Do not refile. Just wait it out, its clear that there is a backup at the service centers so nothing to worry about.

i doubt we have to resend our applications, so many people already filed in April that would be ridiculous.

I'm sure they will just discard it. As long as you sent everything else I see no reason to be worried.

We sent out our package today to VSC as well, in transit now. We sent everything that we could, praying for no RFE.

Absolutely it does, it shows you share the same homestead, unless you're totally devious. And you're young ones, they get that, they do they are only human and they know everyone circumstances are different. You know they look at your profile as a whole and take everything into consideration. Please try not to worry, if they send a RFE, its not biggie, if they call you for interview, you know you have a genuine marriage. Only the people that they suspect are not quite what they seem are going to have problems. I know I jest about the USCIS through their slowness and such, but believe me they aren't stupid and there will be supervisors going over queries. I wish you SO much happiness and a quick journey with ROC! God bless.

NinjaMax got a reaction from caliliving in Friend denied from UK, on vwp. Options?
Nah I just think some members on this forum don't actually want to help others and treat them like garbage instead, ive seen this happen in a lot of threads.
Almost everyone acts like an immigration expert here, but most of the time there are conflicting answers/information so its hard to know whos actually right, anecdotal experiences being the most damaging.
I already got my answer from transborderwife: marriage is the only option, a B2 will likely be denied and even if it is approved he will be denied at customs again.

NinjaMax reacted to aleful in I-864 Joint Sponsor Household Size Question
hi
are you the petitioner or the beneficiary
the household size would be 3, the joint sponsor, spouse and the beneficiary that he is joint sponsoring for
the petitioner isn't included
the petitioner files an i864 as the sponsor, the other person files another i864 as the joint sponsor
the joint sponsor fills out their own i864

NinjaMax got a reaction from oncefuturealien in Waiting for our passports from Montreal
Just cleared customs at Toronto POE. The first woman was being extremely rude and talking to me as if I was mentally handicapped. The people in secondary were very friendly and I got processed in 5 minutes. Unreal it's finally over, AOS up next : )

NinjaMax got a reaction from SincerelyMeike in Got the visa but the valid time of NOA2 had expired before the day of interview
99% of the time there are no issues as most peoples petitions expire before their interview date, its only an issue when you get an incompetent CBP officer that shouldnt have the job in the first place.

http://www.avvo.com/legal-answers/will-i-be-denied-a-k-1-visa-or-barred-from-the-u-s-982101.html
I found this interesting post, since I was not issued a i-94
"As for your prior periods of overstay, assuming you were inspected each time at the border, but not given an I-94, then you should be treated as if you were admitted with an entry stamp of "D/S," which means "duration of status."
People who enter D/S do not accumulate "unlawful presence" even when they stay too long unless there is a formal finding of a status violation by an immigration judge or USCIS. This is potentially very good in your case, since someone who accumulates more than one year of unalwful presence in the U.S., and then departs, is barred from returning for a decade, unless they can qualify for a waiver by demonstrating an extreme level of hardship to a qualifying relative."

I am a Canadian Citizen and I take the BUS into the US
unlike going through an Airport you dont go through customs twice, so Canada dosent know if i left Canada and the US dosent know if I left the US, they just know the arrival dates.
From what ive read on this forum, US and Canadian customs dont share their travel information.
This is really confusing because last time I stayed for 3 months+ and I came back for another 4 months+ and they seemed to not know that ive been there for that long, my return ticket just says staying for a week and they take my word for it if i just say im visiting, nothing else.
Has anyone else experienced this and what are your thoughts on this situation? Im thinking I might aswell stay in the US until there is a decision on my k-1, its been 4 months since Filing so im sure a response will come next or the month after.
Thanks
