    Yes...but of course we all know that Colorado is not in control of the VISA process. The Federal Government is and Federal Law still outlaws the possession of and/or use of marijuana, period.
    Now once you are here I suppose you could move to Colorado and smoke all the ganja you want but only after you complete the ROC or AOS process. But why take any chances??? Just say no to drugs...

    I empathize with your situation.
    My brother in law had to navigate through a maze of F and H visas in order to be able to stay in the US legally with my brother, when a marriage certificate would have sufficed from the onset.

    Congrats! My uncle and his partner are approaching their 35th anniversary together. They've decided to give up on waiting for Texas (where they're both from) to allow them to get married and are going up to Washington, DC soon to tie the knot. May you two be as happy as they have been all these years.

    In Bogota, no. The interview takes place inside embassy grounds, but outside. You walk up to a sealed window in which the CO sits on the other side, and you have to pick up a phone to talk to the CO. Your fiancé can stand next to you, but he won't be able to know any of the questions the CO will ask you, just your responses to the questions. There are actually 2 windows you go to: the first one you hand all your stuff in to the Colombian consul, and then you have a long wait until they call your name. The second window is where you have your actual interview with the American consul. Be prepared because it is all outside still and it does get a bit cool there.

    Well Well Just to let every one know we got Approved today in Bogota Colombia and and my Fiance is 23 and I am 54 so im no math major but that looks like 30 years to me and they did not even ask me a question took 8 minuts at the prison window they make you talk throgh a phone like TV anyway baskc questions asked and we studied everything and I mean everything . I have made 10 trips to Medellín we rent an apartment and my fiance Works in Center down town so yes they are not stupid you cant present a half ### effort so save all your money and effort if you dont want the real thing and speeking of money i spent over 50 k in the effort over the last 2 years that is how long we have kinown each other and how did i spend that it is realy easy 10 trips business class rent at our house food entertainment and general support it ads up quick and I know everyone cant go to this extream and i am not suggestion it is the only way but what i am saying is that if it is not real dont bother you need a real bonofied relationship and be willing to work harder than you ever have and spend the time nurturing the tree before you try to harvest it. No No No you cant do the thing whare you have net your girl just a few times and expect that your emails and other forms of comunication will have much weight but please keep in mind the extream age diffrence between us and put that in context within your efforts. and yes tonight is a very good night in my life and thank you all for the informao on i read to help me prepare but remember last night i was scared to death and did not sleap in the hotel in Bogota and i had no gurantee and no back up plan so just make it real do not lie do not try to bs and do not even start if your not serious because they can see right through this.
    The interview was the easyest part of the the process and the people in bogota that worked at the embassy could not have been nicer or more accomodating no matter what you think its not luck it is preperation and authentisity that will get you through but remember i was terified last night along way from home looking for an ace and on pins and needles and one other Word of advice i would like to empart to you if you are going to make this effort go to the friggin interview with your fiance every person we s going solo was denied yes so if your trying to save a few bucks on airfaire and figure you will just stay at home and wait for the phone to ring your a big tool it would be like giving your wife cab fair when she is in labor and ask her to let you know how it all turns out remember she is under intence stress and it is intimidating as hell so get off your ### and buy an airpline ticket and be there with her and after all she or he is the one giving up all the know to be with you dont give up if your in love you will do anything to make it hapen and if a fat White bald guy and have his dreams come true so can you remeber im ugly as hell on top of being old so you have alot more going for you

    That's messed up. But then they go and legalize it in the US. I mean, I get that it's illegal and all, but it's so darn common and I just don't feel like having used it once 10 years ago deserves a denial and ban.
    Once when I was crossing the US border, they pulled my bag out and said their dogs smelled marijuana on it (to this day, I can't figure out why). They started searching it and asking questions about my drug use and one of the first things the guy said to me was "Look, we don't care if you have used it in the past, just don't bring it into my country". That made me feel like these past run-ins with drugs wouldn't be so important. O well. Immigration is too subjective!

