  1. I think it would be a shame to not get a passport renewal for your other child, and to miss out on a family vacation, etc. I live in Washington state. My divorce was amicable, and we did share custody and both travelled internationally many times separately with the kids. We would get a notarized consent letter from the other parent, just in case. This was years ago, and maybe international parental abduction isn’t as much on the radar these days, but hopefully there is still some system in place to prevent a non-custodial parent from unauthorized travel with the kids? I would also think that the US passport agency must have some way to prevent the reissue of a minor’s passport to a parent falsely reporting it as lost or stolen. I can’t think of any VJ members to tag at the minute, but hopefully someone with direct and recent experience will come along. Best luck to you.
  2. Yikes. Potentially scary situation. Do you have a divorce lawyer still? I wonder what they would advise? Whatever happens, I recommend keeping their passports in a bank lockbox, accessible only by you.

  7. She cannot enter on a tourist visa and adjust status. That is fraud. She needs to be petitioned for a CR-1 or K-1 visa. Generally, the CR-1 is best, but if her children are young and she wants to bring them, the K-1 might make sense. Maybe the Cat will come along and add his helpful comparison. @Crazy Cat

  12. One thing I’ve learned from both Reddit and VJ is that immigration lawyers, while maybe not deliberately telling their clients to do things wrong, often do. The common denominator here is money. There is money to be made when errors happen and cases are drawn out….. This is why anyone with an average reading comprehension skill set should DIY their straightforward case, i.e. no one cares more about your case than you do.

  15. Right, it's a big consideration for anyone contemplating bringing elderly parents here. I would start doing some math. Luckily, you have several years to plan.
  16. She can’t come in on VWP/B visa with the intent to adjust status. When you’re a citizen, you can petition her for an immigrant visa (leads to a GC- no need for EAD). Hopefully she/you have significant financial resources to pay for her health insurance.
  17. You should seek better and more accurate info than "a guy once told me." It will be many, many years before your brother can come to the US. Up to 30 years, so file the petition and then forget about it.
  18. I don't see how it would make a difference, as there is no 'reset' with a new fiscal year since those visa classes are not numerically limited. It's not a matter of caring. It's a matter of huge numbers of applicants for your consulate.

  20. She wants to immigrate, therefore the F-1 is not an appropriate visa. I don't see any basis for an expedite. Expediting because you don't want to wait the designated processing time is not possible. Expediting F2A and other numerically limited visas is not possible. Seems like you're grasping at straws for a way around the current processing times and available visa types. Waiting and following the rules is just part of US immigration. If that doesn't work for you, another option would be to move back to Nigeria.

  22. What is your plan to provide her with health insurance, since she will not be eligible for medicare? Does she have substantial retirement savings?
