    Check the expiration date on the green card. 90 days before the  expiration date the removal of conditions window open and that's when you can file.

    This is a walk through for doing a joint return using TurboTax Basic 2012. I have not looked at other versions like Deluxe or Home and Business or the online method this year. Maybe the screens are the same, maybe not.
    This is geared toward people who married in 2012 and the foreign spouse moved to the US in 2012. If you do not have a greencard yet, the IRS will allow the foreign spouse to be treated as a resident alien for tax purposes for the entire year by electing to be treated that way. It is a perk allowed to those who married US citizens. There are many discussions about if you are physically present in the US for 183 days, you don’t have to make that written election. I go by this from the IRS:


    First Year of Residency
    If you are a U.S. resident for the calendar year, but you were not a U.S. resident at any time during the preceding calendar year , you are a U.S. resident only for the part of the calendar year that begins on the residency starting date. You are a nonresident alien for the part of the year before that date.
    Reference: IRS Publication 519, Chapter 1
    I think it’s easier for most here to be a resident alien for the entire year, rather than a dual status alien. When you make the election, then worldwide income must be reported, meaning any money the foreign spouse earned abroad. Most will qualify for the foreign income exclusion, so don’t panic and think you are going to pay taxes twice. I personally don’t trust H&R Block to get it right. They aren’t trained on immigrant issues, especially the oddities of K1s. They have steered many people wrong. If you file a joint return, you do declare worldwide income. If you don’t want to do that, then the USC does “married filing separately” and the non-greencard holder new spouse who earned no US income files nothing.
    Here's an example of a statement you both will sign and date:
    Statement: Nonresident Spouse Treated as a Resident
    We declare that on the last day of tax year 2012:
    •Mary Jo Smith is a U.S. citizen
    •Sam John Smith is a nonresident alien
    •Mary Jo Smith and Sam John Smith are married.
    We choose to be treated as U.S. residents for the entire tax year.

    Okay, back to TurboTax
    Begin and fill out your names, address,etc. I’m going to call the people USC for the American and FC for the Foreign Citizen spouse. TurboTax will use your names when you fill it in.
    Some questions that you will come across
    Asking your state of residence. That is mostly for TurboTax to know if you are going to be filing a State Income Tax return.
    For the FC—
    Were you a resident of [state] for the entire year? Say YES for this
    Did you make money in another state? Say NO
    Again, it’s trying to figure out if you need to pay taxes in another state and doesn’t affect your federal return.
    Both USC and FC—
    Do you have children or support another person? Just want to say here that your spouse doesn’t count here as a person you are supporting and your spouse is never called a dependent in IRS language. If you have no kids, then your answer will probably be NO.
    Then work on USCs W2 information. Do not enter W2 information for FC unless they worked in the US and got a W2. Ignore their foreign income for now. Keep clicking “continue”, working your way through each section on income saying yes or no as appropriate about your interest, dividends,rents and royalties, retirement, business items…each of us have different things.
