Short update on our K1. We submitted the packet 3 on Monday 3/19, and we received the packet 4 on Tuesday 3/20. My fiance was not able to schedule the medical last night, but she was able to schedule the interview for 4/3. If she can't get the medical scheduled in time, she may have to reschedule the interview, but hopefully not.

Hey all! I've had a question for a while and haven't really been able to find any direct answers about it. So I thought I'd ask you guys!
Can couples choose to have a small non-legal wedding with family while still waiting for their approval? Like if it's just a ceremony done before God is it still contradicting the K1 visa process? I know some friends that actually opted to have their (non-legal) marriage before their approval and it didn't affect them with their visa approval.. and they're now approved, but I'm not sure if they'll have to keep it a secret once they have their interview or not..
anyone have any insight on this topic? I'm very curious..
People have been denied for appearing to be married while applying for the fiance K1 visa. I would say don't risk it. Wait until you have your visa in hand.

Hello... FYI
i am using an attorney and I’m currently in Day 258... apparently calling and opening an inquiry is the worst thing to do this far in.
I opened an inquiry because of being so far in and I was past normal processing times. I screwed my self because even though there is no update, my case was already approved with a NVC number. The inquiry request caused the NVC to send my case BACK to the USCIS and now I have to wait for the bloody thing to get there so they can respond to the stupid inquiry. I screwed my self by calling and I only called because everyone here was calling....
so, if you’re thinking of calling... DONT.
That seems absolutely crazy!!!! The USCIS couldn't tell you that the case was approved and sent to the NVC without having the case sent back to them. I'm sorry, but that is just stupid on their part.

Make sure you are using the most current copy of the I-129F form.
-
Have you called the NVC office and asked for you NVC case number? It is not the WAC number. You can then track the status of your NVC case number on the following website.

Regarding the USCIS app by Spinach and the USCIS website . . . are these just for the NOA1 to NOA2 stage of the process? Mine didn't update after NOA2 and still just shows "received." Have others gotten updates from the app/website about the NVC, embassy, and AOS stages. Thanks - Jason
Yes, the USCIS app and website are only for the NOA1 to NOA2 process.
You use the following website to track your case after NOA2. You will need your NVC issued case number, not the WAC number.

I didn't submit a TOS for the site I met my fiancé on....no rfe, got noa2, now case is in transit to embassy.
We didn't name the website where we met or provide TOS, and we got NOA2. Our case is at the embassy now.

The old saying "Don't put all your eggs in one basket" applies here. You should include several types of evidence if you have them. You don't need 30 pictures. Many people use only 3 or 4. Chat logs, phone call logs, cards, letters, etc. are pieces of evidence most people use.
I agree. You should include several different types of evidence, including chat logs, emails, or whatever.
Also, include copies of airline tickets. They will confirm the date that you met in person, and that it was in the past 2 years.
-
I put the passport photos in a separate plastic bag and stapled the bag to a sheet of paper labeled "Passport Photos".
-
FYI, I typed everything on the I-129F. I used N-A where it allowed dashes, and I used NONE where it did not allow dashes. My form was approved for NOA2.
-
If you are not a sponsor, then you don't need any of those documents. But your family (whoever is the official sponsor) will need to provide letter from the bank, letter from employer, etc.
See page 3 "Supporting Evidence" in the following I-134 instructions.
https://www.uscis.gov/sites/default/files/files/form/i-134instr.pdf
-
Part 1 will be your parents or grandmother's information. Not you, since you are not the sponsor.
Part 2 will be your fiance's information. She is the beneficiary.
Part 3 will also be your parents or grandmother's information.
Note: In part 3, questions 26.a through 37, your parents or grandmother will enter NONE, since they did not file the K1 Visa. If you were the sponsor, you would enter your fiance's information in this area.
Part 4 will also be your parents or grandmother's information.
Parts 5 and 6 will depend on whether you used a translator or hired someone to fill out the form for you.

It seems so arbitrary who gets approved early and who gets approved later. We got our NOA2 after 190 days (1/31), and yet others are well over 230 days with nothing. I hope that everyone will get their approval soon. I still get excited with each person's announcement of their approval.
Hopefully, we will be submitting our packet 3 on Friday, and maybe we will receive packet 4 next week. She cannot schedule medical or interview until she receives packet 4.

Once you get your NOA2 approval, you should go ahead and start getting those items, so that you can mail them to your fiance. Depending on the embassy, she may need to mail them to the embassy as part of packet 3, or she may just take them to the interview.

I don't know that, but thanks, I will ring them again tomorrow and ask! They are closed today..
Apparently, the NVC office has been closed several days this winter due to the snow storms.

