1. Non yet completed ROC wipes out 3. Without all 3 conditions being met, you cannot use the 3 yr rule Your only path to citizenship is that you MUST complete ROC using a divorce waiver. Then you can apply under the 5 year rule. Please fill out your timeline if you want more help.

Have you already been all the way through the removal of conditions? Do you have a GC with the expiry 10 years from issue .. or are you still waiting for ROC (I751) to be approved ? We really are trying to answer a question without knowing what your timeline / status is. Fill in the timeline otherwise it’s almost impossible to give you clear correct answers. Too many variables.

Yes it is very likely you will be refused. It may slip through but that will be an error and leaves you open to action in the future if the dates are re-examined You should be refused as the divorce may not yet finalised but it is no longer a bonafide marriage because the divorce is in process. Withdraw the N 400 Reapply under the 5 year rule once you are 90 days out from being an lpr for 5 years

Skirting a line that I wouldn’t be getting close to… Is it worth the worry and possible rejection? I would be withdrawing the N400 and refiling under the 5 yr timeframe when that comes round. Safe and easier all round
