    I'm uncertain of the steps exactly. However I would definitely consult an immigration lawyer. This is not do it yourself.

    K1 would be denied. She needs an I-212 waiver. Possibly a 601 as well for the ban I'm not sure

    In my opinion this is not an option. I'd sooner take a year off of school, work two jobs to have 35k annually (if possible) and sponsor aos before I'd let my spouse be out if status for 4-5 years. At that point he'd be subject to deportation and would need a hardship waiver to return which is often difficult to get if he's from a country where it's easy to find work and be stable. Search out things like catholic charities. They may be able to help you find a co sponsor.

    If you're going the k-1 route he cannot leave the country without his greencard in hand or advanced parole without risk of not being let back in. This could take months. If you are going to go this route id suggest he visit, you marry and he returns home while you file a cr-1

    Not to down the millions of single parents doing it for themselves, but kids deserve having both parents involved. I strongly believe that this is beneficial to both parent and child.

    Did you two intend to marry when he came? If so, that is visa fraud. Be prepared for scrutiny while adjusting. It's not impossible, but it may be tough.

    1. Where is your home country (curious how far you're travelling)
    2. Your husband is a b1/b2 as well so why on earth are you bringing your children to the USA for medical care?
    3. Are your children with you and your husband?

    So I suppose hypothetically you volunteer for the ASPCA and want to go to vet school later in life you can't use the volunteer work as reference on an application for school. Sorry just playing devil's advocate for curiosity.
