Hi friends,
I called NVC today to update my case since it s been 3 months that i am waiting for my wife interview.they said they are still giving visas for those who filled on the 8th of september 2013, and my case was filled on the 10 of the same month.the think that i can t understand is:the visa billten of june they went back to may 2012.do i have to wait for one more year again to get an interview????????????
Since you're in F2A petition so you need to wait until the visa available to get in interview. Even now your case has been completed, but the visa bulletin went back 69 weeks. The interview schedule for June is only for cases with PD on or before May 2012. It happened once in last couple years on F3 Category, they went back 6 months and some cases had interview scheduled but they re-schedule until current visa comes available with those PDs

Part 19 on the i-864EZ Affidavit form it asks for most recent total income. I was advised by lawyer friends, VJ people, and research that I was to put down the Adjusted Gross Income as located on my tax transcript. I did that and the NVC told me that portion is incorrect. When I called the lady asked me whether I filed a 1040, 1040A, or a 1040EZ form. She told me to put the number that corresponded to line 22 for a 1040 (Which I filed). On my tax transcript that number is NOT my Adjusted Gross Income but my actual Total Income. Has anyone else been held back on their wait because of this mistake???

On 1040, your TOTAL INCOME in line 22, ADJUSTED GROSS INCOME in line 37. In your tax transcript, the number at Total income exactly the same with number on line 22 in 1040.

Your claim status in company (W4) doesn't matter and doesn't effect/conflict in NVC. When you file AOS, the NVC rely on your tax return transcript or 1040/W2, nothing on W4

my husband read about the affidavit of support article under uscis and he said that i-864a would qualify his household members to add up their incomes to his to justify the required poverty guideline. is that what it means under affidavit of support "If you are using the income of other household members to qualify, then each household member who is accepting legal responsibility for supporting your relative must complete a separate Form I-864A, Contract Between Sponsor and Household Member" does that mean he can add up the incomes of his household members? thanks
Yes, your husband can add many household members as he can to reach the poverty guideline. Each household member need to complete the I-864A form.

I think NVC has been lost your case, because they confirmed to you not only once but also twice that they received your case on April 2. And USCIS has no info on your case or didn't know why your case been returned. If NVC sent it back to USCIS on April 28, I think USCIS has received your case cuz it been almost a month. I know your feeling now, call NVC but they said talk to USCIS. Call USCIS but they said contact to NVC. You are in the middle of them, everything are out of your control. You have no other choice except waiting for the answer from NVCResearch. Be strong my friend, praying for you.....

I have waited 12 days since completed DS-261 but IV fee still NOT INVOICED. The status of DS-261 was COMPLETED until yesterday, and then changed to INCOMPLETED today. I did re-submit (just hit SIGN tab and submit, nothing change on the form)again and it changed to COMPLETED now. So, I dont know my DS-261 was done or not? How do we know the DS-261 has done? As I know, the IV fee only invoiced when the beneficiary has done with DS-261.

What I found was limited info on similar situations. And nowhere how it ended or anything like that..
As I said in early post, you MUST call USCIS to ask them what going on with your case. Your situation is CASE HAS BEEN RETURNED TO THE USCIS. But, USCIS request to get case back or NVC return your case to the USCIS are big difference.
- USCIS request to get case back : There is something wrong with them on the approval, so they need to get case back for further processing, investigate, or whatever....This is take more time for your case ==> LONG
- NVC return your case to the USCIS by themself : Maybe your case missing some papers, documents ....that NVC could not process to the next step. So they return your whole casefile to the USCIS==> SHORT

You should put YES, because the beneficiary MUST be done with vaccinations in accordance with US Law before the interview. Of course, he/she will have documents with that

So 2 months and 1 week after filling out the change of agent form, we are still dead in the water. We paid AOS fees and submitted documents. We got a checklist for 2013 tax info even though the filing date for 2013 was not yet closed. We also received a checklist for the change of agent form which I had already submitted on March 10th.
We sent in 2013 tax filing documents and resubmitted the DS261. Called the NVC and agent said everything looks to be in order and I didn't have to appoint an agent as I was in the USA at the same address of the petitioner. Really? Got another checklist for form DS261 that is not filled out properly. Called back the NVC who said that I cannot adjust status in the USA. WTH? Seems like because my correspondence address is in the USA they flagged it as form incomplete. This is despite their agents saying it is ok.
So now it is two months later and even after appointing the petitioner as the agent, there are still checklists being generated that the form is not complete. Hubby called up today, demanded to speak to a supervisor who kept repeating the form is incomplete. Well let's just say he was pissed but diplomatic. Seems nothing was EVER wrong with the form. So she assured him that the form IV fee will become available within the week.
Seriously, how much can they muck up our lives. We have wasted 2 months waiting on the simplest form in the process. Super frustrated. I was hoping to get an interview date before I return to Jamaica but it is not looking likely now. We are now entering the 13th month since filing these papers and like others I just want it done.
I would like to know on average how long is is taking between the FORM IV submission of documents and an interview date?
How many days after you filled DS-261 then got a checklist for it? NVC emailed to you for that checklist or you see something in Form Portal?

I have completed DS-261 on May 8, waiting for IV fee. The status shows : Completed until yesterday I clicked on it to review something and then log out. Today, when I logged in, I saw that status of DS-261 is Incompleted. I have to sign and submit again. So I had 2 receipts of it, 1 for submitted on May 8 and 1 for submitted today. Anyone knows what is a problem? Why the status changed?