Our case is in Administrative Processing after the interview. I stressed myself out so much about resigning tomorrow that I nearly ate a whole pizza. I hope that other July filers have a more effective way of dealing with stress. The July thread seems to have dwindled a lot. Have people run away after NOA2? I am still here to support peeps.
4 hours ago, Lucy123123 said:Not run away but kinda feel bad that we are moving forward when so many people are still waiting (if that makes sense) I have my medical on Friday and interview on the 3rd April. I have so many different emotions it's crazy.
I am still here also. I hope the remaining people get their approvals soon. We have had several delays since getting the NOA2 on 1/31. We needed an Apostille stamp on her birth certificate from Russia, and then an official translation into English. Hopefully, she will be able to submit packet 3 on Friday. Then we wait for packet 4, so that she can schedule medical and interview. Greece does not allow scheduling these prior to submitting packet 3 and receiving packet 4.

I agree with the previous posts. You do not need to include the G-325A form. Check out the following directions for the I-129F form. This is what my fiance and I followed.

I agree with the previous posts. Do not include binders or sheet protectors. Just staple or paper clips the various items together. You want to make it easy for them to see what you have included. Just make sure that you include everything required for the I-129F form.

You should get your NOA1 very soon. It is probably in the mail already.
The time from NOA1 to NOA2 has gone from 50 days to 200+ days in the past year. It is probably a combination of both stricter vetting and an increase in applications. There are signs that this time is starting to decrease, so hopefully you won't have to wait as long as those of us that filed last summer. My fiance and I were lucky compared to many folks. We waited 190 days for the NOA2 approval.

I have 5 topic questions regarding the required documents to send in with the petition for the K1 Fiance visa (the I-129F) to the USCIS. If you guys could, please answer the questions with the corresponding question numbers to help keep your answers organized. Thanks.
Question 1: What is an official US gov website listing all the required documents to send with the I-129F? I found one here: https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-fiance-k-1.html#6 But it really doesn't say anything about what to send except for the actual I-129F. I've checked other websites for the list of required documents, but how legit are these other sites? Are all the things on these other sites REAL REQUIREMENTS or just recommendations?
Look at page 10 - What Evidence Must You Submit?
https://www.uscis.gov/system/files_force/files/form/i-129finstr.pdf?download=19 minutes ago, SebastianOs said:Question 2: Is the G-325a form still required? My research suggests that the G-325a is important for getting a green card, but I guess I don't have to worry about that for now? Also, some research also suggests that the G-325a is no longer required and was actually replaced by the Form I-130A which is to be sent with the I-130 petition, which, I am not sending that petition, only the I-129F. I'm just a little confused about if I need the G-325a to send with my I-129F petition for the K1 Fiance visa. Also, is there a difference between the G-325 and the G-325a?
No, you do not need to submit form G-325 or G-325a.
9 minutes ago, SebastianOs said:Question 3: Some research I did says I need one 2x2in photo of me and one 2x2in photo of my fiance. But my research said I'm suppose to attach these to the G-325 form as part of the biographical information. But again, is this still required? I'm so confused.
Yes, you must submit passport size photos. See page 11 in the link above.
9 minutes ago, SebastianOs said:Question 4: When they ask for photocopies of my passport, do I need to scan every page? Do I need to make it into a book? What exactly do they want? And some research says they want my passport photo. Does my girlfriend also need to provide a passport photo? Then shall we send in our passport photos to the USCIS for the K1 Fiance visa? Does she need a passport before I send in the I-129F?
We did not submit copies of every page, only the identification page in Passport.
9 minutes ago, SebastianOs said:Question 5: I don't yet meet the income requirement for the K1 visa. But that was last year. This year, I know I can make enough to meet the requirement. The problem is, I can't give them such information yet, as the year is obviously far from over. And aside from that, I am still living at home with my parents, so should I tell the USCIS they are my joint sponsors? Do I need to send in information about my parents' income with the I-129F now or later if asked for it?
You do not need to worry about income at this point. You will file the I-134 form after you get your NOA2 approval.

Edit your timeline, and you should see a section like the following.

Date Package Received By NVC :
Date Case #, IIN, and BIN assigned : < this is the date you received MNL #
Date Package Left From NVC : -
If you are preparing the I-129F form, you can use just a regular copy. My fiance and I submitted just regular copies of our birth certificates, and we were approved with the NOA2. You should take certified copies when you go to the interview, just in case they ask for them.

My fiance lived in the US when she was a teenager as an exchange student. I answered YES to question 37, but I wrote N-A to question 38 a-h. Our I-129F was approved with NOA2, so they accepted my answers.

Not all embassy's use packet 3 and 4 this way, but here is how it worked for us.
Once our case was sent to the Embassy, they quickly sent us packet 3, which is a long list of things we had to submit. It included the I-134 sponsor form, police reports, birth certificate, passport photos, etc. Once we sent them all of that information, they sent us packet 4, which is directions on how to schedule appointment for the medical and interview.
