    Sir, I believe that you have been given some missed guided information from your wife regarding how her government works. If she reported to her government, that she is married and her new husband has an income, which I will say if you are getting disability income fome the US government, than your income is probably 50 percent higher than the average worker in TT. This income is now being counted as joint income, which will put her in an higher income bracket.
    The US government did not force your wife to report your income. This seems to be a problem she created. In all fairness to those in TT who are on the same waiting list as your wife, who doesn't have the support of a US husband, why should they suffer behind those who have gain additional support.
    If seems as if you and your wife didnt look at you'll situation and plan accordingly. Poor planning on others parts should be no reasons for others to suffer.
    If you are trying to petition your wife for a spousal visa to the US, maybe you'll should focus on one thing at a time.
    A small piece of advise, is for you to verify all questionable statements before you make them facts to cause you angst. The policies in most developing countries are lot different than what we are use to in the USA. They have so little resources to give to so many that have a greater need.
    Good luck on what ever decision that you and your family shall journey unpon.

    Gee your post is confusing. She wants to buy another house in her country but couldn't because she's married to a US citizen?
    You mentioned going to the states for a vacation. FYI a joint sponsor is not required for applying a tourist visa. She must prove that she has sufficient funds for the trip and reasons to return to her country in order to be approved.
    Your facts are not straight either. I'm only basing my advice on what you wrote. People here are not mind readers.

    Lottery winners are required to present income/savings requirements too.
    Stop whining and find another job or try harder to find a joint sponsor. Being US born doesn't make you special in the eyes of the government. We all had our share of "unfairness" in this immigration process too.

    If it is a US male doctor a female, usually a nurse, is required by law to be present. Otherwise, you may need to shop around until you find a female USCIS physician.

    I don't have the same experience but my advice is to send the missing documents expedited with a letter of explanation. If the rep advised to do this, then take that advice. Thats what I would do. Even though the warning advises to send the documents all at once in one package, that damage has been done. To fail to send the required evidence is almost a definite denial. To send now in separate package is the only good option left. Better second package on time than never.
    As far as what to write in the explanation, you should keep it simple and straightforward. Whatever common sense answer that will be understood easily. If it is only a missing w2, then you could say that the documents were accidentally excluded from the original package due to miscommunication. I'm sure they are familiar with processing errors and will appreciate the honesty IMO.

    There are NO negatives to the petitioner's being on the consular premises at the time of the interview.
    The beneficiary's handing of the petitioner's U.S. passport to show the consul can ONLY be beneficial, because it (re)affirms the bona fide nature of the relationship.

    DING DING DING we have a winner.
    Having jumped down the rabbit hole of this story, she had been in the US since AT LEAST June 21st, 2014, leaving 275 days between then and her detention on March 23rd, 2015. Slightly more than the "11 hours" that she was claiming.
    They tried to take their dirty hippy bus to Canada, and likely the Canadian border guards saw she was trying to enter from the US on an expired VWP and weren't confident she was going to follow their visitor/tourist rules so denied them entry and turned them around, and when they tried to cross back into the US was rightfully detained at that point and put into removal proceedings. Again, rightfully.
    I wonder if they were trying to cross into Canada, and cross back and attempt to use VWP for another 90 days of authorized stay, not knowing that it was likely cancelled already, and that ground crossings to Canada and Mexico don't count as new periods of stay but rather count towards time allowed on the original VWP. That's pretty much #1 on the VWP's list of "Don't be an ####### by Trying This" list.

    You have provided too much proof, by doing this, the consul would definitely have a suspicion. Try next time and be a little subtle, besides the embassy already knows everything about you even before the interview. My cousin and her friend applied for a tourist visa back in the 90's and her friend only shows that she works at the bank and with a little savings and she got approved, on the other hand, my cousin showed everything she has and yet she got denied.
    Sometimes, it's also all about luck to get interviewed by a consul who happened to start his or day with a good cup of coffee .

    For an I-601a waiver you must prove extreme hardship (emotional, psychological, financial...) to the USC. There are denials, but the USCIS is not known to refer to ICE in those cases. So I guess there is no harm in trying (aside from losing a fair amount of money in the event the waiver is denied)...
    You file the I-130. If you receive an approval, it is sent to the NVC. You pay the required fees (Affidavit of Support and IV) but do NOT send in any required documents/file the immigrant visa. Prepare the waiver application (with supporting documents) and file the the USCIS. If the waiver is approved, then it goes to the consular processing.
    I strongly recommend using an attorney for the waiver application. Or really discussing thoroughly with someone who has gone through the process and had one approved. It's not a matter of just filing the application and a statement from the USC.
    On a side note, DACA is applicable for those who came under the age of 16 before June 15, 2007 and that were present in the US on June 15, 2012 no matter which country they are from. DACA is not a path to a green card. It only protects you from removal proceedings and gives you an employment authorization document (and therefore a social security number). Waiver is the way to obtain a green card.

    Just got email notice that my GC interview will be on May 13! Very excited. Hoping my EAD will get fixed so I can work in the meantime.
    I think I can fit my i-485 birthdate issue at my interview so I hope everything works out!

    But can't your husband travel between the U.S. and Canada just with his Canadian passport or ID? Does that cause problems for his residency application?

    Had no idea, I assumed all the service centers were about the same backlog so this is news to me. Had good news and wanted to share it with a community that understands.

    Secondly you have to understand when the USCIS website says 5 months that means within 5 months
    Anything under 5 months is reported as 5 months
    Also for the people who are waiting and having been waiting a very long time at tsc your post seems a little insensitive

    Uscis are ignoring the huge difference in approval times.Csc are taking a month or so. And have no backlog.
    Tsc are taking almost a year.
    When questioned from members on Vj, uscis say we are lying about the vast difference in approval times.
    And now new petitions are getting routed straight to csc even if they are meant for tsc to even the work loads.

    I'm assuming you were at California service centre, that is the only reason for the fast approval.Congratulations and please fill in your timeline as it helps everyone use to forums.
