Hello abey23 I submitted proof of marriage, my own statement, shelter letter ( but it seems that they requested it again and I don't know why), proof of good moral character, and two affidavits from friends.

They didn't ask anything about the proof of marriage just additional evidence for the abuse.

what is the prove of good moral character? who gives it?

  2. Hello guys. Today had our interview at 8am.

    We are approved!

It was super easy. Very pleasant woman asked questions from 485 form and standard.

she told that we sent enough documents for to make decision.

For now I am really happy!

Wish you guys interviews as the easiest part!

Ps: Detroit office is really fast. We sent documents in february....

What is your goal?  Any material misrepresentation will mean a ban.  You can try to hope for a 3 year or a 10 year but I doubt if they will just laugh and smile and pat you on the back.  If you love her and want to be with her then consider moving to her.  This is not the time to expect immigration to be overly friendly towards fraud.  I'm not sure there was ever a time where admitting fraud to get a visa would be looked at as anything less than a ban able offense.

    not agreed.

They do not have material misrepresentation yet.

They have  three possibilities how all can be.

It does not mean that they will have 212 in their case.

I follow all such situations. There are many ppl who said truth at the interview and had 221g and then AP and issued even after difference in information before.

Otherways why all this forum is here?????

My consulate with the lawyer was a brief call.  He too came to the same conclusion about getting married and applying.

I've discussed this with my Fiancee, and we will be getting married when I visit her next year.

I appreciate that help that has gone into these 10 pages.

I've also covered with her that because the tourist visa was obtained fraudulently, that she should not travel over here during the process, and that I will make multiple trips to her.

She is on board with that assessment and plan.

if you will use tourist visa even if you already have it- you will ignore a law even more.  And they will remind you that at the interview. Do not make your chances  less. Wish you better luck then I am in.

Generally, yes. But having claimed to be married in the past is a substantial difference from the norm. In this circumstance, the CO normally requests documentation of the claimed marriage being dissolved.

One can say they only lied on their past application, but how does the CO know whether they were lying before about their marriage or if they are lying now about it?

in my country there is a special extract about it. Hard to say because I still do not know where is she from..

As mentioned before in this thread, the CR-1 might end up being denied as well based on her not producing a "divorce decree" to make her free to marry again, once she reaches the interview stage....this is all whether or not the CO checks past visa applications (likely they will).

    k1 the same.....

Generally she does not have to prove that she is divorced if at her packet of documents will be not divorce certificate.

They will prepare normal documents and to think only what to say and how to explain difference in information at the interview.

The worse may be if she is from list of ban countries, he did not say where is she from.

I think if they want they will try and they will be issued...

Thanks to everyone that has replied.  As a new member I am limited to a certain amount of posts a day, and apparently hit the the first day.

I've bookmarked this thread so I can refer to it later as time passes.

As I may have mentioned, I'm aiming to submit the application next week, and get the timer started.  I have a phone number of a local immigration lawyer that did work for my friend, and I have a call into him, although at this time it is premature.  Nonetheless, I'm trying to cover my bases, and I appreciate all of you chiming in with your experiences and input.

be sure that that lawyer works with problem cases. but not only fills forms... I say from my own sad experience....

    And
PLEASE tell us what will recommend your lawyer. You may help with it to thousand ppl....

This is inaccurate. It has ALWAYS been difficult for people from certain countries for a reason. People really need to stop with Trump this, Trump that, when most of the things they try to blame him for have been the same for years or decades even. Stop watching CNN, MSNBC, ect, or reading the the sob liberal media articles.

if I will call it with another words reason will not changed: there are some ppl who get visas harder, there are some cases which are not easy, there are some ppl who are not perfect, there are some situations in life which you can not predict... choose what you like more...😀 but Trumps version I like the most, because for sure will understand what I mean.. Is it a new thing that Trump has a strategy to minimise immigrants? I guess no. But this topic for luckiness is not about  this...

  9. I have k-1,

    1. Do not believe to the ppl who tells you to "not marry to the liar"- they are crazy ppl. There are some countries which that ppl will never understand. After Trump started to be here is a really difficult to get a visa for some ppl. And if she got a visa with changing only status she is in a good shape and for sure has good basic in life.Where is she from?

    2. Its really strange to measure a woman by visa history, I am sure you are a smart man and will see if she deserves all hard way for immigration visa.

    3. I recommend you  to make spouse visa (it may have AP but still have more chances), to say only truth in the interview, to use lawyer for to make perfect documents for applying the visa  -you will have a document about "changing sername" where will be information about she was never married -at least it makes sense in this situation. And remember that misrepresentation is the worst way.  It may happen that you will be in AP and they will decide about agree or not and will give only 221g.

    4. I think the best way here is to say as it is- that you said not truth because of agency. Situation is a veeeeeery common here in my country for example. There are thousand of ppl who used agencies here and then had problems. When I was at the embassy they said it directly.

    5. I wish your fiancee to be strong and to be ready that from the interview she has to remember all details which she wrote in ds-160 for tourist visa. Its a very important. They may check everything from her past.

Good luck to you, and remember -life is only one , and "right" person may be found only once in life.

my wifes Visa was issued few days after the interview. It might have been different years ago.

I think you exactly understand what I mean.

When I had interview officer told me that my visa will be till March 14, 2019.

I did not get what does it mean at that time.

I just want to know :

my case is under AP in Kiev embassy.

But I still get letters from USCIS site with such text:

    Department of Homeland Security seal

We are still reviewing your case and there are no updates at this time

We will notify you when your case status changes. We last took action on your case on August 6, 2018.

That is why I thought logically what if there is some deadline about my case?

Its not about visa which I do not have. Its about case. What if case has limits?

As I understand its probably 6 months since it was approved in USCIS?

    Thank you for support .😊
