  1. A child under the age of one has not reached the age of majority so they still must be counted.

    I can't believe the terrible advice people give here and then quote the actual correct instructions! In order to not be counted, the child must be above the age of majority, usually 18, and also not be claimed as a dependent.

    So you think this instructions from USCIS are wrong?

    "You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax return."

  2. I agreed with ssw, found this in instructions for I-864 on USCIS Website

    Item Number 4. Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax return.

  3. I preparing to fill out I-864 form, the questions in Part 5 are:

    The first questions, following the form

    1. Enter the number you entered in line 7 part 3. I sponsor for my wife only, so the number in line 7 part 3 is 1

    2. Yourself. I entered 1

    3. If you married, enter "1" for your spouse. The question is what number I will be enter in this box? Because the immigrant is my wife that I have counted above ( at part 5-1). The form said DO NOT COUNT ANYONE TWICE. So if I enter 1, total household size in line 8 will be 3

    The second question

    4. If you have dependent children, enter number here. I have little son who almost 4 months old, he is an US Citizen living abroad. In the recent tax year(2013). I did not claim him as my dependent because he doesnt has a SSN yet. In my tax return transcript, there is no dependent to show. So in this box, I must be enter 1 or 0?

  4. The background checks, security checks... are the reasons they created by themself to hold your case cuz they dont have any other reasons, I think. You need to email them as I mentioned above. Let see what I got from them few days ago.

  5. can you please help me, its been 10 months and 22 days.. and i still havent gotten an approval..can you tell me who i can email and plz give me the email address and kind of show me an example of what i can say in the email... thanks in advance

    Noticed in Mr. Rendell, the first email I sent, he replied to me "I will follow up in your inquiry". When I received a response from Senator tell me that my case pending for background check clearance and have to wait 30 days. In the next day, I emailed to Mr. Rendell again. I told him I was confused and frustrated because so many petitions filed in Sep 2013 and some in Oct 2013 has been approved. My case filed in May, 4-5 months before them but still pending just for a reason "background check clearance" ......And you know what happen? Very next day, my case status changed "Your name updated...."that is yesterday, approved today

    I dont know those people listed above who would help, because I emailed to all of them. I think Mr. Rendell helped me. Back to April filers thread, LoveMyTiCo said she sent an email to Mr. Rendell and her case approved on the same day at 10:30 PM

    In the email, just tell them your situation, they dont have time to read your whole story. Just focus on Date, Processing time at service center, you believed your case was outside of normal processing times...

  6. Regarding the question "Is the child immigrating with you?" on the DS-260:

    My wife, the beneficiary/applicant, is in the Philippines with our daughter. I am completing the DS-260 for my wife.

    We already have the CRBA and US passport for our daughter, therefore she is considered a US Citizen. Therefore I don't think she would be considered to be "immigrating." Therefore, I think the answer to the question "is the child immigrating with you?" would be "No". Correct?

  7. I called USCIS and talked to a TIER II officer about two weeks ago and she told me that my wife i-130 petition got approved and sent to NVC. However the online status still shows initial review and I still haven't got the NOA2 hard copy in mail. I just received the NOTICE OF TRANSFER. ANY ADVICE ANYONE?

    You need to call again to double check on your case. The status not change that maybe system error, but you did not received a hard copy of NOA2 is confused. I think the Tier 2 checked on the wrong case number, your case still pending, maybe

    It is over a month, i haven't recieved anything yet.

    Dose anyone have the same this?

    Someone had this status and then approval just came on the same or next day. Others got this but nothing happen. I got the same status as your in Sep 2013, 4 months after filed but nothing until approval came today.

    Ohh, because you quoted my post and wrote "I have a same message...."my message said name update. That's why I confused. I thought you had a same message as mine, and you know that is changed your husband's birthday :)

  11. If you have not already contacted your senator, please do so; it helped me; they put inquiry for me on Friday, and I was approved on Monday.

    I was also transferred to NSC on 12/12/13 - total time from NOA-1 to NOA-2: 8.5 months.

    Mine transferred to NSC on 12/12/2013 too, I sent email to about 5 people working at USCIS. Made servive request, file 7001 form to Ombudsman, emailed to SCOPSSCATA, OLUInquiries. Contacted to Senator asked for put an inquiry to USCIS.....I did as many ways as I can, and now my case updated with that message. According to lot of people inVJ, that is a sign of approval comming. I just praying and wishing my case will be the same as other people in here. So, tomorrow is my day. It fall on my birthday also. Maybe, USCIS give me a good gift on my birthday :)

    So any idea what the woman could have meant by "your file has been accessed"? I imagine that's a good sign, but how much longer until it might be approved, what is the estimate review time for this? Thanks...

    That means your file has been touched by officer, but who knows what are they doing on your file. Like mine, the officer took my file in Dec 2013, but until now I just got the update above. All the times I contacted to them, even my Senator contacted to them. The responses are "case pending for background check clearance". So "your file has been accessed" or " your file has been assigned to the officer" are mean nothing to me.

LOL I dont know but you made me laugh while i'm feeling so saw. bout my self and everyone as my case .Just clarify something i had k-1 interview before and everything went good in Uscis for my background check .I wonder what is new thing happened since then as i never been in weird situtaion .i am clean like milk .i dont have nothing to worry about .But i will choose the last thing you said lol B********************S

    Maybe your previous K-1 effected to I-130 now. I filed I-130 for my ex-wife 3 years ago, she has denied a visa in the interview. We had devorced a year after, and now I filed I-130 for my current wife. As you know, still pending......how about your previous K-1 status?
