    I have my interview for green card on Monday. 

     

    The notice says to bring the i864w  form but I can't find it online.

    All I find is this. Does anyone have the form ?

    Omg you guys what if they ask about the abuse during my i485 interview.  

     

     

    I seen this online : "A USCIS memo from 2002 reminds interviewing officers that the Form I-360 has already been approved when the VAWA adjustment applicant has their interview.  This means that it is not the job of the interviewer to ask questions about the abuse the applicant suffered.  USCIS has already decided the applicant qualifies for a visa (if the I-360 is approved before the interview).  Once that happens, the interviewing officer is deciding whether the applicant is eligible for permanent residence.  The officer is not deciding whether the applicant’s I-360 should have been approved.  (However, this USCIS memo does establish a procedure for the revocation of a VAWA approval if new information is learned at the interview which was not provided to USCIS when the I-360 was adjudicated.)

    At the same time if you feel things are going badly you can ask for a supervisor, but that to me, seems like it could cause more delays. Since they might reschedule your appointment.

     

    Most IO don't go there. Let's pray you get one of those.

    Your case will not get denied! Worst case scenario..RFE for medicals before they approve you..it's been done here severally. Someone else here mentioned they were able to get an emergency medicals done and received next day...don't relent now..look for and offer whatever the cost for it. You will get it..you've got this!👍

  5. Hey everyone. I posted a while back, uscis was asking for other people besides me to go to i485 interview. . It was a mistake of course. I think they were asking for my abuser to go. I contacted congressman and they spoke with immigration and gave me an interview date of Nov 9th. 

     

    I will call to make an appointment for physical tomorrow. My question.  How long does it take for them to give you results ?

    your abuser is your Son correct? It seems like you don’t live with him anymore. This may have something to do with this situation, wait for Sandra, she will definitely give you her professional opinion. 
     

    in the meantime, if you have a lawyer, contact them and there is no harm in contacting your congressman/senator to get info on this.

    Omg you all are going to make me cry. With all the support and kind words. Yes the abuser is my son.. he still gets mail at my address and alot of things on file for him are under my address... idk where he is at...because he has a drug addiction .

    I hope all is well. We spoke a while back about the request to expedite my work permit. I now have my work permit .

    I have come across an issue and I'm very stressed and worried about this. Please help me. All forms authorizing you all are attached.

    Let me just explain a little. Im a victim of abuse and Im getting my green card through petition :I360 Vawa , which I basically self petition. Meaning I do not need my USA citizen abuser to get my green card. This is done to help victums get on their feet and not rely on the abuser.

    That special petition was approved. (Attached) Now all I have left is my interview for the green card.
    The interview is only for me. My abuser is not allowed to go to it. Only I'm allowed because of the sensitivity of my case.

    I check my online status and it said  " Case Was Updated To Show That No One Appeared for In-Person Processing On September 29, 2020, we requested that certain people associated with your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number xxx come to an appointment. No one came to the appointment, and this will significantly affect your case. "

     

    But I never got a letter at all about this. I think USCIS is confused because this is a self petition. 

    I was wondering if you could please reach out to one of the USCIS officers and have them explain who and why they are requesting for anyone besides me to go to the appointment. And to make sure my address is correct on file.

    I have attached all receipts that I have gotten.

    Yes my VAWA is approved already. Im sorry its just that I kept checking my online case status and mail and nothing came. I did change my address but I did a change of address and it was updated.... i know it was because I got my work permit in my new address.... and all new mail ... telling me they need medicals... what I dont get is who were they wanting to go to the appointment?

The greencard just means you are a permanent resident. For VAWA cases where its spousal abuse they like to see the victim has moved on (divorced) from the abuser- although divorce is not required. They want you to be safe! Because this is your son he may not ever be 100% out of your life. You should find a therapist if you dont already have one and discuss with them ways to separate yourself from your abusive son. It can be very hard but you need to take care of yourself first! You cant help him until you are stable. A local therapist can help you figure out what you need to do to secure housing under your name, the bills, bank accounts etc. You may also benefit from a social worker. The therapist may be able to refer you to one or you can contact your local DV hotline or call 211 and ask for social worker assistance.

    He leaves my home to do drugs for months with friends and then comes back again.  But he will start rehab.

     

    I just don't want to get in trouble with immigration if I live with him after he finishes treatment.  I dont want they deport me . I love my son , I know its the drugs that make him into a bad person. Im in therapy.

    - Supporting Documents for Fee Waiver 

    - Completed form I-765, Application for Employment Authorization

    - Copy of I-797C, Notice of Action, receipt of filing I-485

    - Copy of previously approved Employment Authorization Card

    - 2 color photographs (A# lightly printed in the back)

    - Copy of passport

    Congratulations I'm also a december 2018 filer. My attorney told me i had to gether the money for the i485 because they wouldn't waive the fee.

    Wow you lawyer is wrong. If you qualify for waiver then you just submit with evidence , I did bank statements with no balance and my child's paperwork that she gets benefits SNAP and Medicaid and I explain why I can't pay.

     

    Some layers are just wow. . How can they lie like that.

    New Card Is Being Produced

    On May 1, 2020, we ordered your new card for Receipt Number EACXXXXXXXXX, and will mail it to the address you gave us. 

     

    Here is my timeline.

     

    12/07/2018 Submitted 

    A.    I-912, REQUEST FOR FEE WAIVER
    B.    G1145, E-NOTIFICATION OF APPLICATION/PETITION ACCEPTANCE
    C.    I-360, PETITION FOR AMERASIAN, WIDOW(ER), OR SPECIAL IMMIGRANT
    D.    I-864W:  REQUEST FOR EXEMPTION FOR INTENDING IMMIGRANT'S AFFIDAVIT OF SUPPORT
    E.    I-485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS
    F.    I-765, APPLICATION FOR EMPLOYMENT AUTHORIZATION

    Fee Waiver was wrong so  485, 765 was returned. 

     

    12/31/2018  again submited i-485, 765

    Receipt 2 weeks later

    05/01/2020 Got notification that They are printing out card for VAWA PETITION.
