  1. Thank you so much @OldUser and @Dashinka! My due date is August 3, 2024. My mom left the US on July 8, 2023.

As @Dashinka mentioned, she can come back to the US even within July 8, 2024 to my due date? It would pass her one year mark of leaving the country. But she already has the reentry application. She gets so bored if coming here and has nothing to do, just waiting for the baby to be born lol :))

I am considering time to book a flight for her!

Thanks so much again for your time!

  2. Dear amazing Visajourney community,

Happy new year to you all!

My mom has a US green 10 year green card. She applied for I-131 Reentry Permit on 02.17.2023, and got her biometrics done on 03.21.2023. We haven't heard anything or received any reentry approval permit document from the USCIS since then.

She flew back to our home country, Vietnam in July 2023 and is living there since then.

Since I will give birth in the summer, my mom plans to come back to the US before my delivery to help me here. :)

Do you guys know if it is okay for her to come back to the US when she hasn't got her reentry approval? I heard it may take 2 years to get it. Which documents will she need to show the Home Land Security at the airport to get in the US? She only has her green card and the receipt of I-131 biometrics.

Thank you so much for your help!

  3. Dear amazing Visajourney community,

I wonder if there is any faster way to bring my brother + his wife (both born in 1992)+ their daughter (5 years old)+ their son (almost 1 year old) faster to the US under immigration visa:

    - I opened the I-130 for them since Dec 2019 (brother of US citizen). Based on my research, it will take from 10-15 years to get processed.

    - My brother +his wife+ their daughter passed tourist visa to visit me in the US recently. They just visited me and came back to Vietnam 3 weeks ago. After this trip, they love living in the US and would like to find a faster way to move here. My mom is an  US permanent resident. My dad already passed away. We have such a small family, just my brother and I. We really hope to reunite in the US faster. My mom can't speak English, so the chance to wait for her become an US citizen and sponsor my brother's family is very low, esp her income is very low, too :( She was born in 1964, waiting for her to get the citizenship test in Vietnamese will take a while. We don't think we can rely on her to sponsor my brother and his family.

    - I think about EB3 visa but my brother has a Master and his wife has a bachelor degree. It seems like they are not unskilled workers.

Do you have any ideas about this case? I am thinking about checking with the Attorney for:

    -How much it costs?

-Can they guarantee that my brother's family can immigrate to the US faster? How long is the wait?

Thank you so much for sharing your input about this topic!

I love this community so much. You guys have been helping since day 1.

can you help me with some information? they asked her to do fingerprints...when was the last time she had fingerprints taken by USCIS?

Im just curious to find out if USCIS is taking fingerprints from every single application or if they are using "past" fingerprints .

We applied in Jan 2023 and she got biometrics done on 3.21.23

  5. My mom is an US green card holder. She moved to the US on Oct 2022 from Vietnam. She missed home so much, and wanna go back to Vietnam until I give birth to my baby. (Which we are hoping in 1-2 coming years).

So on Jan 2023, I applied the reentry permit for her I-131, Application for Travel Document so that she can stay in Vietnam for 2 years, and no trouble for coming back to the US.

She got her biometrics done on March 2023.

We have been waiting and no further information from the USCIS so far. I did some research and it may take a couple of months.

Is it okay if she comes back to Vietnam on July 2023 before receiving her re-entry permit I131 approval?

My brother is coming to the US, so she wants to go back to Vietnam with her. She doesn't speak English at all and scared of long flights by herself.

Thank you so much for your help!

  6. Hi, everyone. I am trying to apply for re-entry permit for my mom. She has 10 year green card and would like to travel outside of the US for about 1 year.

After researching, I found the form I-131. It says that I can file online or send mail but I can't file the online link at all.

I will have to print out everything and send to USCIS Mailbox center?

    Thank you so much!

  7. @Crazycat: Thank you so much for your prompt and supportive info! You brightened our day by telling me that she will receive her 10-year-green card, really save us some paperwork 🤩 And I will do more research on keeping her residency, extremely important!

