If for any reason they need to do more checks or whatever, AP can be anywhere from 3 days till 1+ year (idk if Cambodia is a hard consulate to go through) Don't book any tickets etc for your husband to the US until the visa is in hand.

    Yeah I’m getting a one way ticket there. And I was planning to purchase the return ticket back hopefully with my husband. I’m just unsure if 2 weeks will be enough time.

  2. Hello we just got our interview date for 03/11/19. I’m wondering once we are approved, how long it will take to get my husbands visa? I’ll be attending the interview with him and I have about 2 weeks of vacation and I need to plan accordingly. Thanks!

  3. Hello I also just received my interview date in 3/11. I’m planning to arrive there one day before the interview. My question is once  we pass the interview (wishful thinking 🙏🏼🙏🏼🙂🙂🙂) how long does it take for us to get the visa? My thing is I only have 2 weeks of vacation. I’m buying a one way ticket there then once he passes we’ll buy a return ticket home together. Would 2 weeks be enough time?

    I submitted 2015 - 2017 tax transcripts. All of my documents are accepted and I got case complete now just waiting for an interview date. 

  5. Hello everyone! Sorry this might be a long post since I went to give you a little background and explain what I’m having trouble with. 

    Sooo I am so very lost about how to file this year. 😢 Last tax year it was fairly simple. Single, no kids, no dependents. I filed in January 2018 right before marriage.

    I married my husband February 2018. We filed the petition in late March 2018 and currently we’re at the stage where AOS has been approved. Just waiting for his civil documents to be reviewed/approved.

    So after reading this thread, I kind of know what to do but I need to ask some questions to clarify and confirm.

     

    Steps I know I need to take (correct me if I’m wrong)

    1. Apply for a ITIN for my husband. 

    2. Complete form W-7 and attach to tax return 

    3. File as Married file jointly 

    4. I will need to print out completed tax return and send my mail

     

    Steps I am confused about:

    1. Why do we need his actual passport? Who am I giving/sending it to?

    2. My husbands job back in Cambodia is more of an “under the table” job. Where his employer pays him cash every month so there’s no documents of him getting paid. How do we include this in the tax return?

    3. I file my taxes myself and it doesn’t let me skip the part where it asks for my husband’s SSN. He doesn’t have one obviously so how can I get past this section?

     

    Any information would be super helpful and greatly appreciated!!

     

     

     

     

     

     

  6. Hello, I married my husband Feb 2017 and we are at the NVC stage of our process. 

     

    I normally file my own taxes on freetaxusa. So I put it in as “married, filing separately” but it asks for my husbands SSN and it doesn’t let me get past that page unless I put in a SSN. He obviously doesn’t have one yet so how should I file exactly. I know I definitely don’t want to file as “Single” so how do I get past the page without him having a SSN yet.

    Or should I just cough up the money and go to H&R Block since this is a little tricky situation? 🤯

  7. Hello everyone,

    Currently at the NVC stage here.

    I requested both the Account Transcript and the Tax Return Transcript from the IRS because I wasn't sure what the difference is.

    This might be a silly question but which one do I upload with the Affidavit? I'm thinking the tax return transcript but I'm not 100% sure.

     

    Also, why can't I find the DS-261 anywhere on the  CEAC website? I see that we have to choose an agent but I can't seem to find it anywhere .

    Yeah those are enough. We were recently approved and we did not include any bank statement or anything of that sort of our name together. I submitted some wedding photos, lots of other photos of us together with family, a couple pictures of us kissing on the lips (so they know it's real 😉), messages and call logs.

    On another note, since I notice a lot of approvals getting approved by mail i would like to share with you all that you can subscribe to USPS for free with your email and you will be able to track/preview all incoming mail to your address from your email. I have been checking my email daily to see if I received the approval letter yet instead of going home from work to check the mailbox. The link is below.

  10. Hi, does anybody know why no estimated date pops up for my timeline for when my 1130 will be approved?? It shows the below message. What does it mean. Did I input something incorrectly? I know it'll be sometime around September/October but having a date to see gives me something to look forward to at least :rolleyes:

  11. Hello, so I filed the I130 back in March for my husband. My noa1 date is 03/26/18. I'm expecting to receive Noa2 around September assuming no RFE.

