How long for your case processing ??? I'm at NVC now and waiting for the reply on our checklist, btw I'm CR1 visa and it has been a year since we applied it , dont know when will it finish. should wait for them or just call them to ask?

. What kind of checklist you have? On IV or AOS? You should start calling them about 2 weeks after sent documents to NVC. I heard that US Consulate in VN really busy, so it takes about 2 months to schedule an interview after case completed. And almost 3 months from schedule to interview.

I am in the middle of i-130 process, and this is the respond i got today from my senator:
According to USCIS records, your constituent's I-130 case received an initial review by an officer at the Nebraska Service Center (NSC). However, a background check process was subsequently initiated in his I-130 case; and it is not yet complete. USCIS electronic records indicate that this case is currently pending background check clearance.
Please note that a small percentage of immigration applications and petitions have unresolved background check issues that can delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to determine when the background check process will be completed in your constituent's I-130 case. If a background check reveals an issue that may impact eligibility for a requested immigration benefit, further inquiry is needed. The inquiry may include an interview and/or contact with another agency or USCIS office for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible. If your constituent does not receive a decision or other notice of action within 60 days, please contact us for an update.
Something I don't understand, what triggers the background check? I understand my spouse has stayed in the U.S for 7 years as a high school/college student and she does have an alien # and SSN. Is that the reason? Also, how long does background check takes anyway?

Thanks, one of my friends just told me I should of filed a k3 !but I didn't? All I filed was an I-130... Been waiting for 11 months & 5 days... Is this torture ever going to end??
Yes, someone tell me just file K3. But I thought the K3 just 2,3 months early than I-130 so I ignored that. If I know processing times took too long like this, I should file K3 in the beginning. The first step in USCIS took us living apart for 10 months and 12 days. Now in NVC it taking at least 5 months to complete and interview. I cant wait my wife and my little son to be reunited. I miss them so much

Thats what I have. I don't work and I don't have a sponosor so I filed tax as self employed and got the 1040 form with gross income of $19,800. but when my accountant sent the papers to the irs it came back as error because my dad claimed me on his tax papers. So should I just send NVC the 1040 forum and see if they accept it ?
This isn't a game, remember that. For example, you filed on 1040 form that your gross income is $100.000 (or more than that, as much as you want). But, who is confirm that income for you without IRS? Why NVC asking for Tax Return Transcript? Because on transcript that IRS reported your REAL income, not a FAKE income on the 1040. If NVC accept the 1040 only, I think people who low income or no income doesn't need Co-Sponsor because they can do any amount of income on the 1040 form.

The i130 of my 2 minor children were just approved, reafirmed and sent to NVC (TODAY)
I am independent contractor and my personal taxes are just over the edge of the porverty line because I send plenty of money to their country while waiting this process to finish.

WHAT WOULD NVC REQUIREMENTS TO PROCEED AND SCHEDULE APPOINTMENT AT THE CONSULATE?

You only need to file I-864W for each of them. Nobody sponsor for them, they will be automatic become US Citizen once entered to the US. You can apply the US Passport for them when they in the USA. All you need are their green card that they will have in about 2 weeks and their birth certificate. If they are under 16 of age, you and other their parent both need to sign on application. If over 16, only one parent need to sign. And you need to bring proof of your citizenship to show them. That's all I did for my daughter

I have a problem, I just filed my taxes a few days ago and my accountant receives and error saying that somebody already put me down that they support me which is my dad. Now my accountant says that I should tell my dad to take my name out of his tax papers. I was wondering, my dads income isnt enough so I filed for $19,800.. Can't I still send NVC my tax papers? they might accept it.. at this point my dad will not tell his accountant to take my name out of his tax papers. I filed as self employed because I don't work and secondly I just filed taxes for my husbands case.. Can I just submit the documents to NVC and see what happens? I don't know what to do anymore.
You cant send to NVC just your tax papers, I am sure they will refuse it. If they accept it, so all people dont need to work, dont need the income, dont need co-sponsor.....Because, just the tax papers (1040, 1040A....) everyone can do it by themself with any gross income they want.

