Hank, You highlight the I-94 which is issued for a lot of different visas which SSA treats accordingly.  The paragraph listed is very vague and encapsulates a lot of the SSA policies into one.  Speaking specifically about the K-1 once you get married your status changes in the eyes of SSA as I explained before.  That is why it is recommended to get your SS card before marriage or you will run into a lot of trouble getting it.  Believe you me, my wife and I found this out when we tried to get the name changed after marriage.  Luckily I (or unluckily I suppose) got to speak with someone fairly high up the food chain at SSA because I thought the same as you did.  I'm fairly confident that she didn't get her job by not knowing how things worked from A to Z.   So we just opted to check the issue a new SSA card box on the i-765 application and not bother going back to the office.  And it arrived 2 days after the EAD with the new name. :)

    Technically per SSA policy you shouldn't be able to get an SSA or change the name on it between the time of marriage and getting your EAD or GC.  It's considered a "no man's land" because your status is that of "waiting."  You can argue whether that makes sense or not but it's what they go by.

    This has always been the case.  However we now live in a society where everyone has to be given the shadow of a doubt, no matter what their situation is or how obvious their intent is.  If not its considered discrimination and you'll swiftly be walked out the door.

    There is one thing that is clear- the system is just all over the place and trying to figure it out is futile :-)  The only email that you can count on is the one that says your card is being produced!

     

    My approval was 130 days after they received my AOS package.  I know I am very lucky to get my Green Card so early.  This is out of the Philly Office which has a current estimate of 9.5-19 months.  So the information isn't always right, for any of those that are trying to figure our when they will get their cards.

    @Aker Yes the online system is seriously flawed and needs to be fixed.  They hired Billy Bobs cousin and paid him millions to code it and guess what....it doesn't work!!  In any case congrats on getting your GC in a timely fashion.  Crazy to think someone would wait 19 months to get their card.  Our local office is saying 11-17 months but with the EAD already mailed out it's not that big of a deal.

    Interesting that some people are getting interviews and not getting their EAD/AP cards first.    In any case the EAD card is on the way for us :) :)    An email was received letting us know however the "glitch" is on our account online and the AP doesn't say it is on its way, but they are combo cards...very glitchy.  We have 2 letters from USCIS arriving today, a 1 pager and a 2 pager.  One has to be the EAD is being processed letter but the other one is a mystery.  Glitch heaven!

    We still have the dreaded technical error on USCIS (3 weeks now), shows a date of case updated but a blank update for I-485.  Talking to Tier 2 didn't do any good they just told us to wait a year and couldn't tell us what the update was.

    I have been having this responses since last week and called USCIS today. And as the rep told me to wait for 15 days more and get back to them. 

    We are getting the Same thing here.  Same thing here, I wonder if others are getting the same message.  It's either they are working on our cases or its a maintenance error.

    This is true, however that is going to change very soon.  You can pretty much move as quickly as you want once you have your MNL number.  For us it was 50 days from NOA-2 to visa in hand.  It could have been a few days sooner but I had to make arrangements at work to have time to fly down there.  Good luck!

    K1 remains how you got in the country.

    Your class doesn't change but your status changes.  In any case that is the way it's being interpreted by many people working at the SSA office, whether it's correct or not.  In which everyone is having different experiences it seems.  So to be safe get it before you get married.

    Not so, as soon as you get married your status changes into a "no mans land," for lack of a better word.  You are no longer a K-1 immigrant and you aren't a permanent resident.

    Simple, if you can see your I-94 online, so can SSA.  But I would print out a copy and bring it with you to the SSA office.

    When you get the card in the mail.  But from the SSA website its says "Generally 10-14 business days."  Putting that aside its usually very quick as my then Fiancee got hers in about a week.  As usual YMMV.

    But don't wait until you get married to get your SSA, as then you won't be able to get one until you get the EAD or GC.  Getting your SS number now will make so many things MUCH EASIER.  Yes I know the conflicting opinions and advice on here, but if I may put this out there by asking, What does it hurt to try??  Sitting around worrying about what if's and negative posts isn't going to help you move forward.  Good luck!!

I called in and they told me that my expedite case is still under review. So I guess they got my fax from Feb 27th and started to look at my case. Will see what their decision is.

    Also you say you will only be able to visit once during the process because of finances.. the visa process is VERY expensive. are you sure you want to invest more than half a grand before even having met? I‘d say wait a few months and see how it is. if you of course don‘t care that you might waste 600$, apply the sooner the better. It‘s a long process.

    Won't cause red flags at the Manila Embassy.  This is the norm in the Philippines.  For the most part the embassy is fairly easy as far as K-1 visas are concerned.  The key is having all your paperwork in order and barring nothing unusual in your case, the chance of approval is very good.

    I know you are excited and really want to see this work out.  However I would caution you not to put the cart before the horse.  Make sure you go into this with the mindset of looking for any possible red flag.  Plus on the lookout for any inaccuracies about what she has told you so far.  Talking online is one thing, but being with someone in person can be a completely different ball game, especially if one or both parties weren't completely honest about things while chatting or even video calling online.  It would be a good idea to do some research and connect with ex-pats that are in the Philippines so you will have a better idea of what you are getting into.  For starters head over the the regional forum dedicated to the Philippines on here.  Good luck!

    This one is still vaild until they release the new one.  I believe they go by the Edition date at the bottom of the page, not the expiration date.  Also it is when you submit, not when they look at it that determines if they reject it or not.

    Seems like the norm if you look back at other AOS forums from past months.  Ours still shows the NOA1 date January 10th.  Hopefully everyone will hear something soon but it still is very early in the process.  But who knows, the process may be going faster this year???  It doesn't hurt to dream..hehe

    But overall I agree, the normal wedding routine should be on the backburner when deciding to go the immigration route for marriage.

    Yes but starting all over again will add months to the process including the extra 3-4 months it takes to do the CR-1.  Plus ironing out the details of getting married in Estonia may not be easy. However Estonia is part of ESTA, so a Vegas wedding would fit the bill.  Keeping in mind leaving the country then filing for CR-1.  Let's not forget the extra expenses of filing everything all over again, not fun!  It isn't as romantic as everyone is painting it here.

     

    Just my 2 cents if I were in the OP's shoes: I would cancel the party and roll the dice since the K-1 visa is already in process.  And if asked in the interview about the statement, explain that after learning more about the process, you canceled the party in effort to avoid any misinterpretations.  Perhaps I'm wrong, Estonia isn't one of those countries where a party or religious ceremony by itself, constitutes a "legal" marriage.  So this issue most likely isn't on the radar for the CO's there.

I mean something that happened 8years ago , especially something so small as that is pretty easy to forget . & thank you, I really hope it does , since like I said , our 4 kids miss him so much , as do I of course 

    I wouldn't say easy to forget, especially if he hasn't had many interactions with the police.  Perhaps it could be some nerves getting in the way of his memory during the interview?  Or he is embarrassed and doesn't want to tell you what happened.   Unfortunately the only thing you can do at this point is wait to see how it pans out.  Good luck!
