    It has been 7 months since OP's December entry. That is way beyond the normal time to receive a Green card after entering via a spousal visa. I would be doing some serious investigations.

    They are assuming you were admitted as a legal resident.......which it appears you were not. I believe you were admitted as a visitor. That "latest communication fro DHS" is irrelevant to your situation....i.e., no endorsement. There is no endorsement stamp on your visa to establish an entry date. I hope your Green Card arrives, but I fear it will not. Thanks for the update. Please keep us informed.

    If you are talking about current annual income: For employees, Income is based on CURRENT GROSS annual income expected over the next 12 months. For self-employed people income is based on last year's profit sheets or Schedule C.

    K-3 visas are obsolete, and they are not being issued. Any qualified US citizen or legal resident domiciled in the US can serve as a joint sponsor.

    He needs to refile a new, proper I-485 ASAP with new fee! He will need to reapply for another EAD. Social Security numbers are administered by the Social Security Administration.

    The 2023 carrier guide, page 32, states a person with a 10 year expired card can board. Whether a particular airline will honor that is another story. I agree she would not been applying for an immigrant visa. If they denied her a boarding foil, she is not in a good situation.

    They used my wife's photo from her I-751 biometrics which were done 4 years earlier.

    I think she might be given a notice to appear for immigration court. I'm not sure they would detain her. No one really knows what will happen.

    On the day my wife received her interview date, her estimate jumped from 3 to 6 months. Don't let their "system" bother you.

    US immigration requires a great deal of knowledge, planning, time, patience, and a significant financial investment. You are on the right track. Good luck.

    Another Option: Marry now, and start the DCF (Direct Consular Filing) spousal visa process a few months prior to desired move (with exceptional circumstances such as a short notice job offer for US citizen).

    Another option: Marry now, and start the spousal visa process. No adjustment of status needed. In about 2 years, he can enter the US as a Green card holder.

    In my opinion, she should have just gotten on a plane and returned to the US. She is authorized to board a plane with an expired 10 year card. The worst case would have been to argue her case in immigration court.....or she could have been admitted with NO court appearance. Is her appointment in Lagos? That is the WORST consulate in the world to argue a case, imo. They are tough, and they could easily deny her case. SB-1s are not given easily anywhere. Then what is she going to do? Good luck.
