    S_And_J got a reaction from 2022 in DS-160 - 'Immigrant petition' question?
Hi all, I posted this in the main K-1 forum section but have sadly had no luck with advice 😔Was hoping my fellow UK'ers will have some experience with this question regarding the DS-160 for anyone that has completed it?

Under previous U.S Travel Information there's this question:

Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?
Now, I've tried to research this question here on VJ and it looks like there's been mixed responses... Some people say that, of course, the initial K-1 petition to USCIS is what they're asking about. Some other people say that 'technically' the k-1 isn't an immigrant petition, but is instead a non-immigrant petition with immigrant intent once adjusted. Some people also mention that because you select 'immigrant visa' when you check the NVC status - that it counts as an immigrant petition for the purpose of the current process?

Either way it's all very confusing! I just wondered if anyone had recently gone through the interview/DS-160 process and was asked further questions at interview for selecting either option? Or if anyone generally had any advice for what the question really entails? No-one has ever filed any form of petition on my behalf except for the current K-1 process that me and my fiancé are doing.

    Thanks!

While the CR1 has its benefits, I personally hated being so far away from my partner. Dealing with the long-distance or the timezones really sucked, and while the K-1 has the added requirement of Adjusting Status, I would much rather do that with both of us physically in the same place. I would say, for those of us that did the K-1 and then adjusted status, do try to remember how difficult the period of waiting was without our now-spouses.

Honestly, I think it's worth it to check out TurboTax. You will have to pay a little money to get the deluxe version which allows you to file the form to exclude income - but it's all relatively simple. Unless you have extremely complex financial ownership, trusts, etc, of which I would then recommend going to a Tax professional. Otherwise, if your international spouse has income from regular employment, TurboTax should be sufficient.

P.S don't forget that you have to file paper form and attach a statement electing to be treated as a U.S Resident for Tax Purposes for the whole of the financial year if you want to file MFJ.

Yeah, if people haven't already I would check out Turbotax. We ended up getting the deluxe version as this includes the ability to report foreign income and also exclude it. We haven't heard back from the IRS yet (so hopefully it's all okay) but I would definitely give Turbotax a go!

Also, as mentioned above, also very key to get the FBAR done before April (you file electronically online) if at any point in the previous financial year your foreign accounts had an aggregate balance of $10,000 or over.

    Hey all!

Recently had my medical (review coming soon - was really positive - the doctor and team were so friendly!) and was just looking over my vaccination worksheet and started getting worried that it might not be sufficient for the AOS stage?

I was told by the nurse that all my vaccinations were up to date but now i'm getting confused by these 'blanket waivers' she's put?

For example, i've got my MMR date noted on the form and there's nothing in the blanket waiver section - so all would seem that this is adequately completed? However, with Td I have the date noted in there but have the letter 'B' in the blanket waiver section... which apparently means 'insufficient time interval to complete series'?

Will this cause me issues at AOS stage? Will I have to get these vaccinations again at AOS?

    Thanks!

Other than the AP statement for qualification (which is not needed for K1s as filing AP with AOS is routine and no explanation is necessary), you are perfect.
Also if you dont have any prior divorces between either of you or if the applicant doesnt have a criminal record, then you have submitted everything.

You could always answer the IRS letter (if you even get one) with your reasons. Or file in your maiden name for 2018 and switch names on taxes for subsequent years.

As far as tax returns for AOS, the USCIS is interested in those for income, not names. Some people don't take their husband's name and that does not hinder their success at getting a greencard or later citizenship.

The only answer I can give you is what the USCIS "rulebook" says. Unfortunately, your interviewer may or may not have studied his manual that well and could come up with a different random answer. People have experienced so many outcomes in their local offices that there is no guarantee.

If you are as complete as possible on the day of your visa medical, then that is supposed to be good for AOS. Any waivers are good for AOS if you got every shot needed (or waived) signed off.  If you left off a shot because you didn't want to get it, and it wasn't waived, then you weren't complete. By as complete as possible, some examples are:
You got a waiver for a shot for insufficient time interval because it wasn't medically possible to have another injection that day. You were as complete as possible and should not ever need to get that shot for immigration purposes. You were pregnant at the visa medical and could not have the Rubella component of MMR, so MMR was waived. You do not have to go back after pregnancy and get it. You were as complete as possible and signed off with a waiver. Remember waivers only work if ALL needed shots were on the form signed by Knightsbridge. If you chose to go back to your GP later or get the shot in the US, then you weren't complete at Knightsbridge. You would need a new sign off from a civil surgeon. He would waive only what was appropriate on the day at his office. If the time interval had passed or the person was no longer pregnant, then they would need the shots previously waived.

That's just an oddity Knightsbridge does. It was explained to somebody on here several years ago that you "are never complete" because tetanus is boosted every 10 years. So they used to write in "due 10/5/2025" or something silly like that.

Your shot is marked with a date in the last 10 years presumably. It's also marked waived which means it's excused because it's too soon to get the next 10 year shot. Dumb, I know, but fine.
