Hi, Sent of my forms at the end of the December last year, we sent in i-130, i-485, AP and EAD, I have gotten NOA1 text and physical receipts, but nothing since then. Anyway I have been looking for a January filers group just to keep up to date on the speed of things,
wish you and all others that will join the group best of luck.

Yeah I see the 100+ page thread you linked. I'm sure it's all a big mess. Thanks for the info. Some I know from my own personal research I've done. All I know is, my wife & I went through the hell-hole otherwise known as the TSC for our I-129F. That wait made our relationship stronger. We are willing to go through anything else we need to, now that we get to wait together instead of apart. It just makes everything so much easier for us. It makes waiting less terrifying.

You call USCIS to request an inquiry for your I-765. Customer service will ask you why you want to do so. You need to tell them that USCIS's website says that I can submit a request if my case is pending more than 75 days. You need to make sure your application is pending 75 days because USCIS will tell you that your application is not 75 days from the date of filling. Then asking for the confirmation number and that is it. I,myself, as along with other people had been successful by submitting the request.

There is no guarantee of what any CBP officer is going to do. Much of the determination is at their discretion. It might seem like a loophole, but it's really not. The instructions and USCIS website are clear:
If you are a permanent resident, you need to RESIDE in the US. You can visit abroad, but you cannot LIVE there. If you are spending more time out of the country than in on a regular basis, you're going to have a problem.
You don't need a re-entry permit for travel less than a year.
Any amount of time out of the country can be used in consideration of abandoned residency. Yes, 6+ months (especially repeatedly) is more of a red-flag, but it's not JUST the amount of time in one trip. It's about how you are maintaining residency in the US.
A re-entry permit shows you plan to return and is necessary for trips over a year but does not guarantee you re-entry if it is evident you have abandoned residency.
In conclusion: you need to live in the US. If someone you know is only coming back to the US once every 5 months and spending the rest of the time abroad, they're just plain lucky thus far. Eventually, their GC will be revoked.

I've never heard of it, but I think it's worth mentioning that I file single on my taxes, as my husband is not here yet. I had to research the information on Turbotax and verify with my lawyer that filing as a single person was correct, as my spouse resides in another country until his Visa is approved. *fingers crossed*

I don't know if you'd technically call this an RFE but we managed to make it through the entire process rfe free all the way up until the interview on October 11th. My husbands visa was refused that day due to a missing signature on the I864A. He was given the number of the embassy courier and told to get that form back to him asap along with his passport. This was sent out on October 16th and received on the 18th.
What I've learned? Just because you've hired a lawyer, don't assume everything is perfect. Double check your docs.
Several weeks went by and we heard nothing. Upon my calling VOS on Nov 7th I discovered that there was another RFE that we were not notified of. They required proof of status for our joint sponsor. The embassy courier picked that up on November 9th and it was received on the 13th.
What I've learned? Same lesson as before only in addition; Just because you've hired a lawyer don't take that as an excuse to remain ignorant on the visa process. Educate yourself on as much as you can because there's a lot riding on it.

My Stupid RFE was:
I did not submit documents (marriage and divorce certificates, I-864) that I had previously submitted to USCIS. I referenced the USCIS submissions within a cover letter.
What I learned:
NVC absolutely requires everything that they ask for, even though you have already submitted the same documents to USCIS.

It happens. They have questions about you, her or your relationship is in question. Read the notice, prepare every shred of paper you got, and go in swinging and don't leave until they know ya'll are legit.

One doctor for all of Western Canada. Because the embassy only schedules interviews on Tuesdays, it means at least five days in Vancouver.
The U.S. government doesn't give a rat's rump about making anyone's life easier.

Sometimes you just have to trick TurboTax into moving on. Things to check--
If it pulled in data from last year, does it know your spouse was resident all year or is it getting info about Canada mixed in. Did you go back through the personal interview?
Did you go through the "Less Common Income" income section/interview to say No for foreign income?
Can you go to the forms view and delete form 2555 from the return. Then what does TurboTax say? I manually delete forms all the time that it spuriously generates.
If those don't help--
Say yes to revoke. If you had actually formally revoked it with a statement to IRS, then you could not use it for five years. However, you are just tricking TurboTax to move on. You don't need the form this year. IRS does not require you to revoke it, nor file it. You can lie to TurboTax because they are not the IRS, and you are doing your return correctly. So saying you revoked to a software program in this case has no actual IRS implications.

Even getting an RFE., your wait might not be as long as others. You have two things working in your favor.
1. your petition was sent to the CSC service center which is processing them faster then TSC service center.
2. you are from the Philippines, they are still expediting petitions from there due to Typhoon Yolanda.
I really do not think ,you will be waiting close to a year. 8 months are less is a good realistic time. You can check others members timeline similarly to yours and get a fairly good estimate.

No, NBC is the slowest and then Nebraska, at least according to timelines here.
We sent our package January 23rd, NOA1 January 26th at Nebraska service cencenter.

To be honest I have the same thought as Apple21, however, I think you have real chances if you show that you and your stepfather have a real relationship, I had my k1 visa interview last week, they are very good people and just wanna check your intentions. Having him with you at the interview will help a lot!
I would not mention the law to the consular officer, first, because he is supposed to know it and second because, in my very own opinion, you can sound desperate, as long as I think a person with good intentions dont even need to tell them "hey i have the right" (w/ exceptions, of course).

The U.S. Department of State Foreign Affairs Manual states the following:
9 FAM 40.1 N2.2-2 Stepparent/Stepchild Relationships After Termination of Marriage (CT:VISA-1000; 09-03-2008) a.
A stepchild who has met the requirements to qualify as a “child” of the stepparent under INA 101(b)(1)(B) may continue to be entitled to immigration benefits from such marriage, even though the relationship between the natural parent and the stepparent has been terminated by divorce or by the death of the natural parent, provided the marriage was a valid marriage and the family relationship continues to exist as a matter of fact between the stepparent and stepchild.
So I'm taking this as the grounds for continuing with my petition hoping to find someone who has gone thru the same ordeal to provide some insight.

If he is active duty Navy there is free assistance through the JAG offices. They will assign a lawyer to complete the paperwork and answer any questions. No cost so you may as well use it. There may even be some fee assistance. Its a great resource.

if she is turned away it would at least be considered a removal, correct? -unless she is allowed to withdraw her request to enter. This is what happened to us and he was removed (visa stamped "cancelled" all over it) . After a removal there's a 5 year bar to re-enter the US, and your case can become very complicated. (now she is an immigration problem) So please use a LOT of caution before deciding she should visit. Would you be better off meeting in another country for her visit?
Always tell the truth, and always assume that they know what you don't want them to know (but won't know the things you think they should know already) I agree with the other posters that she has to have enough evidence "to overcome the presumption of immigrant intent". She should bring as much as possible with her to show that she plans to return to her country.
