Blue Blood, you are correct that if you simply stay in USA and go through the complete AOS process there will be no consequences attached to your overstay etc.
The only hang-up is your inability to leave and re-enter the USA; or the substantial risk if you do so.
In reality, you are facing a situation which is an inherent problem for any of us becoming involved in a relationship with a person from another country.
There are going to be situations that we (or our foreign spouses) all will probably face at some point with aging parents, etc.
Although it is not talked about here much, this is something each person should consider before even getting involved with international romance.
Aside from your immediate situation of lack of travel authorization, we should all be considering what will happen when a family emergency arises back in the home country and we are involved with a time sensitive project at work, or a family member in USA needs our help, etc., etc.
At some point we have to decide which is more important to our future and the future of our family in the USA.
Think back to a hundred years or so ago. Family members back home became ill and died, and there was no possibility of getting back to them before death, etc. Life went on.

Fructose is metabolized directly by the liver. When calories are in excess, fructose is more harmful metabolically than glucose, so to that extent HFCS is potentially more harmful than sucrose.
If we (as a population) didn't consume so many empty calories, it probably wouldn't be an issue. But we do, so it is.

One of my friend's friend story. she stayed here illegally ( because husband never supported her anything but she was pregnant)
She applied green card over 5 months later.. she got approved.. but I cannot make sure about naturalization...... anyway..plus I cannot make sure about I-751 after conditional green card.
You can still file it.. co operate with husband.. trying to get money from anywhere if you can///
if you want to visit here yeah you can.. but not for a while.. idk 5 years or 10 years.. you don't know about your future what is going to be... so ...
idk why you are going to divorce with him and Why you didn't file it ( because of money?) you should already knew that it will cost lots of money.

second, co operate with your husband what you guys need paperworks..
third, trying to get EAD whatever work permit ... I think it takes 2 months after you applied?(idk just heard it. I didn't apply work permit when I was processing..)
then make more money....
but when you file it.. you should explain to USCIS.. what happened for 10 months...
plan B is.... if you get denied you need more money.
another choice is.. going back to your country.. it means it will be really hard to visit United States again.

and people are so mean and very negative right now because this website is visa journey people who tried to live with their husband or wife based on love. That's why ..

If You get approved from USCIS try to find your life with green card... it will be really hard after 2 years later if you filed I-751 for getting 10 years green card without your husband..
I think you will get denied.
So... but I think it would be better to try to get green card then divorce.. then go back to your country and return your green card.
so You can travel here too without any problem

If you do plan on going to the K-1 interview and seeing what happens, I would definitely hold off on that "wedding ceremony" you mentioned. I realize you have family pressures weighing on you, but you're playing with fire when you do things like that, especially in non-Western countries.

Finally our journey has come to an end after we started our application for a K-1 4.5 years ago. Today I had my citizenship ceremony yay!!! No more dealing with USCIS!
Thanks to everyone who helped us, especially Nich-Nick who went above and beyond to assist us.

Marrying a new man won't save your green card that was based on your previous marriage.
This is the reason that the two year conditional green card exists.

Within 2 months of arriving your husband divorced you due to infidelity, you have little evidence to show your marriage was entered into in good faith, your husband has evidence to show the marriage was a fraud, you did not file for removal of conditions, you have new man with whom you want to get married before the expiration of your GC for reasons of maintaining the GC only (your words), you have not kept abreast of immigration laws, you think your husband's sponsorship is going to extend to this 2nd marriage which would supposedly take place "just in the nick of time", and you believe you are not out-of-status.
I think you and your new man will have a better start by the both of you moving to Thailand. No GC needed there!

Amaryia, I know I've probably said this before when you've asked, but I'll mention it again.
Long-distance relationships are not easy. Especially ones in the situation that you now find yourselves in. But the fact is now that you've married him, and that complicates things even more -- but I think you were aware of that, since the last time you asked, you were debating about getting married.
Now, I've been in my relationship for ten plus years. That is a painfully unbearable amount of time to be apart. Our situation has not been easy and we've sacrificed. He put himself through college and university in that time, worked, and has saved to go towards our future. In your case, you are in nursing school -- and that is something you'll hopefully finish, because it certainly will better your job perspectives, and your probable primary goal right now is to support and better the life you have and your kids that especially depend upon you.
That is one of the reasons why last time, I suggested he return home, seek employment or further education, and start saving so that by the time you finish your training perhaps you'd all be a lot more financially stable. Of course that requires separation; it requires patience, endurance, courage, trust, and above all love.
And so, me suggesting the very same thing again, even if you are married, is going to seem unbearable to you and even harsh, but you know yourself the predicament you find yourself in. You now have a husband that is there illegally, cannot work, and you are financially unable to file paperwork making him legal. So I would say find the courage between yourselves and have him return home. He should start trying to find any job he can and save, while you finish your education. Then when you are both ready and able, file. It will be hard, but there really aren't any other options. Fear can be the greatest obstacle. Love and common sense can often best it.

