    I entered United States November 2014 on K1 Visa And got the 2 year green card in August 2015. Applied for ROC in May 2017 and I751 got approved in July 2018.

     

    I was eligible to apply for Citizenship under 3 year rule in May 2018 but we were in moving process so I decided to apply after I get settle in new state. Meantime me and my wife have been having issues for more than a year. We moved to texas right after I751 approved in July 2018. After few months I applied for Citizenship under 3 year rule in November 2018 and in just 1 month I received Interview date was scheduled on January 22 2019. 

     

    Right before the interview me and my wife have had huge arguments and decided to end the marriege. Since she left my house I did not have her Citizenship certificate to take with me to interview. 

     

    I appeared at the interview and been very honest with officer. I told him my situation and asked him If i was not eligible under 3 year rule than i would like to withdraw my application. Officer was nice. He still took my test and told me I passed the test but He will not deny my application. Either he will send me Oath letter or If i m not eligible he will withdraw my application. Couple of days after My application got withdrawn and We got divorced legally in May 2019.  I believe I can apply under five year rule and I will be eligible to apply in May 2020. I have booked the tickets to go india and get married in Feb 2020 right before I will apply for naturalization. So below are my few questions. 

     

    1. How will my application for Naturalization under 5 year rule be affected since i m divorced? 

    2. Can I go India and get married before naturalization? If i get married does it affect my eligibility or my application?

    3. Is it best for me to get naturalized before getting married? 

     

    Please advice me. Thank you so much in advance. 

     

    Not sure the difference of green card getting married and bring the wife to USA and citizen getting married and bring the wife to USA?

    If you have a child who is not currently living with you who is living in another country ;be aware that you will be asked to provide proof that you are taking care of the child/children financially and is in contact with them.Weather you are filing for them or not.This is for children under 18.

    The test will be administered but you will not be approve until proof is shown .

    You are absolute right.  A parent needs to prove that they are supporting their child/ children even after separation, it is a requirement to prove moral character and it is moral responsibility too.  I also personally feel, that just not financial support , it is better to keep touch with kids also, in a form of sending cards, gifts and meeting them , if possible , telephone call, Facebook and other means.    IO might one day ask for those kind of proofs.

    I'm sure the guidance can't cover every eventuality.- Starting filling the application online and if you have questions, let us know.  It is a very simple process.  You do not have to fill everything  in one sitting, you can save and come- back

     

    The first Q I have is whether I can take photographs of my actual documents rather than scan them in? Printer is broken and wondered if officers will frown upon receiving photos instead? Things like GC, marriage certificate, tax transcripts....- Scan copies are  better than taking pictures

     

    The second question which I'm sure has been asked numerous times is the listing of trips outside the USA of 5 years, I shall be applying under the 3 year rule... is it wise to ignore the trips taken before I became a permanent resident? (Years 4&5). Not sure why they need to see any holidays I have taken as a non permanent resident really.- If you are in US for more than 5 years, it is better to provide 5 years history, since it says trips outside the USA in 5 years

     

    Any help would be most welcome.

    Update: Good news is that we both got conditional approval today 9/4/2019, but could not get any appointment until Oct 26, 2019, that is also  2 hrs drive to Newark airport ( EWR), NJ.  The earliest appointment in Philadelphia airport is Dec 9, 2019.

    At the ending IO gave me N-652 with passed English & Civic test, but decision can’t be made at this time.

    I was really shocked, surprised & mute.

    IO mentioned also hope everything fine, but IO need to review my travel history, if needs anything IO shall contact with me via mail. 

     

    Every exceptional things happened with me. I don’t know, anything am I did wrong? 

    Am I need to worry about something? 

     

    I need your valuable support, suggestion and recommendations. Am I need to do anything? 

    So if I understood, you did not put any travel history on your N-400 form?  Did you have work permit work in the country where you worked before coming to US?

    As I said, no combo interview, only N-400 interview and my spouse was not called and was waiting outside all the time.  At the end of N-400 interview when I asked about the status of I-751, only question IO asked, " is your spouse with you"  When  I said yes, he said , he would review it and provided me the paper " passed but decision can't be made at this time" .  So basically that was the I-751 interview without my spouse.  That is reason, I would recommend everyone to go with SPOUSE  for N-400 interview, if I-751 is pending.  Both are approved on July 3, 2019 and interview was on June 28, 2019.  

     

    So if not combo interview, make sure to ask about the I-751 and if possible ask, if the file reached to local office.