@boiler: When she can take citizenship in her native language, I will help her to take the exam. Meanwhile, we will have to renew her 10 year green card.😁

    "

    1. Age and Residency Exceptions to English

An applicant is exempt from the English language requirement but is still required to meet the civics requirement if:

    • The applicant is age 50 or older at the time of filing for naturalization and has lived as an LPR in the United States for at least 20 years; or

    • The applicant is age 55 or older at the time of filing for naturalization and has lived as an LPR in the United States for at least 15 years.

The applicant may take the civics test in his or her language of choice with the use of an interpreter. "

    1.  Her Green Card will be sent to her via the mail in a few weeks after entering the US via her IR-5 visa.   There is no "renewing her one-year temporary visa on her passport".  On what are you basing that??

    2.  A Green Card is for living in the US.  You need to do some serious research concerning maintaining residency.  Yes, it will affect her application for citizenship.

    Maintaining Permanent Residence | USCIS

@Crazy Cat Right now, the government stamped on her passport visa "Upon endorsement serves as temporary I-551 permenant residence for 1 year". We are still waiting for her plastic green card since I paid $220. I haven't seen it, so I am not sure how long it will be valid. I assume one year. Then we will have to renew it by submiting I-90 for her 10 year green card. Please enlighten me if I am wrong :) Thank you so much!!!

  9. Good morning, this amazing community!! My mom just entered the US under IR5 visa on Oct 22, and waiting for her plastic green card. (She got her social security card after only 1 week hooray!!! 😄).

I think she will get her 10 year green card after I renew her one-year temporary visa on her passport (Plan to apply by July 2023).

Do you guys know after she is granted her 10 year green card, can she live in the US and another overseas country (for example, Vietnam) ? I assume that she will need to live in the US longer (7 months) and shorter in Vietnam (5 months), for example.

Also, they will deduct the total time she wasn't in the US when she applys for citizenship?

Thank you so much for your help!! Have a wonderful day!!!

  10. Hello, everyone! I am so grateful for each of you to spend time on meticulously reply to my mom and I whole-heartedly. This community is so amazing and helpful!! It really warms my❤️

My mom entered the US successfully. The USCIS didn't even open her brown sealed envelope and told her that they will send her paperwork to our address :). Hopefully, her green card and social security card will come home soon so that she can open a bank account and work next month.

The guidlines you guys sent us was so helpful!!

I wish you guys all blessings, joy and luck in life! You all are such kind people!!

  11. Hi, guys. My mum was approved IR5-visa with I-551evidencing permanent resident for 1 year. Do you know when I will need to renew her visa? 90 days before expiry date?

And the form to apply is I-90? After that, how long will her new green card be valid for? (like 10 years?) Any condition beside not going overseas outside the US for more than 6 months?

    Thank you so much!!!

  12. Thank you so much for all of the info that you guys have shared. I just paid for my mum's fee of $220 today. I entered her Alien registration number and IV case number correctly and carefully. Then I got a confirmation receipt that I paid but for an IOE case number that I have no idea. Then I entered her Alien registration number and IV case number again. It said that this person's case fee was paid. I hope everything was fine since I am at the airport right now with her, waiting to fly back to the US tonight.

Also, do you guys know upon arrival, how long can she receive her social security card upon entering the US for the 1st time? I already chose "yes" for applying her social security card when I filled in DS260. Can she work with a valid I-R551 (valid for 1 year) but without her social security card?

Love this community!! Thank you again for your support!

It won't affect anything. You are a citizen. You can file this minute if you want to.

There is no right away with immigration. You mom will take about a year or more and your brother will take about 15+ years. Also, keep in mind that in 15+ years if his children are to old (over 21) they may not be able to immigrate because they will be considered adults.

Since you are divorcing your husband, they will not look at you and your husband's income together. They will only look at your so you will need to make the requirements to petition for them.

Good luck and sorry to hear about your marriage.

Thanks for your help. I am researching on I-130 for sponsoring them. I filed tax jointly with my husband since 2015 up to now. Hmm, I wonder how the financial sponsor is calculated and submitted.

I don't see how much I should make or pay tax to be a sponsor for 4 of them or any information regarding tax return.