Well there are a lot of things being posted here that are well intentioned but dont actually jive with the way things work in the real world Im sorry to say. On paper yeah, great plan, but to implement it- no way...
So starting with the most immediate concern- "the brother". Reporting an illegal to ICE- waste of time. He would be so low on their priorities to pick up, it just wouldnt happen. (sorry) I posted in another thread recently about Morton memos and their priorities if anyone is interested google it.
Op- you said you went to the police and they werent interested or something like that. What exactly for? Ideally you would like to go to the police and speak to a detective there and report harassment or a threat and get a police report or incident number. You would then go down to the clerks office and file a protection order. There are different kinds- some for domestic like spouses/bf -gf some for people with no relation. Im not sure what he would be to you. I mean he lives in your house, you are kind of related. The clerk can help you. The main point is you want the immediate ex parte order. Its one that is placed in effect immediately. You go before a judge alone and explain why you need one right now so badly. Its temporary until a hearing takes place a week or so later where you both appear and the judge can decide if if it should be temporary or not.
Once you get the temp order you can return home with the police and the order and he will be served it and removed from the home. If he comes back he will be arrested.
As for the wife. As many have said- do not bother filing AOS, It will be a waste of money because as you can see your marriage isnt going anywhere/ It doesnt really matter that the 90 days has passed so much. She will be technically be in overstay but wont receive a ban if she leaves before 180 days from when her k1 expired. So she has plenty of time.
Because you are married, she can file for VAWA. This can be very dangerous for you as VAWA can be based on physical abuse or mental abuse. It is not unheard of for scammers (and your spouse seems to fit that definition) to stage a domestic violence scene and set the Mr up so they can obtain a police report to use for a VAWA claim.
Someone suggested setting up nanny cams in the home if you must be there together or simply not being alone with her. Both good ideas. You do need to immediately file for divorce from her and in the papers specify that she moves out. How that will go over- I dont know. They may require you to move out or to pay for her housing or help pay for it since she has no job and can not work. Your divorce papers should allege all the fraud so hopefully that will be taken into consideration. Divorces can take I think 6 months in CA. (not sure about the annulment angle) that you need to speak to a lawyer about. Perhaps you should seriously consider staying at a hotel or with family until you file papers that require you two to live separately to protect yourself from false claims of abuse. Most divorce paperwork also comes with a built in restraining order clause about not harassing each other or destroying property. After you file though if she does not respect it you can file like you did with the brother a tougher order.
You have no basis right now to go to court and ask for an order against her as she has not threatened you or harmed you in any way.
As for "the child". lol. The best you can do is send a letter explaining what you know, or think you know to USCIS, or bring it to your local office to have it attached to her A file. Lest we not forget the child- lets call him 'Peter' has a birth certificate and she is not listed on it. So what kind of proof do you have exactly that Peter is not the child of Mary and Paul but the child of your wife and unknown rapist? What proof do you have that the BC is a fake?
Seriously you are going to collect DNA samples from Peter and your wife and pay to have them tested and along with the BC to USCIS? Because USCIS is not going to call them both in and collect samples. Secondly the BC may not be a "fake" at all. It could be an authentic fraudulent document.
It is very common in that country, if you have the right connections to purchase BCs from government officials. Real authentic BCs that they log in the books. (my previous spouse had 3 different BCs from there that believe it or not he turned in to USCIS at various times and for various complicated reasons nothing was ever done about it) Generally for children under 14 no biometrics are taken just a photo. Occasionally they will take just the index finger- but if they dont- well... kids grown and change and with no print and a different set of docs making a new A file... you see how it goes. But you didnt really specify if the BC used to get him in was one of USC childs or a perm resident child.
Its a tough call to decide whether to add the child to the divorce papers. Technically she has no child, she has no BC she can present that you know of. Im assuming the child is in your home as well. Its a tricky play. You can possibly add to the divorce papers that she must leave and the child she is caring for that is Mr and Mrs whomevers shall be returned to Mr and Mrs or turned over to child protection services. If she responds back with it is my child- well then thats something you can submit to USCIS. Consult with an attny on how to proceed with wording on that one.
There are a lot of ways to stir the pot here- aggressively, soft and gentle or just enough to not let it burn. Depends on what kind of action you want to take and how much you are comfortable with. What you have to keep in mind though is you are dealing with people who dont respect the traditional laws. So getting a lawful legal victory... well it can mean nothing. Because you can 'win' and take away their papers and be all satisfied and smug but they will just come back with another set of fake authentic or just illegal. So I would urge you to not focus on justice but just on protecting yourself and moving on/cutting ties and not looking back.