     

    Me and the hubby want to meet up one last time before his interview (I'll be heading to cambodia to attend the interview with him as well). We're not sure when to expect his interview. Will it be this year or next? How long will the process take from NOA2 to interview?

     

    So basically we want to go on vacation in November around thanksgiving to meet up in Thailand. That's the only time I can get off work or else it would be earlier. Last time we saw each other was Early march when we got married and we miss each other a lot ;( Do you guys think that is a good idea? Or is it cutting too close to when the interview will be? (Even though I have no idea when to even expect that) :wacko:

    Anyways, priority date does not apply to usc spouse petitioners but if your petitioner is LPR, for some visa class they have family preference / they need to wait till visa is available meaning : after their I130 is approved they will not be able to start nvc till their PD for their visa is current - sometimes up to a few years wait. (I’m not sure which ones are affected but you can check it on USCIS website) 

    After reading your comment, it made me re-read my email confirmation cause I know I'm never lucky with these things.... and it was actually sent to Potomac and not Vermont :')I guess it was just wishful thinking :rolleyes:

    At least you can marry and move forward should you choose.  However you may want to talk to your fiance about the denial reason before that.

    Signed waiver = privacy release so the senator's office can inquire on your behalf (see senator's web site), fill out, sign, send or fax.
    Sometimes it is hard like pulling teeth to get the reason out of the embassy.
    They may say they can not say because it will violate the beneficiary's privacy and sometimes they will inform the senator's liaison.

    i really think you are wasting alot of time worrying about this K1 denial,. you should fly there tomorrow and get married! then apply for CR1.  then see what happens and go from there.  i know the wait will suck, but this seems to be the easiest/safest and best approach.  then you will figure out is it just they dont believe your marriage is real or is it an actual misrep ban.  then you can move forward from there! because either way, your K1 is DEAD their is no way to get that back or appeal it. so either you file a new K1 or you file a CR1! Everyone here will agree, filing another K1 is a waste of time.

    The difference between a fiance and spousal visa denial is what happens after the denial.  A spousal visa would be sent back to the USCIS and they would send you a NOIR (notice of intent to revoke) and you would submit more evidence for specific things.  Then it would be sent back to embassy for another interview and they cannot deny for the same reason as before.  Basically until the USCIS denies the I-130 you can keep interviewing or sit in AP.  With a K1, the I-129F has a self life.  So even if it's sent back to the USCIS, the petition will expire and you have to start over.  Often there will be no explanation of the denial other than the main letter.  While I admit I dont spend a great deal of time in the K1 forum section, I do not think it's common for an embassy to extrapolate on their decisions when it is a K1 visa.  

    There are some embassies and consulates where the petitioner needs to be there regardless of what the official stance is.  There are some embassies where even though the petitioner isnt allowed into the embassy for the interview, but just being there is a huge plus and can make the difference between an approval and denial.  

    I do not feel that another k1 would be beneficial for you.   While you're trying to get answers you probably should be planning a wedding and moving in that direction.  On a personal note that is a generalization of course,  I have noticed many men do quite poorly when they arrive on a K1.  Anyone who is used to working and sustaining themselves do really.  The inability to work for about 4 months strains a new marriage incredibly so a cr1 may be a better choice.

    Op.. this was not a misrep denial. 212(a)(6)(C)(i) is a misrep denial but a 221g is just a denial and they dont believe the relationship is real.  Go get married and file again with a CR1.  Try to be there for the interview this time. Best of luck.

    The Grandmother/Aunt scenerio does sound like it could be an immigration setup.  That can be easily handled with the correct front loading of a new CR petition.  It may be tough for another K-1, though.

    Oh idk others are saying that it's useless to file for a spousal visa until I know the reason of the denial. 

    I'm not sure what to do. I can file for the CR1 immediately after the k1 denial? Not sure how that works.

    They will tell you about it when you call or drop by.  It's standard practice.  When you open a case at your congressional office they ask you to sign a waiver giving them permission to discuss the case with DOS on your behalf.  It's just a one page form.  They can't/won't do anything without that waiver. 

    Every congressional local office has staff members who specialize in different issues - ranging from federal benefits to immigration.  You will get a "caseworker" from his/her staff who specializes in immigration and that is the person who will follow up for you.
