    The visa in their passport should show the expiration date, which is typically 6 months from the date of the medical exam for the interview. They can travel back and forth as much as they like, but they should be residents here in the US and visit back home.  A month or two is ok, but if it's over a year they need to file for a re-entry permit.  Frequent 6+ month trips back would lead to CBP wondering if they have abandoned US residency.
     
    After they arrive on their IR-5 visa, they should stay long enough to get settled before travelling back.  It will take 6+ weeks for them to get their SSN cards and physical greencards.  The visa in their passports will be endorsed and will serve as a temporary I-551 for a year if they really need to travel back right away.

    not an issue to travel. just dont permanently live outside US for more than 1 year than there will trouble.

    Ollie had his interview today and was Approved!!!! From start to finish this whole process has taken about 8 months, and boy are we glad that all this waiting is almost over. Its been a long journey and I can't wait for him to be here forever and ever. To those that are still waiting, just started the process, or are thinking about what they want to do. There is an end to it all and it's not easy, but its totally worth it. I can't wait to spend the rest of my life waking up next to him everyday. Good Luck Everyone!!!

    Have you flown into Orlando on an international flight before? You get off the plane and get directed to an immigration hall to show your passport, etc. That's a POE. The difference for him is he will tell the person on the immigration desk that he is entering on a K1 visa. Normally he will be escorted from there to a room where they will process his visa and take the envelope of visa files off him. He might have to wait if they have other visas to process. Then he goes on to baggage claim to collect his luggage, turns in his customs form, and out the door to you.

    Please do not purchase flights til you have Visa in hand. It could backfire. You will go through Immigration at the first US airport he lands in. They will direct him on landing. You can not get out of the Locked down area till you go through immigration. He will not have to search out them they will funnel them to the proper areas.

    Bakemma,
    His point of entry will be whichever airport he arrives at in the US and goes through customs if Orlando is his first stop in US then it will be there.. That's where he will surrender his packet and be allowed to enter. Then if he's flying to another destination he will collect his luggage and go to that airline departure.

    He would only be doing the POE (point of entry) at the first city of a state or territory of the USA that he arrives at. What other international cities he stops in before he gets to USA does not have anything to do with the POE. OF course he will want to make sure he has enough time to clear security to catch his connecting flights
    You should also wait until you actually get visa before buying airlines tickets

    He can pretend he does not have a minor child and willingly leave them off the I-864, but I do not suggest anyone lies to the USCIS on any of their forms. It does not matter what 'most people' say. It only matters what the USCIS and the I-864 instructions say. They say if you have minor children, no matter where they live, no matter who has custody, no matter if child support is paid or not, no matter who claims them on their taxes, they are included in the household count. IF the child was no longer a minor and also was not claimed as a dependent, then they would not be counted. Both of those factors together mean they are not counted. Simply not claiming the minor on your taxes does not exclude them from the household size.
    For example, a divorced couple has a 14 year old child. The child lives with the ex-spouse mother who has full custody. She is the one that claims the child on her taxes because she is the one that provides most of his support. The father is filling out an I-864 for his new wife and must still include that child in his household size because the child is a minor and has not reached legal adulthood(age of majority). It makes no difference if he claimed the child on his taxes or that the child lives with his ex-wife and he does not have custody.

    Page 8: How to count household size >
    Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ
    Also, current annual income is not based on what was made last year. It is what he is currently making, not what is on his W-2 from 2013. How much he makes gross(before taxes) per week times 52 weeks is what his current annual income is. For example, if someone makes $12 an hour and works 40 hours a week, then their gross pay a week is $480 and their annual income is $24,960.

    We actually had our LOIs notarized as well to be extra sure. But yes, my understanding is the same in that LOIs need to be originals and not copies.

    The not knowing has got to be terrible, but you will know soon and get it all sorted! They looked at your application and that's what the good news is! At least you know that as soon as you send whatever they're looking for, you'll be approved soon after. Cheer up, I view this as a good thing!

    Just an FYI - this link only covers denials for I-129F petitions, not denials of K-1 visa by embassies. So this might not help in your case.

    Also side note, If some else claimed your daughter as a dependent, you can not amend and claim her too. That is tax fraud and will ultimately cost you a lot more hassle and money than it's worth. Shouldn't mess with the IRS.....

    Both children will still be counted as hers for the affidavit of support, because they are biologically hers, unless the sister adopted the son. and to prove the tips and what not add up to the required amount some embassies accept bank statements showing the proper deposits and balances proving tip income.