If this was the case, i wonder if it would explain the rape explanation, as a way of ensuring you did not have 'relations' with his wife, as the rape had traumatised her.
If this gets really messy, and you had DNA samples (like hair) from all three of them, I wonder if that would be helpful in proving the size of the entire deception.

I was in exaclty the same boat.We could not make it work, wife decided to file for divorce . If you think there is no way to make it work, no point of making it more complicated.
Everything was done in good fate and everything USCIS-related (like filing/documents etc) was done in the proper way.
Here is me 2 years later and divorced/single and i have applied for citizenship based on the 5-year rule... Honestly use rational and common sense and do everything right.

I think its madness. You now have to earn £18600 a year to bring a spouse etc in. So.. I cant bring my husband to this country, but somebody from another European country can bring theirs.
We applied under the human rights act when my husband came here. Because we didnt meet the requirements but now that doesnt even count for much. So when it comes to renewing his visa (in 1 year 9 months) he would have to leave. Hence us moving to the US.

I use an iPhone app called "USCIS Case Tracker & Searcher. It not only keeps track of your case and gives you updates but the most useful feature is that I can put in a case number and then see the status of 100 or 200 (any number you give it) cases after it. If you want to see 100 cases before yours, then for example if your case ends with 4000, then start at 3900 and it will give you the status between 3900 and 4000 in a matter of a minute.

One hopeful thing that I see in this list of K-1 petitions received by the TSC from 6/19 - 6/25 is that only 1 out of 186 has been rejected outright. There are 99 approvals, 60 RFEs, and 27 pending adjudication.

Hey guys. Just wanted to stop by to give each one of You some encouragement. My case is in transit to the consulate. There is light at the end of the tunnel. I would definitely start getting your documents prepared so that's one less thing you have to do. The process, once approved, moves so much quickly. It's kind of like when Jesus was tempted by satan. Each one of us has or is going through a difficult time. Keep your heads up and this too shall pass. I posted a while ago that the journey of a thousand miles begins with a single footstep. Although my journey is practically complete there are still some bumps along the road. It isn't easy. As a matter of fact it's so frustrating. I've even found myself arguing a lot with my fiancée out of pure frustration. I have to definitely take a step back and be grateful that we have come a long way. Of course it isn't easy but the closer we get to realizing our goals the harder it becomes. Don't stress the little things and believe me, each and every one of you will have your day. Chin up and rock out. I bet you someone across the blue desert loves you!!!!

I thought is was pretty standard for American birth certificates to have parent names on them. What state gave your wife a short version? Only curious.
And for an I-134 at London, I am not even sure they require that proof. It is not in the instructions, nor the law. I can't remember anyone having an issue over a sponsor's birth certificate at a London interview with an I-134. They are pretty flexible there and also don't require all the financial proof VJ tells you to bring. Example--they do not require a tax return if you have proof like an employer letter.
You will need the proof of the joint sponsor's birth for the I-864 with adjustment of status, so might as well get it lined up. Have you asked them if their parent is listed on it?
Sorry for the rambling that doesn't exactly answer your question but I don't think London cares or needs to see it.

I totally understand your thinking. (I can't seem to find in the I-134 where it says proof is required. )
And the Foreign Affairs Manual 9 FAM 40.41 N5.6-3 procedural Notes (2013) doesn't state it. It does say non US citizens are not the best choice to trust as the sponsor. But that indicates there is no statue against it.
NOTE: When there are compelling or forceful ties between the applicant and the sponsor, such as a close family relationship or friendship of long standing, you may favorably consider the affidavit. On the other hand, an affidavit submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has more limited value. If the sponsor is not a U.S. citizen or lawful permanent resident (LPR), the likelihood of the sponsor's support of an immigrant visa (IV) applicant until the applicant can become self- supporting is a particularly important consideration.
But if the Dept of State says parent names on a birth certificate are needed to prove citizenship and you plan to take proof, then I think parent names it shall be because the embassy is under the DOS.

Just to go back to the troll thing the person posted something in this forum they could have went to the October filers forum and posted this thread has been quite and everyone hoping for their approvals and supporting each other no bickering and fighting and maybe that wasn't good enough for the person they needed to liven things up seriously now due to one immature person with nothing better to do than rile up people with so much stress and anxiety has people who have been very supportive of each other angry at each other. And yes there are people with no lives who will make up stuff just to harass and laugh at us. If they truly understood the process we are going through they wouldn't poke the sleeping bears. It happens more often then not that trolls are in here seriously go through the forums and look at some of the posts they really like to go through the tsc forums and post how fast they are approved and get everyone bickering between each other just say good for u or congratulations and ignore them and continue on with supporting each other we are all waiting patiently/impatiently.
