I’m also doing my immigrant visa through consular processing. You can definitely expedite the NVC process but the reason for expedite has to be a severe emergency. From what I’ve seen with other people, depression is not considered an emergency so, unfortunately, it will most likely be denied.
btw we have a telegram chat group for the NVC and consular processing, let me know if you want to join and I’ll send you the link. Many people in the group have expedited and it was a success but mostly for military reasons or severe medical emergencies like surgeries or a serious Illness.
Yes if you can send me a link to the telegram group
thanks

I am recipient of Green card through VAWA and I have filed for naturalization a month ago. I have also got married to my wife who is India. I sponsored for her and her I-130 was approved recently and her case is with NVC, probably waiting for a visa number to be available.
In the meantime, my anxiety and depression has been getting worse. My primary care has put me on anti depressants. Given my health condition, do you think I can request that my wife’s case be processed faster so she can come and stay with me to help with the situation. At work I am not allowed go and work from there anymore, I have a written email.
is it worth trying to request and have my wife’s case be expedited?

Definitely fraud,
Hire an Indian attorney and get an annulment for fraud ( not divorce ) from India courts. Assuming here they married in India. As per link , fraud claim needs to be filed within one of of its discovery, not marriage date.
If you can pull off annulment pretty quickly ( less than 5 years) chances are his LPR journey will be very bumpyhttps://www.kaanoon.com/187674/marriage-annulment-via-fraud
You can file petition for annulment of marriage on the ground of fraud or you can file divorce petition on the grounds mentioned in section 13 of HM act. If you prepare section 13 there must be one year seperation period before filing the petition. If you prepare section 12, you have to prove the fraud committed by him. As per section 12(1)(c) Hindu marriages act, no such petition for annulling a marriage on the ground specified in HM act i.e., on the ground of consent by fraud, shall be entertained if the petition is presented more than one year after the fraud had been discovered.
Therefore, if your consent to the marriage is obtained by fraud, you have to file petition for annulment of marriage within one year from the time when the fraud is discovered. Asif no petition shall lie before the Court, if you continued to live with him as a wife even after the fraud was discovered
thanks for sharing. I will pass this on -
As a Green card holder through VAWA, I will be eligible to file for naturalization on 05/02/2023. I am planning to do it through USCIS online portal. I have a couple of questions
1. I was filling out the form online, to have it ready, what is the qualification reason. As none of the reasons mentioned apply for a 3 year VAWA Rule
2. Are there any additional documents that I need to attach at the end? Like payslips / tax returns etc. As it says that any additional documents can speed up the case
appreciate if you can respond

My sister, who is a US Citizen, got married to her husband in 2019 in India. My brother in law had a previous marriage and he had a dowry case on him from his previous wife. He made us believe that the case was closed and his previous wife falsely put a case on him. We believed him and later when my sister got married, it took him longer to clear the process. I am also confused how he was able to get a police clearance certificate in India because dowry case is a criminal offense. In Aug 2022 he immigrated to US and got an unconditional green card in a month. In Feb 2023 he flew away and he just texted my sister saying he is going away to India.
3-4 days later he called my brother and told him that he is going to divorce my sister.
clearly this is immigration fraud. Is there anything we could do.
@sandranj please advise

I did apply after 2 years and 9 months. It is mandatory to have proof of your marital status either the marriage certificate or divorce decree, if you don't submit it and it is on the list of documents to bring to the interview.
Please find the memo in this link. https://www.uscis.gov/sites/default/files/document/memos/sec319a012705.pdf
Hi @gramercy, do we just count the business days? I got my Green Card approved on July 31 2020. Can i send in my naturalization documents on April 30th 2023 ? -
Hi All, does anyone know how long after getting my Green card through Vawa I can file for naturalization? I got mine in July 2020
Thanks

I have been researching about this for a while and I saw several cases where people were able to sponsor a new spouse without problems. However Sandra (and later on Demise) were extremely clear about the process. I feel quite scared to go through this process after I will obtain a green card. If anyone else has case studies to bring to this forum please do so! I will bring what I found!
Could you share if Sandra had shared any information or any pro tips on this

Hi All, I am a Green Card holder that I got through VAWA. I divorced by abusive spouse 5 years ago and I filed for VAWA. It took me 4 years and it was last year when I got my Green card. This year I got married and my spouse is from outside of US and I am trying to sponsor my spouse for Green Card. I wanted to understand about this rule on the USCIS website which says as a Lawful permanent resident I cannot sponsor for new spouse. However, I want to understand if the green card that I got through VAWA is considered as a green card through prior marriage or not, and if this rule applies to me or not. Did anyone here file for their spouse

I got an update on my I485 saying Request for Further Evidence, does anyone know from experience what they usually ask ?
I was asked to submit updated medicals, I693, which I sent last week and they received it already. Does anyone know how long USCIS takes to adjudicate I485 after receiving medical, I already had my interview in Nov 2018

I went to my interview today as you know:
My case went to further review, 15 days (it could take up to 180 days) to know if I get to stay or not so I have to continue waiting...
The officer just didn’t make a decision on my case there because he needed to send it to further review to a supervisor to make sure about my “legit” Divorce Decree and he wanted my daughters’ birth certificates too
So I have to continue waiting either for :
RFE or Denial Document or GCThank you for all your support! 🙌🏼🇺🇸
What is your local office ?

Nothing so far ... I’m worried as everything went well and officer said he has requested my file and also he asked my divorce date what I wrote was different as actually divorce happened later so I didn’t had the original copy . Watever I could provide him was the copy from court but it was the same way I answered in rfe.
Hey @rayofhope any update?

Did anyone else had their i485 interview (after VAWA approval) and their case was put on additional review, after the interview ? Its been 5 months since I was interviewed and no update yet.
Local office is San Francisco

I have sent my EAD renewal application to Vermont and it’s 2 weeks since it was delivered to them and I still didn’t get receipt yet. How long are people usually waiting these days for receipts

Yep, renewal

I am going to send i765 for my EAD extension, since it’s been an year I last did. Just want to make sure if the list of docs below is good to send with i765. Let me know if I am missing anything
1. Copy of current EAD
2. Copy of i485 receipt (category is C9)
3. Copy of Passport
4. 2 pictures
5. Finally the i765 form itself

Anyone here who recently got their i485 approved from San Francisco office ?
I had my i485 interview in Nov 2018 and the officer decided to put my case on additional review and since then there is no update. Any one in similar situation.
Thanks

Hi All, I have my N400 naturalization interview coming up in a week. As a recipient of Green card through, what documents do you all think I should carry with me to the interview?
Are there any other things I should be aware of ?
