    We are approved (09/21)! 
     
    Only old web site / case tracker app was updated.
     
    02/20/2018 - NOA1 (new web site)
    09/07/2018 RFE was mailed (only old web site was updated)
    09/10/2018 RFE was faxed 
    09/11/2018 Response was sent 
    we haven’t signed the RFE request, we replied with faxed copy
    09/12/2018 Response on RFE was received (only old web site was updated on the same day)
    09/21/2018 NOA2 (only old web site and app was updated).

    It all depends on your embassy from NOA2 on out. Since you don't have a complete profile showing this information, it makes it difficult to help.

    Our NOA2 came through in the post today! No email no site update. Our RFE has taken 17 days from when USCIS received our response. Surely it’s a sign for everyone else!!! 😍😍😍😍😍 
     
    I actually have no words to describe how I feel right now. Been a long road but now it’s finally moving 😊
     
    Everyone that is patiently waiting, hang in there, your time will come xxxx

    Hello all,
    I am a December,2017 filer.
    And after 265 days OUR CASE GOT APPROVED 
    As per USCIS old website.
    NOA1 (Old Website): December 26,2017
    NOA1 (New Website): December 29,2017
    NOA2 : September 14,2018
    Both websites have been updated now.
    Received the physical letter yesterday.
     
    Just keep patience and wait. All approvals shall come. I know from experience it's very painful to wait but just keep going.

    We received our approval (NOA2) today (09/21), so I’m joining this thread (finally 🙏🏻).
    I do really hope the NVC stage will go faster than USCIS stage! 🤗

    Hi guys, I have an update
     
    I just recieved an email from NVC saying they've recieved our case and confirming our LDN case number. So we can go ahead and book the medical and interview! 
     
    I filled out the Ask NVC online form out 4 or 5 days ago and got this response today

    Hey guys, just wanted to update I received my NO2 on August 31 and NVC sent me an email with the following yesterday: 
     
    We recently received your visa petition. We will send NVC processing instructions within 8 weeks. Please resubmit your inquiry if you have not received any information after 8 weeks. 
     
    its just funny to me because this whole process is just deadlines. 5-7 months to process the application, then 45 days to hear back about your inquiry if you’re outside of processing times, then 6 weeks to transfer your case from USCIS to NVC, now 8 weeks to send out a simple email with processing instructions!!!! Really?!? If I waited 8 weeks to work on one task at my job I’d be fired. I just hope I’m not old and gray by the time this is over 😂

    Your fiancee is a girl, there is no need to worry, if she is just careful enough. It is much safer to travel to Ukraine than to Georgia for a girl, believe me. 
    I traveled by train with my mom and alone to Kiev and Lviv in July, absolutely no trouble whatsoever.

    I’ll tell you my story: my fiancé called NVC several times before they got out case (it took them three weeks). Every time he mentioned Kiev. But they couldn’t do anything without a case. Alright.
    Then he called and they finally had it that day. He asked about a transfer. They said to fill out the form on their website. I did it the same day.
    Our case was at NVC for 13 days.
    I think I already told you that I never got an answer to my request.
    We called two more times during these 13 days. We were told that they “will reply when they will reply”.
    Here we are, our case made it to Moscow today....
     
     I would be truly happy for you if you are able to do it. Just don’t really count on it... Cause we did all we could and... ended up in Moscow anyway😂 It’s like “all roads lead to Moscow” now.
    So I wish you the best of luck and be sure to let me know how it goes for you!

    I completely understand. I would suggest transferring your case to the US Embassy in Tbilisi. Aeroflot has cheap flights to Georgia, and it will save you 4-5 months of waiting. Just my two cents.

    I did see an incident there with customs which I thought was absolutely crazy.  I was leaving Kiev for a departure flight and sitting in one of the priority pass lounges.  A group of customs border agents (with machine guns) came into the lounge and started talking in russian to the guy sitting next to me. I dont speak any russian so I had no idea what was happening but I knew it wasn't something good based upon their tones.  After they left I asked the guy if he spoke English and he did so fluently.  I asked him what that was all about and he said he is a Russian citizen and he travelled to ukraine to visit family.  THe customs border agent at POE told him he would not be allowed into the country at the moment.  He didn't give him a permanent refusal - it was just a one time thing.  He didn't give him a reason and just said you wont be allowed in  right now. I am not giving you a permanent ban - just a time ban. He told him he would be allowed in later today or tomorrow but would have to take a flight out of the country and then re-enter.  THe gentleman proceeded to tell me that they took his passport and they would give it to him upon him getting onto a plane and departing the country. He was waiting for his flight to Belarus i believe and then would take another flight back to Kiev later that day.  I told him that it makes absolutely no sense and he said he thought it was because of the political situation.   I did ask him if why he didn't just bribe them and he laughed and said I dont want to risk anything and end up in jail.   So why I think what happened to him is rare - your fiance has valid concerns - and it appears as if the border agents can do as they please.

