As stated in the letter, a waiver is available to you. You need to file the I-601, no need to refile. I believe this to be the I-601 form Section A check 1,3. You will most likely need to see a Doctor (family doctor or where you were treated) to certify that this was a one time occurrence.
    (A) CLASSES OF ALIENS INELIGIBLE FOR VISAS OR ADMISSION Except as otherwise provided in this chapter, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States: Health-related grounds In general Any alien — who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to have a communicable disease of public health significance; [1]

I fail to understand why you want him deported. From what you described I'd say you guys have a genuine relationship that fell apart. Just divorce the man if it does not work out for you anymore but trying to deprive your child of his father is counter productive. most immigrants come to the US because of love and a chance at a better life, otherwise you could have move to his country but you did not; instead he is here with you. marriage break apart all the time. It's no longer up to you, he'll remove condition alone once you divorce him.
I wonder about the other side of the conversation for you to get that reply "he married and came to USA was to earn money and education."

neoblast got a reaction from ChasUno in Booking flights abroad with AP, but still have no interview
I think AOS interview can be rescheduled only for a valid medical or family emergency and you'd go back to the beginning of line, most likely waiting for months to get another. You cannot schedule an interview window either. Rule of thumb is if you are staying more than the time if takes for the interview window to come and go ( around 30 days ) it's a risk and the only way to mitigate that risk is stay a shorter period of time.
    Good luck!!!

Hey Pekan sorry about your rfe. Vital statistics usually means you submitted a document that does not properly reflect your family background. Your mother and father's name have to show on any vital statistics document ex birth certificate, birth registry records and such..
Check to see if your current document has this information.

Joe you are actually wrong on both counts. I know it might help to give people good news, but setting the wrong expectation does not help.
Tip Sheet: Employment Authorization Applications Pending More than 75 Days
If your Form I-765, Application for Employment Authorization, has been pending more than 75 days, you may contact the National Customer Service Center (NCSC) at 1-800-375-5283 and ask that an Approaching Regulatory Timeframe “service request” be created. The NCSC will route the service request to the appropriate office for review. Please have your receipt number ready when contacting the NCSC.
To determine whether your case has been pending more than 75 days, you must consider the following:
If USCIS issues a request for initial evidence, the 90-day regulatory timeframe will start over from the date USCIS receives the initial evidence. For example, if your case is pending 60 days when USCIS issues a request for initial evidence, and you respond 30 days later, the “clock” will be reset to Day 1 on the date USCIS receives the evidence. If USCIS issues a request for additional evidence, the clock will stop the day the request is issued and resume from the same point when USCIS receives the additional evidence. For example, if your case is pending 60 days when USCIS issues a request for additional evidence, and you respond 30 days later, your case will be processed with the clock resuming at Day 60 on the date USCIS receives the additional evidence. The clock will also stop if USCIS issues a request for initial evidence pertaining to the principal application/petition that serves as the basis for your application for employment authorization. For example, if your eligibility for employment authorization is based on a pending Form I-485, Application to Register Permanent Residence or Adjust Status, and USCIS issues a request for initial evidence pertaining to your Form I-485, the clock for your Form I-765 will stop when USCIS issues the request for evidence and restart when USCIS receives the requested information. If you request that your fingerprint appointment be rescheduled, the clock will start over from the date of the request for rescheduling. Note: “Initial evidence” is defined as any piece of evidence specified by regulation or specifically requested on the form or form instructions. “Additional evidence” is evidence beyond that which is required by the regulations, form, or form instructions, but which may assist in proving eligibility where the initial evidence submitted does not.

neoblast got a reaction from Darnell in Where to send for Renunciation of citizenship ? CKGS or Travisa
    Here are the facts:
    * The Indian constitution does not allow or recognize “dual citizenship”.
    * The Overseas Citizen of India (OCI) scheme does not get you “dual citizenship”.
    * The Overseas Citizen of India (OCI) scheme does not give you “Indian passport”.

Automatic loss of Indian citizenship covered in Section 9(1) of theCitizenship act 1955, provides that any citizen of India who by naturalisation or registration acquires the citizenship of another country shall cease to be a citizen of India.” This means you have to give up Indian passport and citizenship to the nearest Indian embassy, should you become citizen of foreign country. A seal is affixed at the back of passport mentioning it is a punishable offence under Indian Passports Act of 1957, of any possession of indian passport, should the passport holder acquires nationality of another country..
-The Overseas Citizens of India (OCI) scheme was introduced by Indian Govt in 2005, to encourage Indians who have gained citizenships abroad in terms of easing travel restrictions and aid the economic development of India. This scheme is just like“Permanent Residence” or "Green Card "given in India.
If you are already a Person of Indian origin (POI) and have taken up citizenship abroad, you can take up benefits of OCI scheme, which gives you same travel and residence privileges like other Indians, but you are not allowed to vote and take up jobs in Government sector. You will also be free from reporting requirements to police regarding the length of your stay. . With that being said, you are eligible to apply for Indian citizenship if you have acquired OCI for 5 years and you have legally resided in India atleast for a year.

I fail to understand why you did not do a full medical upon receiving the rfe, not finding a Dr to sign off on the UK medical does not preclude you from getting a full medical at around 150$ depend on where you are. You took a chance but now you complicate your life. I am sure you can refile but it has to include everything including a full medical and AOS fees all over again.
