    She can't sponsor a new spouse until at least 5 years passed since she gained residence, It's the Law, and the  law was enacted in 1990.
     
    She can try to sponsor him but if USCIS denies the AOS he will be removed from the U.S.  She can  overcome the 5 years rule if she can prove that se had  ALL the documents mentioned below with her  FIRST  husband.
     
    Documentation showing joint ownership of property
    Joint lease or documentation showing a common residence
    Documentation showing commingling of financial resources
    Birth certificates of any children born of the marriage
    Affidavits of third parties having personal knowledge of the marriage who can attest to the genuine nature of the couple’s relationship.

    Hi All,
     
    just had my I-485 interview today at Federal Plaza, NYC
     
    The officer was very nice, most of the time he was just talking to my lawyer about unrelated things
     
    He asked me Yes/No questions, nothing else. He only asked me to show my passport, original marriage certificate and and original birth certificate. Nothing else.
     
    He then said the lawyer made a mistake by filing two I-485s (one was filed based on marriage and one based on VAWA). The lawyer filed it before I found this forum, so I basically had two pending I-485s. He said he will deny the marriage-based one. He also said that I should receive the card in 2 to 4 weeks. He didn't say the word "Approved" and only mentioned receiving the card by mail.
     
    He then wrote a note in my passport with my alien number, status of I-485 (pending), and class of admission.
     
    So far, I saw the status of the old I-485 online (case denied) but nothing for the VAWA-based I-485 today

    I can only give you an example with my own experience bearing in mind it's different for everyone. Some cases move pretty quickly while others just drag! My case was transferred to 'another office' in June 2019 and interview happened March 2020.. and yes I'm in NYC!👍

    Hey guys! 
     
    I had my VAWA approved on January, 27 2020 and I got my work permit a couple weeks afterwards. 
    I still didn't receive the approval letter, I even sent a letter to them asking for the approval letter and I still don't have anything in hands. Should I worry about it?
    Can I apply for the green card even without the approval letter?

    I was scared, I'll not lie! But we have to remember that we are not doing anything wrong and we are adjusting our status in this country in a legal way.

    Hi! I flew two times domestically and nobody ask me about my immigration status. They checked my foreign passport, but nobody even open to see if I had a visa or anything like that. I had all my receipts with me (I-360 and even my Prima Facia). I'm not a lawyer, but I don't think there's a problem if you don't have your PF - If they want to check your immigration status, they will see that you have a pending petition, and there's no problem if you're not crossing borders.

    Hi all!
     
    I applied my VAWA case on November of 2017, and in November of 2019 I got an RFE (Good moral character). They were asking me for letters from other people proofing my good moral character and my previous taxes. Today I got a notification saying "New Card Is Being Produced" - I'm confused. Does it means that I was approved? I did send the EAD Card forms and I-485 with my I-360.
     
    I can't wait to have all of this process done - It's a nightmare.

    Don't be confuse everything under each case belong to that specific case New card produce under I-360 is for your VAWA nothing to do with I-485 one.... Congratulations is being approve soon you will receive your EAD c31 category following the approval notice...