    Next. Next. Next until you finally hit the section called LESS COMMON INCOME. You will see Foreign income and exclusion in the list so say yes at the bottom. It will take you through Alimony, jury pay and finally----
    Did you make any money outside the US? Yes
    What form was Foreign Income Reported On? A statement from my foreign employer
    Enter your foreign earned wages. Put in converted to US $
    Did FC’s income come from any of these sources? NO
    Confirm FC’s wages. Probably no adjustment needed.
    Employer provided goods. Skip
    Enter Amount employer paid you cash for. Skip if none apply.
    Whose foreign income would you like to exclude. Tick the name.
    Did FC live and work outside the US? Yes
    Was FC a citizen? No
    Was FC a resident alien? YES, because to the IRS, you are a resident alien for the whole of 2011 because of the statement you wrote electing to be treated that way.
    Income tax treaty? YES (you'd have to look that up, but NO won't allow the exemption) Treaties are covered here http://www.irs.gov/publications/p901/ar02.html#en_US_publink1000219371
    Do either of these situations apply to you? FC is required to pay foreign taxes.
    Choose how to qualify for this exclusion. Bonafide resident test
    Date started living in foreign country? Probably date of your birth
    Date stopped living there? Entry to US date if already here.
    Enter info about US travel. Self-explanatory
    Deductions related to Foreign Earned Income. Shouldn’t be any. You weren’t moved because of work so can’t take moving expenses for example.
    Foreign address. Enter it.
    Separate family address. No doesn’t apply to this situation. For Americans transferred overseas and wife stayed home maybe.
    Housing. None. Skip.
    Country of citizenship. Type in.
    Employer information. Type in. Tick no US address. Fill in foreign address.
    Type of company (at the bottom of the page). Pick one.
    Did FC take a foreign exclusion before? NO
    Did FC's family live with him? NO. It doesn't really apply except to American's living abroad for work who get exclusions for expenses.
    The next two aren't so important. Again more for American’s living abroad.Just pick something for-
    Did family live with you?
    Describe your housing.
    Does FC have an employment contract. NO. That questtion is for Americans abroad.
    Type of visa? Don't tick any of the four. You don't have a visa TO the foreign country in this question. The United States is not a foreign country on this IRS form. The visa to the US you got is not the visa in this question. For Americans working abroad.
    Does your visa limit the time you can work outside US? Tick nothing on this.
    Next screen should say Congratulations, you qualify.
    Now you can look at your Form 1040. If you did this properly,
    Line 7 should be both incomes added together
    Line 21 will show the exclusion with a minus sign in front of it.
    NOTE: This is general information. Each of you arrived at different times of the year or married in 2012 but haven't arrived, earned a little or a lot, have babies or not, earned wages or were self employed. This can't be an all inclusive tax guide but hopefully will help many of you in fairly plain language.
    If you do the statement, you can't efile this year. I called the IRS and confirmed this twice. I always ask twice because they don't always have the same answers.

