    $420? Still not a big deal.... its not like leaving the country at a price likely much higher than $420) and starting over as some have indicated... leaving and starting over to me now that is a BIG deal that can be avoided

    if you marry two weeks after the i-94 expires, she stays here and you file the i-130/i-485 rather than just the i-485 had you gotten married before i-94 expiration. not a big deal

    and I say it is irrelevant... pick the one you used to enter the USA because that is how they have his entry recorded (as an Italian NOT as a Ecuadorian)... After your greencard whichever one is irrelevant anyway as the only thing you need to get in to the USA is the greencard... no passport required

    Please don't confuse things unless you have direct knowledge that it will..
    My son was born in Moldova, but entered on his Ukrainian passport... We noted him as Ukrainian nationality.. Absolutely NO issues during I-485/AOS process whatsoever... His greencard says simply says Country of Birth : Moldova. NO CONFUSION.

    YES and it must be done at a USCIS civil surgeon... You cannot use your personal doctor (unless they are also a USCIS civil Surgeon as well)

    NO.... not necessarily... there is also a substantial presence test that can allow the K-1 visa holder (who is not yet AOS approved) to be treated as a resident alien for tax purposes
    AND
    if all else fails, then there is the special provision for the non-resident alien spouse to be treated as a resident alien by special election...

    how do you know even more experienced people are in the K-1 forum MORE than the embassy forum? The K-1 gets more posts because people don't think and they just post any thread topic to the K-1 forum...
    Do you think jim, gary and push just troll the K-1 forum? do you know about the "view new content" button? all the "experienced" members do. If you put it in the right forum it will be seen by jim, gary and push as well as a host of others...
    just an aside... your answer is consulate specific so I am not sure Jim, Push or Gary will know the answer exactly... but common sense would dictate rather than waiting for some members of a immigration info board to happen upon your topic, to just do it yourself and ask. All consulates have e-mail accounts and as you mention fax numbers, and since a K-1 is handled by the IV unit... I guess you can tell which one to contact

    Filing the I-102 with the package won't help as the re-issued I-94 comes to you not them... and can take quite a bit of time
    If you file the I-130/I-485 without the I-94 then you will be issued a request for it with a very short reply opportunity. If you don't reply withing the stated time frame your I-485 will be rejected and you start all over... best bet is to have the I-94 in your hand before submitting the I-130.I-485.
    Even better bet is to remember the law firm and get your stuff back

    the issue of intent was dealt with at the time of entry... if the CBP felt you had intention to immigrate you would have been turned back at the border when you entered... as long as you did not make any statements at the border that now could come back to be considered misrepresentation, then just do the I-130/I-485 AOS route and you will be fine...

    you need to check the CA DMV for the license requirements... quit sending her back there until she has the needed immigration documents/status. This is not a CA only issue... it is pretty the same much nationwide for K-1 entrants