    I need to make above: 20,000 x 4 people = 80,000/year ?

From I-130: Item Number 10. Total Value of Assets. In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current Federal Poverty Guidelines for your household size. However, if you are a U.S. citizen and you are sponsoring your spouse or child age 18 years of age or older, the total value of your assets must only be equal to at least three times the difference. If the intending immigrant is a foreign national orphan who will be adopted in the United States after he or she acquires legal permanent residence, and who will, as a result, acquire citizenship under section 320 of the INA, the total value of your assets need only equal the difference.

Example of How to Use Assets: If you are petitioning for a parent and the poverty line for your household size is $22,062 and your current income is $18,062, the difference between your current income and the poverty line is $4,000. In order for assets to help you qualify, the combination of your assets, plus the assets of any household member who is signing Form I-864A, plus any available assets of the sponsored immigrant, would have to equal five times this difference (5 x $4,000). In this case, you would meet the income requirements if the net value of the assets equaled at least $20,000.

  14. Thank you so much ! You guys are so fast ! I am so grateful for Visajourney website. They have been helping me tremendously in my paperwork.

Please help me to confirm. So far, I only need to :

+ submit the citizenship certificate + birth certificate

+ 1 form I-130 for my mom and 1 form I-130 for my brother 's family (wife + 1 child)

+ Pay fee: $535 x 2 (This is expensive lol)

I don't see how much I should make or pay tax to be a sponsor for 4 of them or any information regarding tax return.

  15. Dear everyone,

I am a newbie to this topic and searching information to bring my family overseas to the USA. I started to research now. Hopefully, I can start a new application in 2020.

My mom (born in 1964) and my brother (born in 1992). He got married to a girl (born in 1992) and they have a daughter (born in 2018) .  It is form I-130 only to sponsor for both my mom and my brother 's family ?

I guess it will take 2 years to bring my mom here. For my brother 's family, it might be 13 years ? By that time, he probably has 2 children already.

One more thing, they will require financial proof which is tax of 2017, 2018, 2019? If my husband and I divorced in 2019, will they look at my income separately or with him as well because we filed tax together in 2017, 2018.

    Thanks so much.

  16. Dear everyone,

I got my Citizenship Oath today. My husband wants to file for a divorce since we have unsolvable discrepancies and different life purposes :( It is very sad for us but he realized he just wants to be single for the rest of his life, no children, just travel and date multiple women but never remarry. We entered marriage with a good faith. We used to love each other and he is only 5 years older than I am. We both have good jobs and no language barrier.

How long should we wait before he files for our divorce ? He thinks it may affect my citizenship because it might look suspicious that I just wait for my citizenship to divorce. I also want to sponsor for my mom and my brother 's family to come to the US right away and live with me because my dad already passed away . The government is going to look at our income tax and documents together.

Thanks so much for your advice.

  17. Thank you so much for your information. I guess for sure you need the husband for the combo interview especially if you have 2 year Green card approved without any interview before.

Did they interview your husband separately in a different room? Or they put you two together in 1 room, then officer asked questions and the wife (applicant) answered only?  How long is the oath ceremony after the citizenship passed?

  18. Dear everyone,

I just got interview date for citizenship test next month hoooray. But I have not had 10 year green card yet. My status expires at the end of July.

Do I need my husband to go with me to my citizenship interview? It is 4 hours far away and he does not want to sit there by himself since he is superbusy. I heard they may need the husband to interview since the wife has not yet had 10 year GC.

    Thank you very much.

  19. The 5 year rule is for those who applies for citizenship by themselves without remaining to same spouse .

    So my marriage is 11/18/15 and resident card since 01/27/2016. I used this https://www.uscis.gov/forms/uscis-early-filing-calculator and saw I can start filing N400 since 10 / 29 / 2018.

But my marriage is not 3 years yet by 10 / 29 / 2018. Do you guys think I should wait until after 11/18/2018?

I tried to enter my information here and it works to submit N400 on 10/29/18  https://citizenpath.com/n-400-naturalization-citizenship-application/getstarted/

    Thanks guys
