after filing for your parents/ parent to come to the United  States and it was approved. How long Can they stay in their country before they migrate? I mean after they received the visa.

My mom’s IR5 had a 5-month validity from the date of her medical. The exact date of expiry will be printed on the visa.

In general, an immigrant visa is usually valid for up to six months from the date of issuance unless your medical examination expires sooner, which may make your visa valid for less than six months.

I am US Citizen married with foreign spouse and I filed taxes married filing jointly with my spouse ITIN number. Our joint income is less than $50,000. Will I get $1200 or $2400?

What the current version of the stimulus bill says:

“Everyone earning up to $75,000 in adjusted gross income — the income on your tax return — and who has a Social Security number will receive a $1,200 payment.” (Source: AP)

Since your spouse does not have a Social Security Number and the bill specifically requires an adult to have a security number valid for work, that disqualifies him/her from being a beneficiary of the stimulus check.

    Unfortunately, you’ll only get $1,200.

    Hi,

I wanted to start a thread about things we may or may not have heard about the NVC. I think it would help clear up some questions for a few people. Let's start off with some true or false statements...

True/False: Some cases are approved in a week or less after submitting documents

True/False: NVC reps. must meet a quota each day regarding Case Completes

True/False: Clicking on the submit button or resubmitting documents pushes your case to the very beginning of the process

True/False: Once your case is review it is not reviewed by the same person each time after a resubmit

    Speaking from experience here:

    - True/False: Some cases are approved in a week or less after submitting documents

TRUE: I submitted all the documents on 11/8/2019 and received approvals and DQ on 11/14/2019. This was not expedited on my end.

  4. Hey guys. Got I-130 approval today for my mom. Had my expectations set on waiting another couple of months, at least, based on processing times. My mom’s not present in the US so, she’ll eventually be applying for a visa at an embassy abroad.

    Priority Date: March 18, 2019

    Approval: September 20, 2019

    Service Center: Texas

Waiting on physical approval notice since I only have case status notification for now.

    Hello,

I am in the middle of filling out the N-400 based on marriage ( three year rule) and I am confused regarding the questions that asks to list the last five years of address history and employment history. Should I list 3 years of info( since I became a permanent resident) or should I list info for the past 5 years (  I have been living in the US for 3 years and half.

    thanks for your advice

For n-400, only your time as a permanent resident is relevant where these employment and address history questions are concerned. Since I also filed under the three year rule, I also included just 3 years of history.

So can she file the I-130 first, using our address as their physical address and then file the I-485 adjustment of status once she gets all the forms filled out and evidence gathered? Or is it required to file together?

Thanks for your help, greatly appreciated.

Sure she can. You can file I-485 after with a copy of the receipt received when I-130 was filed.

Please keep in mind that her parents can fall out of status if the i94 expires and I-485 hasn’t yet been filed. The I-130 alone will not allow them authorized stay beyond the date printed on their i94.

My wife is currently filling out the I-130 form while her parents are visiting the United States. The hope is for them to be approved while they are still here so they don’t need to fly back and forth.

On the I-130 form it asks for the beneficiary Physical Address. Should I put our address in the US since they are here, or put their home address back in their home country? I’m just wondering what pushes the interview location to be held in the US?

    Thanks for for your help!

If they’re already in the US and you’re hoping to have them stay here and have their status adjusted  to that of a permanent resident then you should select the option to ‘adjust status’ and put their US address/ your address as the physical address. Adjustment can only be done within the US so, this makes it clear that everything will be done via USCIS and consular processing will not be applicable.

Although entering on B1/B2 you’re authorized a maximum stay of 6months, once you file I-485 to have them adjust their status, they’re  considered to be in authorized stay for as long as a final decision is pending on their adjustment (i.e. the initial period of stay provided on i94 by CBP when they entered is no longer applicable).

Do I have to include email or iMessage conversations between my husband and I? If so, how much?

I have about 9 years of iMessages and it‘s a lot to go through. It takes forever just to go through one year of iMessages. Same with Facebook. I included a lot of other proof.

I actually did include some chat conversations as proof when we filed for AOS since we didn’t have a lot of other proofs. I included conversations related to our wedding, congratulatory messages from friends, and just chose different conversations at different time periods in our relationship — spaced out over time to show the length of the relationship.

N400 filed based on marriage is very similar to I-751.. Joint IRS tax transcript , house deed, joint bank statement, car insurance/ health insurance with both name on it & life insurance with their spouse as beneficiary, or other docs that you can provide with both name on it plus some pictures should be just fine for the case.

Definitely an overkill, but I respect the ‘too much is better than not enough’ approach here.

  10. Recently got approved for Citizenship based on marriage to US citizen as well. The only documents that we submitted related to our marriage (apart from a copy of the marriage certificate, of course) were IRS transcripts (filed jointly) and apartment rental leases with both names for the past few years. I did take some additional proofs with me to my interview at Federal Plaza, NY though, but there was no interest by the IO in any of it.

Intent is determined at the border,  they were let in.  They are eligible to adjust.   Besides,  where in the OPs original post mention anything about a preconceived plan?

Nothing prevents an IO, at the time of green card interview — should one be required, from re-evaluating intent and making a decision based on that. However, coming here with non-immigrant intent, having a change of heart while already in the U.S. and seeking permanent residence is quite common and should not pose any issues.

