  2. Refused, does not mean Denied/Rejected. Refused only means that the consulate needs more time. They used to use the generic Administrative Processing all the time, but now they are saying Refused when a decision cannot be made at this time hence the 221g, and in this case a white one means they are still looking at your case. Since they kept your passport, that is positive, so just keep monitoring the CEAC website.

  4. My other question is relevant. What color was the 221g. The different colors are meaningful as to how the interview went. I don't know CASV. Also, if the stay was less than 180 days, no bar is in place, if over 180 days to 365 days, a 3 yr bar, and over 365 days a 10 yr. bar. You asked why the CO did not mention a waiver, if the overstay was less than 180 days, no waiver is needed, and if between 180 and 365 days, I suspect you have already been outside the US for more than 3 yrs, so a waiver would only be needed if over 365 day. https://www.path2usa.com/blog/all-about-221g/

  12. It doesn't sound like you need another lawyer as even with a lawyer, one should become an expert of the process. As to a refund, that is hard to say. If you can show clear malpractice, you could sure for a refund, but that may be more costly than what it is worth. As to the EAD, if you have a job offer already, I would pursue getting a replacement card (I assume a new I765 filing), if not, I would probably save my money and wait for the GC. Good Luck!

  15. Often they do biometrics at any location, but to the best of my knowledge, the Detroit office has jurisdiction over all of Michigan. My friend's niece lived in Escanaba when her spouse was adjusting status and they had to go to Detroit. Luckily they had family in the area, so a place to stay for a night. As to canceling the interview and then approving, I have not heard of that happening, but I suppose anything is possible with USCIS. Good Luck!
  16. If you have the IRS transcripts, use those, consulates generally like those better. I would not worry about W2's/1099's and copies of the returns as the transcripts have all the required information. Also, you only need the most recent tax year's filings, but it is good to have the previous two years (total of 3 years) with you in case they ask for more. Also, it is a good idea to have your father fill out an I864A as a household member as oftentimes consulates ask for this when one spouse is sponsoring or co-sponsoring an immigrant and they file taxes jointly. Beyond that, the I864 is only looking for financial evidence, so the list you have with the suggestions I made should be enough. So to be clear, you will have your own I864 showing zero income, your mother will fill out her own I864 with her financial/tax evidence, and your father will fill out an I864A. Good Luck!

You as the USC will need to complete an I864 affidavit of support, and since you are not currently domiciled in the US, you need to find a qualifying joint sponsor that will fill out a separate I864. A qualifying joint sponsor is anyone domiciled in the US and is either a USC or an LPR. Congrats on the I130 approval. Good Luck!
  18. If you haven’t already filed an I130 for him, then yes, you need to do an I130 along with the I485. If you already have an I130, then you would include that receipt NOA with the I485 filing. Good Luck!
