    Who is sponsoring you?
    How have you found this job?
    What duties you will perform at this job?
    What experience do you have?
    Where is the job located ?
    Are you married?
    Have you  been to the USA before?
    This is just what I have seen on other forums and what our lawyer told us. Best wishes, and let us know how it goes.

    It sounds like you are in the US right now. If so, you can do AOS fine...no need for a new visa.

    Marriage to a USC permits concurrent filing of the I-130 + I-485. No need to wait for approval first.

    That post was confusing... how could that person have gotten the labor certification and passed the USCIS application process without the required minimum experience?

    That's good. I am not a lawyer, so go with what he/she says.  Each case is different, and I;m sure your lawyer knows what she is doing. Tell the truth and be honest, that goes a long way. Best of luck! Let us know how it goes. When is your interview?

    No you have it wrong. The ten year bar is for unlawful presence, and there is a waiver for this.
     
    The 212(9)(c) ineligibility is a "lifetime bar." But a waiver is available after ten years. 
     
    He has two ineligibilities. One for unlawful presence and the other for unlawful crossing after prior unlawful presence. The 2nd is the more serious issue.

    Update our expedite was approved and consulate called us a few days later and requested husband come to Jaurez immediately. He has been home for 2 weeks after being gone for 18 months.

    4.25/h that's insane. I worked as a nanny  10 years ago and made 15/h . I don't think you'll get anything from the lawsuit, get married, get your GC and move on with a better job.  I get so irritated when people take advantage of other people.

    their is no downside to working 'unauthorized' since it is fogiven. it is the same as overstay tho. so basically it is only forgiven when married to a USC and of course, if you are out of status they can deport you anytime. but honestly, i would have done it again in a heartbeat:) i got married and used my SSN from college and it wasnt a problem! in fact, i called 4 lawyers and they all said it was not a problem and actually told me to work lol

    Working UNAUTHORIZED is not grounds for inadmissability! i worked unauthorized in the US for 3 years and wrote it down on the AOS applicaiton (i used my social and paid taxes) and they didnt even bring it up bc it is a NON issue when you marry a USC it is forgiven. 
     
    they pbviously just dont believe the relaitonship si real, which is crazy, so get more documentations!!!

    He could have pushed a long-term solution in a humane way, without pulling out the rug from underneath hundreds of thousands young ppl.
    If this long-term solution fails to materialize no one but Trump owns ruining the life's of all of them. Not that I think it'll keep him up at night. His soul is like a rotten apple. To think I at one point had hopes that he could prove so mny of us wrong.. 
    I don't see "shrewd business" in anything he does... I see him wanting it to look that way - he can't run a business and he sure as heck can't run a country. He has no morals and a country exists in the realm of living ppl not in an isolated world of pluses, minuses and percentages.

    It's totally correct. Please, read more about the job visa, even no brilliant people get a job visa and not necessary here are not Americans to fill up the vacancy, it all depends of the Company and the lawyer.
    I know it well by personal experience, all my family including me, we came on a job visa each one.

    Our case has finally made it to NVC. Payed the visa fees today, and we are filing my  waiver next week.  I'm so excited and nervous at the same time.I can't believe that after all these years, after many sleepless nights and many tears we can finally see the light.  I pray for an approval on my waiver and a smooth process from here on.

    Hi yes I think the lawyer I am with now basically only works on waivers and I have looked up on places like here and others and she has a good name and people only say good things about her. 
     
    There is a lot of background to this and my mother was through a lot in the past with trying to keep custody of me and with my parents separation which to put it nicely was very crazy. 
     
    Hopefully something might come of it yet.

    NOTE: If your I-94 is non-date specific, i.e D/S (Duration of Status), then Unlawful Presence begins when an Immigration Judge or USCIS adjudicator declares you have violated your status.
