    Here is the list of what we submitted. Not the most comprehensive, I know, but it’s difficult being recent college grads without kids, mortgages, significant assets, etc.

     

    I have started putting a few things together in case we receive and RFE. I have gotten a new job since filing and have him as beneficiary for life insurance. He listed me on his Whole Foods employee/family discount form as his wife. We’ve gotten another joint credit card together.

     

    o Exhibit 1 - Copy of our joint IRS Tax Return Transcripts for fiscal years 2016 and 2017

    o Exhibit 2 - Monthly statements from our joint checking account from 9/2016 to 8/2018

    o Exhibit 3 - Copies of our credit cards, showing joint accounts

    o Exhibit 4 - Apartment leases and other correspondence from landlords showing joint residency

    o Exhibit 5 - Copies of Driver’s Licenses with matching addresses

    o Exhibit 6 - Periodic statements from rental insurance in both of our names at our various residential addresses

    o Exhibit 7 - A cellphone plan overview and monthly bills from Sprint showing cell phones on same family plan

    o Exhibit 8 - Various plane tickets from trips taken together

    o Exhibit 9 - Photos of us and family/friends over the years

    o Exhibit 10 - Affidavits attesting to our relationship from family members and friends

    No, we were never told fingerprints would be reused. We got a letter about a biometric appointment and went in early July to get everything done. Just like most of the other LIN filers I’ve seen who got approved months ago.

    I have an update and I am not sure if this is true for everyone but I saw one other person who did the same and the next thing you know is that there was some movement in their case status.

     

    So I inquired about my husband's case status as it was a year since we did biometrics and we were waiting on approval. We are traveling again and although we have the extension letter I just didnt want to receive anything while we were out so I asked the representative online if we should expect anything soon so she said no. So I asked her about being able to apply for citizenship since we are 90 days or less than away from our 3 years in usa for my husband. We have been married for 3 years but will be for 4 in jan and will have my husband in usa for 3 in jan. She said we are not eligible yet because of the residency. Anyways I just took her decision and just figured we will wait. 

     

    Next thing I know is that an hour or so later I get the update on my tracker app that our card is being produced. Now I feel that they maybe backlogged or something because if you had your bios early in time I would highly recommend to speak to someone and see the case status. It is possible that the case is just sitting there until you inquire and it probably popped up in the system.

     

    Last year I had to call to get the extension letter twice so I think it might be sitting there especially if your fingerprint review was updated again in august.

     

    Ours was at vermont center. 

     

    Anyways I thought to share our news as well. I will update the calendar here in a day or 2. 

     

    Wish everyone the best here. Dont lose hope. If you trust your gut feeling and feel the need to call or speak to someone do it. I did and everytime I heard positive result. 

    Did you ask to speak to a Tier 2? What service center are you at?

  4. Risk is a weird work for it... implies a sort of chance element. There are instructions. If you follow them you should have no problems. If you don’t, you may have problems.

     

    From what I remember from those approval statistics that were floating around recently, RoC/I-751 was actually the process with the least denials. Like, 3% I believe?

     

    It’s the part of the process (after K-1, AOS, etc) that’s been the biggest headache for us in terms of waiting with no updates, but it really wasn’t any more of a hassle than anything we had done before.

     

    I filed everything all by myself for my partner, by the way. I was only 20 years old at the time and I figured it out, while working 30 hours a week and going to school full time. I also planned a successful 200+ wedding which is apparently difficult for most people who do K-1s. No RFEs, no issues.

    It’s impossible to know for sure. I would suggest looking up processing times for the service center your application is at to get an idea. Also I find joining the appropriate I-751 filing group for your month.

     

    Though both have been unhelpful for me since all the Nebraska Filers in my month have gotten approved already and we have been waiting with no updates..

    Hey. Same boat as you. LIN filer, sent docs october 2018. Got fingerprints done sometime in June then nothing. I got nosy and started snooping cases before mine. Looks like cases which are 200 steps before mine got approved then they suddenly stopped and every i751 case from that point upto my number says fingerprint recieved. There were about 10 of them. This is the only reason I'm not panicking right now.

    That does actually make me feel a lot better, thank you! Would you be able to PM me a random one of the case numbers in that chunk so I can see if it's close to ours? It doesn't have to be yours lol

  7. If your husband’s behavior was enough to warrant some extra psych checks in their eyes, it doesn’t matter if you don’t agree. That is your situation now. I’m sure these people aren’t sitting around adding extra work to their caseloads for fun what, fun? 

     

    You need to do what they ask and do it correctly in order for your husband to obtain obtain his visa. You have a clear path forward and steps to take. I’d prefer that to being in AP for weeks/months without any concrete reason.

My husband called USCIS yesterday just to confirm that any delay wasn’t caused by us possibly missing something in the mail during the month that we were having issues with our address and the local post office. He says whoever he spoke to confirmed that the last thing that happened was the fingerprint results. 

     

    It’s definitely a little bit of a bummer seeing December 2018 LIN filers approved and not knowing why ours is taking so long. I was sort of hoping we had missed and RFE or something so we could at least reply and hopefully get some progress after that.

    Our I-751 has been in status "Ready to schedule for the interview"  since May 23, 2019. It doesn't mean you will even get an interview it is a standard template.
    You entered in good faith no one is lying. Just don't go playing the happily ever after live together couple. Or file for divorce and if you are called for interview you have the filing or final decree in hand. No big deal.

    That’s interesting. I’ve been active in the September/October/November 2018 I-751 filers threads and I can’t recall a single person who got approved without and interview mentioning their status ever being that.

    No, I don’t think you will get approved without an interview if your status says to schedule an interview. That’s not what I was saying.

     

    Divorce process is something you should look up if you are getting divorced. It’s going to be important to know about regardless of what you do about immigration.

  11. How long is the process for divorce in your state? Do you have any mandatory separation periods or any other requirements that may extend the process? I know here in Wisconsin there is a 120 waiting period for a hearing, and the whole process from initial filing to officially divorced averages at about a year.

     

    If you are already at the interview stage and have a long wait for divorce, switching to a waiver might be an issue. You need the final divorce papers for that, and if you don’t have them and get an RFE for that, you may not be able to reply in time.

     

    I am in a similar situation. We filed for ROC in October of 2018 and things were okay relationship-wise then. Over the past few months things have started to break down. However, Nebraska has approved almost everyone else from around the time we filed, so starting the divorce process and switching to a waiver now when it could take up to a year to get the divorce finalized would be an issue. Our current plan is to hope to be approved without interview soon, and if we get called for an interview bring proof that our relationship was entered into in good faith and be honest about the status of it now.
