    If the two of you entered at the same time, that's not possible. It's a mistake and he got the wrong card. He does not have to remove conditions. File I-90 to replace his card.

    you have up to 1 year to get the GC, you must pay, the stamp is only temporary proof until you get the card, the GC is for everything to prove that you are a resident,
    plus you will need the GC to remove conditions 90 days before your GC expires.

    Yes you have to pay for the cards. You will need these for when you remove conditions and apply for the 10 year greencard,

    What the consul was thinking..... where did the embassy's learn that your son has a USC father in the first place? Is he listed on the birth certificate as such?

    The embassy needs to get their head wrapped around the fact that your husband is NOT the father and that the father is not in the picture at all...
    If you can get the USC bio-father involved then you can complete CRBA, otherwise this is a lost cause.

    I am not sure how you can complete CRBA without the bio-father. If they request DNA testing how will you get this done without the bio-father? How can you get the CRBA forms completed without the bio-father's signature and personal information? ... I think the embassy was not paying attention on this one and for some stupid reason believe your husband to be the father.
    I think this was one sleeping dog that should have been left laying and not mentioned at all.

We will accept a notarized copy of the current U.S. passport and its pages in lieu of the original. (Note: we only accept documents notarized by a U.S. commissioned notary). If the U.S. citizen parent was naturalized, he/she must bring the original Certificate of Naturalization.

    Not likely... as in don't hold your breath on that one. The USC bio-father abandoned the child, so there is no real way of proving the child is a USC. Her husband is not the father of the child. The consulate will NOT automatically deny a CR-2 in this situation, and a IR/CR-2 is the only way the child can legally enter the USA.

    If the father is a USC you will have to file a CRBA first. Depending if it's appproved or denied, you will then either receive a US passport for your child, or will be able to file for a CR-2 visa.
    The consulate will automatically deny a CR-2 if their is a potential claim to USC, so do this first.

    His information is on there and he signed it and checked the box stating he is the culprit responsible.
    He signed in his name clearly on the NSO birth certificate that we have and put his profession and full name
    There are pictures with them together before and they had a place together.
    I....also...was wondering what the embassy was thinking, though, I trust the Almighty GOD is able to remedy this shortly.

    He checked box that he is the biological "father"

    Not sure what the embassy is thinking either, without the bio-father signing the required forms CRBA isn't happening ... embassy sometimes does the weirdest things. I hope it gets remedied very soon for you all as well.

    Go thru with CRBA, a denial is already expected anyway because according to you the bio father is no where to be found so he can't sign the forms. The consul will downright deny CRBA upon interview the minute you explain the situation.
    Once CRBA is denied, the child can chase the IR2.

    Very likely.     ACS doesn't need it completed, USCIS just wants to see if it is approved or denied.
    Aas mentioned above, USCIS needs to determine if the child has a claim to citizenship. If there is a "no-claim" letter issued, USCIS can continue with the CR-2.
    It's not weird: By law they can not issue an immigrant visa to a USC (wouldn't make sense, too). That's why they need clarification, of the child's potential citizenship claim. This is a consular and not USCIS procedure.

    You can get your CFO sticker at any of the three locations; CEBU CFO, Manila CFO or NAIA CFO desk (see instructions below)
    You can get your CFO sticker (be sure to bring your certificate with you if you are going to get the sticker at the airport for that matter all locations require your certificate for processing) at Manila NIAI Term 1. NIAI office request that you call ahead 2-3 days to make an appointment. The airport location is open from 5am till 12 midnight - CFO NAIA desk is at terminal 1 (one)... beside TIEZA travel tax desk... between the entrance doors with the x-ray / conveyor machines...     Your visa packet with your passport will be delivered by 2go, or you'll pick it up from 2Go (depending on which method you chose if it's delivery or pick-up). You will have to go to CFO carrying your passport with you, don't forget to bring the CFO certificate AND receipt. You have to present it to them and they will affix the Emigrant Sticker on your passport. You don't have to pay anything at this point.
