  5. You should assume this is a combo case regardless. US spouse MUST attend, else you risk an automatic denial of both the I-751 and N-400. In our case, I, the US spouse, was notified only 2 days prior to wife's interview that it would be a combo case. There is recent case here which resulted in a denial of I-751 and N-400 when there was a mix-up in instructions and US spouse did not attend.......both spouses should attend.

  13. Unlike I-130s, approved I-129fs are valid for only 4 months. The only remedy is if the consulate agrees to extend the validity. Although there is no guarantee they will do so, they have the discretion to extend approved I-129fs in 4 month increments up to a year. Of course a USEM backlog helps you.

  15. Not legal...and not up for discussion here on Visa Journey per the Terms Of Service. Adjustment of Status is for people already inside the US. Thus, as your spouse lives outside the US, consular processing is your legal route for a spousal visa. Material Misrepresentation can be a sole reason for denial.

  20. Please see my reference above. You must enter either with the petitioner or after the petitioner has entered the US. You cannot enter prior to your spouse.
