As the petitioner you still need to prepare i-864 with a letter explaining why you didn't file taxes. Then have your sister in-law be the joint sponsor by preparing an i-864 too

It's okay to go back to the states after the filing. Some wait for the approval just in case USCIS ask for more documents for whatever reason

During my interview we have tax returns from 2013 to 2015 and no W2.
They only took the one for 2015. The screening officer asked for W2 but we don't have it so he just said it's up to the CO's discretion if he will require us to submit one. Luckily the CO didnt mention nor ask for W2 and approved my visa. So based on experience I'd say you're good to go