    I don't think this is true. As long as you file as married (as opposed to single, which means trouble), you should be good. Married couples have the freedom of choosing their filing status (jointly, separately), basing on what yields a smaller tax bill. In this case, the OP's mother will claim him as a dependent, hence the OP has no choice but to file separately.

    To answer your question
    There is no requirement that you file JOINT tax returns. There IS a requirement that YOU file a tax return (either joint with your husband or separately)and a requirement that you ARE married and living together. A JOINT return can provide evidence of BOTH paying taxes and living together and being married. Very convenient, but not necessary. You can change your filing status anytime you want.
    Just be sure to provide other evidence you are married and live together.

    Hey again everyone.  We went back to social security on the 18th and this time (our second time going because they wouldn't let him submit an application, they said we had to wait 2 weeks.) I thought they wouldn't have a problem taking him in the first week because others on here have done it and from what I read everything's electronic now? But at least this time his application was submitted and we got a receipt. They said he'll get it within 2 weeks. Also, went to pick up our wedding bands but unfortunately my band had to be adjusted again because it was still a tad too big for my small little ring finger lol.  I also got my engagement ring adjusted because that was too big as well. My fiancee picked up his ring that we ordered though, so towards the end of October I'll be picking up mine. We also ordered a keg of beer for the wedding, even though I'm not much of a drinker, were having our wedding and reception in the backroom of a private bar that my mom works at, so we got a discount and it's very spacious. I know others will want to drink, so we got miller lite because I was gonna get lager originally since I wasn't aware it made people drunk quicker. It's a good thing my mom came along because I don't know anything about that. It's probably an unnecessary expense getting the keg of beer because were in the bar, but I know people won't want to pay for it and have to keep walking out of the room into the bar, so I figured it was easier. So, everything is basically done.  I ended up buying a few more things today for the wedding that didn't seem to come to mind right away. Our wedding colors are Purple, White and Black so I ordered some candy for the wedding favors and some personalized wedding tags with our names and date were getting married on it, with a little purple heart. They're so cute, I'll have to show all of you. I got so much candy I'm pretty sure were gonna have plenty to ourself lol. I found these awesome bride and groom candy boxes on eBay for about $13.00 free shipping and you get 100 of them. It took me forever to find what I wanted because I'm super picky but it was worth spending the time. This is the moment I've been waiting for since March, and it feels so good that were actually doing everything now! It's still hard to believe and he's been here 18 days now. The idea of a wedding guest book came to mind and I found a beautiful Black and Red one for a good price. As I write this I'm just paying for the last things (let's hope no more, we spent so much in the past month way over what we anticipated, but at the same time, we were originally just getting married in the court house. The reason why were getting married by a pastor now is because all of the court houses were booked and I would leave so many voicemails and talk to reception but they would never call me back. I'm not sure how it works any where else but they said I had to speak to the judge to arrange our wedding date and I never got to speak to any, even though I called about 7 within 45 minutes of us and all of them were completely booked till the end of Nov or end of Dec. So we just decided to have a traditional wedding but I feel that was meant to happen anyways. I can't imagine getting married in the court house now after all of this. I'm happy everything happened the way it did. So, that's about it guys.  I'm just about to pay for the centerpieces for our wedding and it's a fiber optic rainbow flower piece, which is perfect and Purple at the base. Everything matches as it should and I made sure to keep everything those 3 colors haha. The only thing I didn't hire was a photographer, my aunt is just going to take a bunch of pictures on her phone for me, but since I do want to have keepsake pictures that look a bit professional we bought a backdrop drape stand and I'm just waiting for the seller to get back to me on some specifications for the backdrop. It's Black sequin (of course :P). So I'm pretty happy because even though everything was pricy I know it's only going to make the celebration more exciting with everything we invested into it. I know I already started compiling receipts for AOS even though I won't probably need to send half of them, I'm sending them everything we got for the wedding. It worked pretty well by sending them basically everything to USCIS and taking everything to the consulate. We didn't get any RFE's and approval at 4 months. Consulate seemed surprised yet happy to see all the papers my fiancee took with him. So I'm just going with that approach and I'm feeling confident he won't have any issues getting approved for this next stage of the process. I don't think anything could be as hard as it was when we were separated so to me this is a cakewalk and I don't mind doing the paperwork. So I think I will end it here, sorry for talking your ears off and don't want to come off as bragging but I guess I'm just really proud of how far we've come. I have my favorite cousin who I grew up with giving me away at our wedding because my dad and me don't have a relationship, and my brother is gonna be my fiancee's best man so everything is basically transcending and my stress has decreased massively within the last 1-2 days (ironically, it was a couple of busy days for me.) All I have to say is meditation. It really works.  I'll be back soon and hope you guys take care and stay safe.