  12. Phew I guess we were approved. At least that's what our IO lady said.

I can't recall it completely..I was too nervous, but we were there like 1.5 hours early and waited around an hour until we were called in.

First sworn in and then she asked for photo ID with our address on it. And there we were with our one big problem which made us hold our breath for a minute or two: my dear husband never got a new drivers license after moving two years ago. So his license had the state montana and a completely different address on it.

That was the one thing I had never checked, I was prepared for everything else.

The IO was pretty upset about this and said that he had to get one latest after 30 days and that we should be trying to proof that we are living at the same house, which is hard without an updated ID.

Luckily I had my boss, who is also our landlord, write an affidavit which said that she is our landlord and knows we are living together.

    Phew.

Next questions were the usual like how we met, when we decided to marry, who attended our wedding and where it was and if we have some pictures to show.

And if I had some supporting material.

I handed here taxes filed married, phone bill, joined saving account, joined credit and best buy card and our car insurance and the affidavits I had written by boss and one friend.

She took a copy of a few pictures out of our wedding album and said we were approved.

I didn't receive any confirmation by email yet and realized that she didn't take my EAD/AP card?

    Is that bad news??

We were approved on the spot and I still have my EAD/AP as well as my I-94 in my possession. We got our email confirmation a couple hours later.

I don't think you have anything to worry about

  13. Congrats @ nycaribb,

Might I ask did you have any RFE during your application process or was it smooth through out the whole process, if it was I'm guessing my interview will not be until July seeing as you applied during September and just had your interview now.

The New York City Field Office at Federal Plaza is a bit quicker than the one in Long Island, though. You're interview may be sooner if your interview will be held at the former. No, i had no RFEs.

  14. Hey guys, my husband and I had our interview today (priority date September 2, 2014) at Holtsville, NY (Long Island Field Office).

Our interview was scheduled at 9:40am and we arrived at about 9:33am. We went through security within a few minutes then were directed to an area (sign in/ reception area,i guess) where our interview letter would be requested before we proceeded to sit and wait for our name to be called by the Immigration Officer. No IDs were checked at either the security area or the reception area. There were two doors where officers were coming out to call their next interviewees (labeled ‘A’ and ‘B’). We waited maybe 50 minutes before we could be called in by the Immigration Officer (through door ‘A’). She was a lady maybe early to mid 30s in age. She seemed really pleasant as she expressed her delight in meeting us. She proceeded to leading us all the way to the back of the hallway area where her office was located.

She started by swearing us in then requesting my husband’s ID and my passport used to enter the US. She then asked my husband for his proof of citizenship (i handed her both his original Birth Certificate and U.S. Passport).

She went on to request additional proof of our bonafide marriage (specifies examples such as leases, joint accounts and insurances). While I was gathering those documents [we had a thick binder full of evidence even after submitting some with the original application], she began to question my spouse, although she stated that either one of us could respond to the questions.

IO: How did you two meet?

    Sp: Dating App

IO: How long after meeting did you get married?

    Sp: 1 yr 2 months

IO: Who was present at the wedding?

Me: Do you want me to tell you their names?

    IO: No. Friends? Family?

    Me: Friends

IO: Did you guys go out afterwards? … to a restaurant?

    Me: Yes. [named the restaurant]

IO [specifically to me]: Do you have family here?

    Me: yes, aunt

IO:What type of visa did you use to enter the US?

    Me: student

    IO: Where are your parents?

Me: back in my home country

    ————

IO [directed to me]: I’m going to ask you a few questions. She asks me to verify my address, age, work place. Honestly, i first thought she was asking these questions to my spouse about me (thinking she wanted to see if my spouse knew these facts about me), but it was only a matter of verification for her. While I was responding to the question on the address, i guess I was responding little too slowly so she completed my address by saying the city and zip code while i nodded in agreement. Afterwards, she went through the yes/no questions on the form I-485.

IO asks to see the photo album and quickly flips through it once i handed it to her.

IO asks us to select two pics from our photo album which shows both of our faces while she does stuff on her iPhone.

    ——

IO asks for recently filed taxes. She asks if we had any copies of it. We didn’t so she said that she won’t keep it but make a note that she saw it. She then went on to say that she had to wait for my background check to be updated on the system. We were told that although the background check was done before, it needs to be updated and that we were approved and our case status should be updated either this afternoon or the next morning once she gets the updated background check. We were told that we would receive the welcome letter within a week and the green card in two weeks. At this point we smiled and she asked if we had any questions. We didn’t so she was up and ready to usher us back out.

    Observations:

-We were not asked any questions about one another.

-She didn’t look at the evidence that we gave her but quickly punched holes in there and placed them in our file.

-She gave us back the joint phone bill we gave her as evidence since she didn’t want anymore evidence at that point.

-Our interview lasted less than ten mins.

-There were more than a few questions asked but everything was speedily done. I think, as many have stated, the IOs make up their mind about the approval of a case even before the actual interview. We got the card production text message about two hours after the interview was completed.

P.S. sorry for the long post.

  15. If you've never applied for permanent residency before, chances are you don't have an A# so you should leave this blank. An A# will be assigned to you once you submit the applications and obtain the receipts.

The visa number is the number in red and should not be confused with the control number.

I think the i-94s are no longer given at the POE so it can't be found in your passport. As far as other members have stated, these can be obtained electronically online so, even if you lost the card, you should still be able to obtain it.