Hi all, new forum member here. My name is Paul, and my girlfriend in Vung Tau and I are just starting on this journey and need help with the process. As you can imagine, there are a lot of questions, and a lot of advice from friends and family. I hope I am posting this in the right forum.
First off, we are planning on marrying in Vietnam in September. We are in the process of gathering documentation and the necessary forms.
I found a page on the Vietnam Embassy website that outlines the documents needed, and allows you to gather, have notarized, and send in the documents to be certified by the embassy, BEFORE traveling to Vietnam to get married. http://vietnamembassy-usa.org/consular/legalization-document-marriage-registration
it has a list of documents to send in, along with a certified photocopy of my passport (info and pic) and then I will receive the items certified by the embassy, along with Power of Attorney for her to apply for the marriage license before I arrive.
She is concerned that the local justice in Vung Tau will not accept the documents (even though they are certified by her government)
She picked up a packet from her local office, and they look similar to what is on the Embassy website, with two distinct differences.
1) the forms she received have a stamp on them from Vung Tau and are printed in Vietnamese only.
2) the forms on the Embassy website have both English AND Vietnamese on them; no need for translation later.
My question concerning this situation is, has anyone here used the Embassy forms (and had them certified through the embassy) and been successful when applying for the marriage license/certificate?
I know we will need those forms translated later for the visa process (K3/IR1-CR1) and this would save us time and money in the long run, and make things easier and faster for us, when I go to Vietnam in September.
You need to do all of embassy forms as they required. When approved your file, they will send all of them back to you. In Vietnam, you have to redo Application for Marriage Registration in their form. Dont worry about that, you do anything embassy required in here and redo anything in local justice. The funny thing is embassy doesnt accept local justice forms and local justice doesnt accept embassy form. I did twice, so trust me

I just found out that my case is sent back from NVC to uscis. No reason why, they just told me they sent it back on April 28, no other info, just to call uscis.
Btw, I got approved on March 19, 2014. I-130 petition.
Anyone that has went through similar situation, what now, what to do?
You need to call USCIS to find out what hapened on your case. USCIS requests to get case back or NVC return it to USCIS? Either way, you MUST call them ASAP. Does NVC assigned the NVC Case number, nor you have paid AOS/IV fees yet?
@chalesreco : Dont say something that you dont understand. After approved the case, USCIS will ship it to NVC for Visa processing, they are 2 different places to process. If your case has been returned to USCIS, that is not a reason for "faster processing".

Case number/IIN generated on May 03, IV fee still NOT INVOICED. Is it normal or I need to do something with NVC?

You are exactly one month ahead of me! (case approved april 28th, shipped to nvc 1st may) I really hope my dates come along the way yours did!
Yes, just email to NVC and ask for NVC Case # . Write your USCIS Case number on the subject line. Remember include Petitioner/Beneficiary's name, DOB in the email.

I received an email from NVC with my Case # and IIN today. This is an email that NVC reply to my email sent to them on April 1. Because I know that NVC took about a month to reply an email. That's why I emailed to them to ask for Case # right after USCIS confirmed that my case was shipped to NVC on April 1. Still cant login yet, hopefully I can login on Monday. For more timelines about my case
- USCIS Approved on March 28, and the Status shows that USCIS shipped my case on April 1
- Called NVC on April 7, they said my case arrived at NVC on April 7
- Received another email from USCIS, answer about my inquiry a month ago. The email said my case was shipped from USCIS to NVC on April 7 (???).
- Confused, so I called NVC again, they said they received my case on April 11(???), still not enter to the system yet. Told me wait for 30 days from April 11.
I planned to call them again on next Monday, but received my Case # and IIN today

So, my wife's visa was approved at her interview today. They said she would get it within a week.
They only asked her one question... "Is your son with you?" Then approved the visa.
We couldn't believe it.

hope every one had a great weekend
last week i filled my ds-260 form online & sent all supporting documents BUT i did not send PCC certificate !!!!!!
As i am from INDIA and my cosulate is MUMBAi consulate. In my state,passport office is asking for checklist or about interview e-mail from the NVC to issue a PCC
i called nvc 3 times and the lady operator told me that "there is no need to send PCC with this package i have to take it at the time of interview with me".
so ,there is a chance to receive check list from nvc about the submission of PCC ???
i already include the letter written by me,in the civil documents, that i will take the PCC at the time of interview with me and signed & dated the page.
please advise me with this specially members who have Mumbai consulate and who faced this situation....
It depends on person who process your case. I knew some cases processed without PCC and applicant must be bring it in the interview while other cases NVC requested the PCC during process the case. Who knows.....

It's rare to need any translations at the NVC stage. (China is an exception.) Documents in Vietnamese are fine if the interview will be in Vietnam. French in France, German in Germany, Russian in Russia, all OK. However, if the interview is in Vietnam and there is a German document, it would need translation. Most of the exceptions involve police reports from a third country the applicant may have lived in after turning 16.
I agreed, in Vietnam we dont need translating docs to English if they are Vietnamese language. The Consulate Officer (American) in Vietnam they can Read, Write, Hear and Speak Vietnamese very well. I knew that because I have talked to them twice. Once on my ex-wife's interview and once on my son's CRBA/US Passport. They spoke to me in English but spoke to my wife in Vietnamese. They readed our emails ( we used Vietnamese) and understood what we told with each other in those emails.

Also, if petitioner have any previous marriages, bring all docs relating to those to the interview. The NVC doesnt require those but C.O always asking for

As you see processing time on USCIS website, the process for F2A and CR1/ IR1 are the same time frame. So, when your husband became USC but your case still pending...just notify them your husband now is USC. And then wait for approval, look at approval notice, if they listed in the "USC filling for spouse....." so you dont need to notify to NVC. But if you see "Permanent resident filling....." you MUST notify NVC. Just in case if USCIS did not received your notification so they still process your case under F2A