    Hey guys! Our wedding rings are available now to pick up, since were on a budget we spent a little less than a thousand on both combined, and yesterday we booked a reservation for the honeymoon for 2 days. A nice jacuzzi to relieve some of the built anxiety from this process. It's much needed, and I'm super stoked and can't wait. It's only less than a month from now that we get married. We only really need to get a half a keg of beer ordered for the wedding, and apply for his social security card. I have everything ordered for the wedding and we only need basic stuff like chips and soda for other people, but I can't believe everything is pretty much done. Catering, DJ, pastor, marriage license, wedding decorations, rings, cake, and all the major stuff is completely DONE.  Now I have already started researching AOS so I can be ahead of this whole process and aware of everything I need to submit. I'm feeling super good about this, and to be honest, I'm looking forward to filing it even though the paperwork is gonna be tiring, but it's so worth it and I don't mind anything. This process has taugh me to be incredibly patient, and while the stress has been so intense in the last few months, I'm actually happy to experience it since I'm not very good at coping with stuff, and have pretty bad anxiety. I'm happier than I ever have been before. I hope everyone else is settling in, and many others have successfully got in the U.S. with their loved ones. I'm so happy for everyone of us here and wish I could personally congratulate everyone for how far we've come. We got so far and did quite a lot to get our loved ones here, and we deserve this. I hope you've all been doing well, and sorry again for my quietness. I had no idea how hard it was going to be to keep up with everything but I like to come on here to post and let everyone know how our journey is going. The only thing I didn't hire was a photographer, my aunt is just going to take a bunch of pictures on her phone for me, but since I do want to have keepsake pictures that look a bit professional we bought a backdrop drape stand and I'm just waiting for the seller to get back to me on some specifications for the backdrop. I know others will want to drink, so we got miller lite because I was gonna get lager originally since I wasn't aware it made people drunk quicker. It's a good thing my mom came along because I don't know anything about that. It took me forever to find what I wanted because I'm super picky but it was worth spending the time. The reason why were getting married by a pastor now is because all of the court houses were booked and I would leave so many voicemails and talk to reception but they would never call me back. I'm not sure how it works any where else but they said I had to speak to the judge to arrange our wedding date and I never got to speak to any, even though I called about 7 within 45 minutes of us and all of them were completely booked till the end of Nov or end of Dec. So we just decided to have a traditional wedding but I feel that was meant to happen anyways. I can't imagine getting married in the court house now after all of this. I'm happy everything happened the way it did. So, that's about it guys. I'm just about to pay for the centerpieces for our wedding and it's a fiber optic rainbow flower piece, which is perfect and Purple at the base. Everything matches as it should and I made sure to keep everything those 3 colors haha. The only thing I didn't hire was a photographer, my aunt is just going to take a bunch of pictures on her phone for me, but since I do want to have keepsake pictures that look a bit professional we bought a backdrop drape stand and I'm just waiting for the seller to get back to me on some specifications for the backdrop. It's Black sequin (of course :P). So I'm pretty happy because even though everything was pricy I know it's only going to make the celebration more exciting with everything we invested into it. I know I already started compiling receipts for AOS even though I won't probably need to send half of them, I'm sending them everything we got for the wedding. It worked pretty well by sending them basically everything to USCIS and taking everything to the consulate. We didn't get any RFE's and approval at 4 months. Consulate seemed surprised yet happy to see all the papers my fiancee took with him. So I'm just going with that approach and I'm feeling confident he won't have any issues getting approved for this next stage of the process. I don't think anything could be as hard as it was when we were separated so to me this is a cakewalk and I don't mind doing the paperwork. So I think I will end it here, sorry for talking your ears off and don't want to come off as bragging but I guess I'm just really proud of how far we've come. I have my favorite cousin who I grew up with giving me away at our wedding because my dad and me don't have a relationship, and my brother is gonna be my fiancee's best man so everything is basically transcending and my stress has decreased massively within the last 1-2 days (ironically, it was a couple of busy days for me.) All I have to say is meditation. It really works.  I'll be back soon and hope you guys take care and stay safe.

    Hey guys! Our wedding rings are available now to pick up, since were on a budget we spent a little less than a thousand on both combined, and yesterday we booked a reservation for the honeymoon for 2 days. A nice jacuzzi to relieve some of the built anxiety from this process. It's much needed, and I'm super stoked and can't wait. It's only less than a month from now that we get married. We only really need to get a half a keg of beer ordered for the wedding, and apply for his social security card. I have everything ordered for the wedding and we only need basic stuff like chips and soda for other people, but I can't believe everything is pretty much done. Catering, DJ, pastor, marriage license, wedding decorations, rings, cake, and all the major stuff is completely DONE.  Now I have already started researching AOS so I can be ahead of this whole process and aware of everything I need to submit. I'm feeling super good about this, and to be honest, I'm looking forward to filing it even though the paperwork is gonna be tiring, but it's so worth it and I don't mind anything. This process has taugh me to be incredibly patient, and while the stress has been so intense in the last few months, I'm actually happy to experience it since I'm not very good at coping with stuff, and have pretty bad anxiety. I'm happier than I ever have been before. I hope everyone else is settling in, and many others have successfully got in the U.S. with their loved ones. I'm so happy for everyone of us here and wish I could personally congratulate everyone for how far we've come. We got so far and did quite a lot to get our loved ones here, and we deserve this. I hope you've all been doing well, and sorry again for my quietness. I had no idea how hard it was going to be to keep up with everything but I like to come on here to post and let everyone know how our journey is going. I think I will have to check out the AOS forum on here pretty soon, and hopefully I'll see many of you in there as well.