NVC received my case yesterday, expect case number and IIN in early May 2014. Anyway, I have to wait for 2013 Tax Return Transcript because I just did amend yesterday(changing filling status from Single to MFS). Hopefully it isn't more than 8 weeks for Transcript available. So confused, do I send the old 2013 Tax Return Transcript with the filling status is Single or wait for new Transcript? Just in case if NVC ask for AOS while my tax amended still on hold at IRS. Any idea?

Go to this link and fillout the form. Explain the reason and type full name of beneficiary. I did before, about a month I got a notice that my wife full name had change. In NOA2, her full name with middle name included

Question 17 part C is information for your relative ( beneficiary).Asking question for friend, on question 17, he knows he has to put his name, and beneficiary son name, but when he fill out i130 for step child what does he put on question 17?
For his wife I-130, there is his name(as spouse) and her children.
For his step son, write NONE or input his step son's wife or children if he had those

My wife's case is currently at NVC. 2 weeks ago I sent them the IV package and had submitted the DS-260 as well. Got a checklist today in the email concerning the IV package and this is what is says:

The two respective documents I had submitted were copies and it had attestation stamps on them. They were the ones that I had initially sent with the I-130 when I filed the petition with USCIS. If they approved the case with the same copies, then why is NVC sending me this checklist?
Are they asking for originals or are they asking for copies with some sort of government stamp on them? I'm not sure if they're certified. If not certified, then how do I "certify" them? I'm confused and would like some help with this. I tried calling the NVC but the number is either busy and/or I can't reach a customer service rep. Thanks.
USCIS ask for copy (photocopy) only, but NVC ask for original copy. The original copy means, i.e: You only had 1 original of birth certificate, but you can obtain as many copy as you want, just pay the fee for that. And NVC need that copy.

I filled my DS260 saturday and it was NOT 72 pages! I think it was around 17??
Depending on applicant's informations. I did for my sister and her children. For her, it about 20 pages but her children just 14,15 pages.

My wife and I are in a same sex marriage in Florida (where it is not legal). We were married in a legal state and are going through the I-130 process now (about 6 months in). Now, I was going to file my taxes, but if I choose "married but filing seperate" it still wants her SSN, which she does not posses because she lives in the UK. Am I able to file as "single" and not have there be an issue with my I-130 application (I get more money back this way)?

If you filling by software like TurboTax ....you can input any number with SSN format to let the software run when ask for SSN of your spouse. And then print the completed form 1040 out, white out the "fake" SSN that you inputted before. Write NRA on that line, mail it to IRS. That way I did when amended my tax return to change filling status from Single to MFS

I filed as Single for 2013 Tax Return, now I just filed 1040X to amend today. Since my wife doesnt has an ITIN so just file as MFS. It takes 8-12 weeks to process, I wish I have a new Tax Return Transcript with filling status as MFS before process AOS at NVC. 8 weeks is long enough or I can wait until I have that transcript and then process AOS. My case at NVC now, no case# yet but I'm not hurry because if NVC process my case fast and IRS still hold my amended so I cant send AOS with the old stranscript stated that my filling status is Single

I also wrote Rendell Jones and got a personal note back from his assistant this morning, someone named Geary...saying he would look into the case. At the end of his note he said this:

Of course, a few hours later I received an email saying our case status was changed and a "RFE" letter will be sent to us. I feel these guys are doing this out of spite to me for emailing them!!!
I'm sure I could find this elsewhere, but what could they possibly be asking me for? I know I'll see the letter in a few days but wondering if there is some standard thing they usually request?

Congrats! At least your file has been moved forward. I think if you did good I-130 preparing, today you got approved instead that RFE. Hope those would be simple things

Hi everyone so I called last night and I talked to tier 2 since February 21st they have. .een telling me they are waiting for my husband background check and this morning I receive email and text saying that they move the i130 to my local field office for further processing I am very frustrate after waiting ALMOST 11 months I was expecting to be approved anyone have any ideas what's gonna happen now?
Good news, maybe that's a glitch text/email or atleast if they transfer your case to local field office. You have a chance to talk with them in person. In some cases, they approved the same day after found out what you need from you.

Yes, just point out the date on your file, date of transfer and tell them that you believed your case was outside of normal time and you need help. Write your case# in the subject line.

Thanks, now I am really clear about that matter. My income is $65,000/year. So no matter my household size 2,3 or even 7,8.... But, is it a problem if I counted more than my household size? We will be false if counted less than household size, right?
