It depends on where you are in the progress. If NVC hasn't touched your case yet, so you need to wait 2 months for it to take effect. If NVC is processing your case, so yes, it takes only couple days, 2-5 business days to upgrade the visa categories.

99.99% standard service fits your timeframe. No worries. But if you need something 100%, pay $60 go with expedited service.

    Cause:
    1. It’s cheap. Just $30.00
    2. It looks good. Better than the driver license.
    3. It can be used as a second form of ID.
    4. It’s powerful.
    5. It’s extremely light. You can carry in your wallet.
    6. It saves pages on your passport book. No need to renew if travel regularly to Canada or Mexico.

    So, I’m wondering why not?

cybermax got a reaction from helloearth in N-400 Filers who got stuck or delayed in Background / Name Check.
For all of you guys, if you didn't read what I wrote on the previous page, I quoted it here for you guys, please read:

"Let me share with you this. I'm the original poster of this thread. Meaning I had been stuck in background/ name check for a long time just like you. I did research and tried a lot of things to push my case forward too. Unfortunately, nothing worked. It's hard to accept this but if you are stuck, that means you are STUCK, you can't do anything until the FBI finish their job. I guarantee with you that no matter what you try, it's not gonna work, so don't waste your time.

Here is the truth, there are only 2 scenarios here:
    1. If you are stuck, and have not been stuck for a year (count from the date you submitted your application). So you are fine, nothing you can do but wait. Your case is gonna be automatically cleared when it approaches 1 year. This happened to most of cases ( > 90% )
    2. If you have been stuck for more than a year. Meaning you are so unlucky and having 2 options:
----- Continue waiting until the case cleared. Nothing guarantees when it occurs, normally 1.5 years to 8 years, or more, this is what a USCIS officer told me when I had my infopass.
----- Take your action: file a lawsuit against USCIS . This works most of the time and really push your case forward by forcing USCIS to pay attention to you. But this does cost money. According to people who recently filed the lawsuit, they spent around 3k upto 7k for a lawyer to do this."

Also, if you are one the people in case #1 above:
DO NOT TRY TOO HARD FORCING USCIS DO SOMETHING FOR YOU.  THEY WILL NOT AND CAN NOT DO ANYTHING BUT GIVE YOU A FLAG IN THEIR BACKEND. THAT MAKES IT WORSE AND DELAY THE REVIEW PROCESS.

    PD: 08-04-16 (F2A)
    Scanned: 11-06-17
    CCC: 12-01-17
    Upgraded: 01-25-18 (CR1)
    Interview: 03-26-18 (HCM-Vietnam Approved)
    Issued: 03-30-18
    Flight to US: 04-16-18

We got approved last Monday. The process went through quickly and smoothly at the US Embassy in Ho Chi Minh city - Vietnam. The whole waiting process for checking, scanning, taking documents and interview is around 2,5 hours but the interview part is just 2 minutes. A beautiful young lady asked me to step back and had a seat while she interviewing my wife. We brought 20 lbs of evidence but she never looked at them. She doesn’t care about log chat, bill, tax return, hotel resevation, tickets, money transfer receipt at all.

    Only 3 questions were given:
    1. How did we meet?
    2. When did we fall in love? (Exact date required)
    3. Show her some pictures that we were both together.

She took the photo timeline binder and went through quickly in just 10 seconds. She laughed so hard when saw our “crazy” pictures. Then she signed  the pink sheet, gave it to my wife and said: Welcome to America, you got approved.

Although it was extremely easy for us but it was not with everyone else in the room. A lot of blue sheet (denied) were given. Some were deinied right away because they didn’t prepare enough required documents. I think fail rate is around 70-80% (all visa categories) as what I see there.

    Good look everyone.

    After the upgrade:
    1. If the case is completed > 1 week wait >  Interview will be scheduled (1-5 months).
    2. If the case is not completed > 2 months wait > Case Upgraded > Submit documents to NVC > 11 weeks wait > Case completed >  Interview will be scheduled (1-5 months).

I have the same problem, unfortunately there is nothing you or me can I do but wait. I recommend your husband to apply for USC. I guarantee with you it's gonna give a push to your case. For me, I filed F2A first, then I upgrade it after I became a USC. It's at least 6 months faster than processing with regular F2A.

Normally, most people gonna go even faster than me. I was stuck with background check before naturalization interview for more than a year. Only 10% people have extensive check like me so no worries.

Just process your case under F2A category than upgrade it later. If the naturalization process goes smoothly within a popular time frame (4-7 months), there is no differences between your F2A and CR1.

For my case, I got married in May 2016. My wife still lived back home. After I came back to the US, I applied ITIN (a Tax ID) for my wife because she is not a US permanent resident or a US citizen and she doesn't have a social security number to put in the tax return 2016. In March 2017, I filed my tax return jointly with her using my SSN and her ITIN. Everything went smoothly and accepted with both federal and state tax departments. I did the same thing for our tax return this year. My wife was scheduled for an interview (CR1) on March 26 2018 coming and we have nothing to worry about. Her name and my name are printed clearly on 2 year tax returns. It's a good point showing a real, trustful relationship with nothing to hide.

If I was the officer interviewing you and your spouse. You told me that you are married but on the paper show that you are single. This is obviously a conflict and take my attention seriously. I'm questioning that why you don't share your financial situation with your spouse and why your spouse didn't report his/her income to IRS?

This is a big mistake, please consider to fix this before the interview.