    I believe they arrive at the NVC in batches and are processed and assigned a case number within a few days of arrival. Not all embassies receive them as quickly from the NVC, however, as some embassies use an electronic system while others use good old fashioned paper. One telltale sign is some embassies will e-mail Packet 3 within 24-48 hours of the NVC assigning a case number. Ukraine is one of these countries I know of for sure.

    D&J your lawyer is wrong. They continue to send RFE's on K-1 applications if you are lacking information that is required to complete your file for proper adjudication.

    MDMA it was issued back in July but does not apply to everyone, especially the K-1's
     
    There are many varying degrees of RFE's. Some as simple as not "ticking" off a question. Others, forgot the fiancé(e) letter and then others who met on a website and now need to prove that it wasn't a marriage arrangement website.
     
    I got a hold of the memo and read over it and there is so much in there to explain but it has nothing to do with K-1's.
     
    Basically if you are applying for a benefit (visa) and you are not eligible for that benefit or you are not using the benefit for its intended purpose then the adjudicator doesn't have to send you a RFE or a NOID. Just VOID. Done!
     
    But if an application is received with an error or missing documentation and is the intended benefit then the adjudicator is obligated to complete the entire processing up to and not including the approval, but must combine all RFE's for that case into one request. If the adjudicator determines that the application is a "place setter" application, meaning they don't have all their information at the time of filling but hey USCIS will send an RFE and then I can respond with my missing documentation that I now have.  In the past they may send out a RFE letter then two weeks later send another RFE for a totally different circumstance tied to the original submission. The memo requires them to ask for everything in one letter.
     
    So there are many good things in the memo. One just has to take the time to read for themselves and not rely on CNN or Betty Lou over in the Jamaican thread who is afraid that the sky is falling in on her K-1 visa with the intent that she is going to get denied.
     
    Believe it or not the spirit of this letter was promulgated in the Obama Administration. This administration is only trying to get the rules so that they are followed. There isn't anything in there that is made up without a reason now or from the past.

    NOA2: Sept 6th. No hard copy yet. Fiancee is done with DS-160 and is going to find out if she needs the NVC case number in order to schedule her medical on Monday. She's been super awesome and proactive with everything, doing tons of research and gathering all her paperwork. When I told her we were approved, she asked if the I-134 was in the mail yet, in a very serious tone, then bust up laughing. 😂 We want this next phase to be as short and painless as possible.

    I was previously notified on Sept. 6th via text and e-mail that there was a change to my case with a link to the new website. My case was approved on the new website. I received my NOA2 hard copy yesterday from a neighbor who had received my NOA2 in error. Today I got another e-mail and text saying my case had been approved with a link to the old website. Now everything says we were approved, in case there were any doubts. 😂 The only difference is the new website and hard copy show Sept. 5 as my notice date and the old site shows Sept. 6. There's no significance to that, just interesting.

    Hello, guys! I've been a lurker since January but now I'd like to share something with you. I've been complaining to my fiance nonstop since last month because of the wait and I always tell him that I think it's unfair because he wasn't stressing out as much as I did (I'm the beneficiary). You see, I already resigned and was unemployed since August 28. He would only tell me, "Just wait. It will come."

    Last Sunday, I went to church and the message was all about faith in waiting. Just like the Chinese Bamboo Tree. Once you plant it, you would only see a bamboo shoot in a year and it stays that way for 5 years. But the bamboo farmers don't complain because it will eventually grow at a rate of 90 feet in six weeks. You see, its roots grow underground in those first 5 years. We just can't see it yet. And beginning that Sunday, I was calm and happier. I didn't check VJ as much and I only prayed and kept myself busy.

    And voila, just this morning here in the PH, my fiance got a text from USCIS (around 9pm NY time) that an action has been taken on our case. I was shaking as I checked the old site. And OMG! WE JUST GOT APPROVED! 13 has always been lucky for me. No update on the new site, though.
    NOA1 (old site): February 28
    NOA1 (new site): March 3
    NOA2: September 13

    So for those who are still waiting, hang in there. We won't realize the value of the blessing if there was no waiting. All this waiting makes us stronger as a couple. We just have to look at the bigger picture. I just can't wait until I get to hug my love!

    Just an update - received notice of an RFE August 30th and received it September 4th. My fiancé missed one box on our form. He mailed it back on September 6th. Just got notice they received it today and that “Our California Service Center will begin working on your case again” lol. Hopefully we hear soon.

    Hi All
    Been reading February and March threads since my NOA1  has 2 dates (old 2/27 and new 3/1). 
    Received a text then an email today (new website) saying we were approved as of 9/13. I’m currently in Manila with my fiancé and today’s date is 9/15 (but 9/14 in the US).
    Like everyone else in this forum, I too have waited (sometimes impatiently) but keep the faith guys, all things that’s meant  to happen will happen.

    I couldn't believe it when I just checked the old site but it says we're approved! New site still not updated. My goodness I didn't think it would happen.

    But I only knew today the 14th by the old website. The new still shows received.