    It is not by default.  NBC needs to send I-751 with N-400, then there is a possibility of combo interview or only N-400 interview and approval of I-751 at the background.  In my case, only N-400 interview and at the end when I asked about the status of I-751, IO officer asked if your spouse with you and I said yes, then he  told that he would review it.  Interview was June 28, 2019 and both approved on July 3, 2019.  So combo interview ( means did not call spouse), but it is important to take spouse with your if I-751 is pending

    1. March 2015 I became a conditional resident after marrying my US citizen.
    2. February 2017 I submitted request to remove conditions sending prove that we married in good faith.
    3. July 2017 I received request to submit more proof because we don't have kids. We sent more than 200 pages this time showing that we bought a house together, cars, bank statements together etc.
    4. September 2017 I received confirmation of approval and conditions were removed
    5. October 2018 I received my new permanent Resident Card (green card) for 10 years.
    6. March 2019 I submitted Form N-400 for naturalization (citizenship)
    7. March 2019 I received letter for Biometrics appointment.
    8. July 2019 I received letter with my N-400 interview information.
    9. August 2019 was my N-400 (citizenship) interview in Chicago at USCIS Building.
    • I got there 20 minutes early.
    • I was interviewed almost right away.
    • The USCIS officer was nice, asked me to show her the paperwork required in the letter and a few thing extra ( thank God I brought a lot of paperwork extra with me) and then asked me the civics questions right away, which I passed with the first 6 questions answered correctly.
    • Officer proceeded with writing and reading test (The test was to read "Where is the white House" The Reading part was " The White House is in Washington, D.C.) Which I passed.
    • Then I was requested to stand and raise my right hand to receive the oath to tell the truth and nothing but the truth.
    • Officer proceeded to ask me a lot of questions about my N-400 Form that I filled and corrected information that changed after the filling)
    •  Officer asked me if I had any questions and I asked a few.
    • Officer gave a piece of Paper saying that I was recommended for approval but had to wait for final decision.
    1. Next day my receipt # was updated online to waiting for approval.
    2. Next day after that it said that I was approved and was in line for oath ceremony date and time.
    3. Exactly 3 Days after my interview my online status was updated to "Oath Ceremony Notice was mailed"
    4. Exactly 2 days after that I received my letter in the mail.
    5. Now I'm just waiting on my oath ceremony which will be in a few days in September, ( I will update after )

     

    PS: My husband hired an attorney for my first resident card but I did NOT get an attorney for N-400 (citizenship) process, I would say that what helped me was that I did it as soon as possible after receiving my Green Card, since USCIS already had investigated me recently twice, when I applied for both my conditional and permanent Green Card, and I'm pretty sure it helped because I was able to do N-400 process in less than 6 months from beginning to end because process started on the very last days of march and is ending in the first weeks of September I will have my oath ceremony for name change with a Judicial Oath Ceremony and that usually takes more time than my case. Good Luck to everyone.

    Congratulations !  Glad you did not retain an attorney for N-400, since the form is simple and we already gone through a long immigration journey and learned everything.

    After you pass the interview, make sure to ask IO, since you filed in NY and the interview is in NJ, will it delay approval or oath ceremony and who will do the final review before final approval, NJ local office or NY local office?

    I am sure, what is needed from NBC, sometimes if I-751 is pending and I-751 file did not send from NBC with N-400, it takes time.   Wait for few days, you might see your approval.  Let us know when you will  get your approval.   My approval came 4 days after interview.  Best of luck and relax, you are almost done.

    hi fellows, I took the interview in the Newark FO(NJ) this Tuesday and passed the examination. The VO was nice and we talked well. He gave N-652 which says I "passed the test" but the "decision cannot be made". He said that he is waiting for something from National Benefit Center (NBC) and that he needed to review those materials. I asked if I can help provide such info. He said no. He also said that if I did not have result in 120 days I can check back with USCIS (but he did not say how). Finally he must have sensed I was nervous and he said that it would not be that long (120 days).

     

    Today I checked the online status. My interview was still not added, and the status is still "We scheduled your interview".

     

    Anyone else had the same experience?

    Is there any way to follow the status of this NBC (National Benefit Center)?

    Shall I be worried? Did anyone be denied N400 before? thanks

    House deed(we purchased in 2017 and shows both our names)

     

    Please let me know if it is sufficient or I have to add more evidences.

    I followed the requirements that mentioned the USCIS website, did anyone face any issue when they submitted the minimal requirements?

    Add birth certificate of foreign born spouse, diver license or state ID,  a few months of joint bank statement, life insurance and a few utility bills

    My interview was June 28, 2019 and oath July 15, 2019.  I was provided estimated date Feb 2020 when filed online.  USCIS is trying to decrease processing time.