    In the past I have had both mental health problems and problems with drug abuse. I was really worried that it might be a problem but I had a lot of help from some people on the forum and successfully received a K-1 visa with no delays. I did this all on my own without the help of an attorney, but every case and embassy are different. Some people thought I should lie, some encouraged me to tell the truth and almost everyone said to not volunteer information. I definitely agree with not volunteering information, and just answering any questions asked, but if you do plan to be honest it’s important to be able to prove that you no longer abuse drugs. I want to share my experience so that it might help someone else out.
    I’ll outline a bit of my history just so you understand the context of everything I brought with me to the medical and interview.
    When I was 14 I was hospitalized for 2 days for “suicidal ideation”, with no suicide attempts ever in my life, just thoughts.
    I self harmed, and abused drugs from the age of 15 to 19. I am now 25.
    When I was 16 I attended 10 sessions of out-patient drug counselling. The drug that I used the most was marijuana. I did experiment with some hard drugs but haven’t used hard drugs for over 5 years. I wouldn’t call the hard drug use “abuse” but the marijuana use was definitely abuse. The last time I used marijuana (or any drug) was over 2 years ago.
    In the past few years I have seen 2 separate psychologists to help cope with different stressors in my life.
    So this is what I brought with me to the interview:
    An original signed letter from my family doctor, on her letterhead stating how long she’s been my doctor (only about 5 months), that I’ve been taking an anti-depressant for about a year and a half to treat anxiety and that it’s working. That I’ve been receiving counselling, and that I have produced negative drug screen results and she has not see any evidence of drug or alcohol misuse, and that she doesn’t believe me to be at risk to harm myself or others. Negative drug screen results for the 3 months prior to the medical exam and interview. I obtained these by requesting them from my family doctor. An original signed letter from a psychiatrist saying that he had assessed me and outlining my depression history and how’s being treated. Also including my drug use history and that it has not been a problem for 5 years. That I did engage in self harm but haven’t done it for 5 years and that I have never had a suicide attempt or been a danger to others. That my depression prognosis is good and I am at low risk of harmful behaviour to myself or others. I’ve heard that if the panel physician thinks you may still have a problem they will send you to see a psychiatrist. Copies from my medical record of notes from 4 sessions by one of the psychologist I’ve seen, which were provided to my previous family doctor. They outline some of my history, how I appeared when I showed up, how I was feeling, what we worked on in the sessions, as well as how I was reacting to the strategies we talked about in previous sessions. An original signed letter from an addictions counsellor outlining how many times I went to counselling at youth addictions services, to make changes to my substance abuse. A copy of my file from when I was hospitalized including the discharge summary. A copy of the original police certificate provided for the interview, showing that I have no criminal record. Original signed character reference letters (on letterhead when appropriate) from my boss, one of my co-workers, my best friend, my mother, one of my aunt’s, another one of my aunt and uncle, another friend, my fiancé, and my fiancés parents. Some of the letters do not acknowledge that I have had drug & self harm problems, while others do. The doctor said that character references are good to have. A letter that I had written outlining my history, including where it started and why, why I used and self harmed, the treatment I’ve gone through and what I’ve changed so that I can cope now, and how I cope with stress. The interview and medical were done in Vancouver. I saw Dr. Cheema for the medical exam and he was super nice. He asked me all of the basic health questions and when I answered,”yes” to having abused drugs he looked kind of frustrated. He then asked me when the last time I used drugs was, to which I answered “over 2 years ago, and I have evidence to prove that.” I then told him what I had brought and started handing it over. The only thing that I didn’t offer was the letter I had written. He did ask me which drugs I had used but because of all of the proof I had with me that I no longer used, he didn’t think it was going to be a problem.
    After showing him everything I had brought he was impressed that I was prepared and was fairly confident that I would be okay. He did send me to do another urine drug screen, which was obviously negative. The drug screen is not usually included in the medical.
    My medical was approved (thank you God!) and I had the interview 3 days later at the Vancouver Embassy.
    There were a couple of forms required for the interview that did mention drug abuse. They may not even be relevant now because I’ve read that they don’t used these forms for the K-1 anymore, but this is how I answered.
    The DS-156K has a question on it that says, “Have you ever been afflicted with a communicable disease of public health significance or a dangerous physical or mental disorder, or ever been a drug abuser or addict?” I answered “yes,” to this question.
    The DS-230 part 2 has a question that says, “Except as Otherwise Provided by Law, Aliens within the Following Classifications are Ineligible to Receive a Visa. Do Any of the Following Classes Apply to You? A. An alien who as a communicable disease of public health significance; who has failed to present documentation of having received vaccinations in accordance with U.S. law; who has or has had a physical or mental disorder that poses or is likely to pose a threat to the safety or welfare of the alien or others; or who is a drug abuser or addict.” I answered “no,” to this question. I was not asked for this form so it didn’t matter.
    The first lady I talked to who goes over all of the paperwork that is required at the interview noticed that on the DS-156 I answered “yes,” to that question and she asked me which topic it applied to and if I had gone over it with the panel physician. I told her that I had, and she said, “ok,” and circled it in red.
    When I talked to the second person who actually did my interview, he said, “it says here that you have a history of drug abuse, when was the last time you used?” I replied, “Over 2 years ago.” He was satisfied with that answer and went on to ask me questions relating to my relationship with my fiancé.
    I was approved on the spot at the interview and receiver my visa 4 business days later.

    I put a lot of work into everything that I had to gather and it took a lot of time. If I had realized sooner that they would ask me about drugs (duh!), I would have started a lot earlier and brought more drug screen results than I did.
    Whether you have had treatment for mental health problems or drugs, or not, I would recommend you bring a letter from your family doctor and a letter from a psychiatrist if possible. If not, a letter from a psychologist. The doctor said the character reference letters were very important. If you did abuse drugs, even if you don’t anymore, doing some sort of counselling specifically for that may be in your favour. Negative drug screens are a good idea.
    When doing research please pay attention to that date that any article or forum topic is written as it may not be relevant anymore. It used to be that if you used drugs within the last 3 years you might get a 3 year ban. That has been changed and now if you’ve used in the last year you can get a one year ban. I’ve also seen cases where people get banned for the amount of time that would make it one year since they last used drugs. For example, if you used drugs 3 months ago, you might get banned for 9 months. Keep in mind that it is all up the panel physician and the person interviewing you. If the panel physician believes that you don’t have a problem anymore than you will likely be okay when it comes time for the interview. If you are still a drug abuser you can get banned for however long they want to ban you, including a life-time ban. If you don’t abuse drugs and you can prove that then you should be fine.

    I have my interview on the 21st and all I think about is how long our journey has been. I remember walking to the airport with my boo and how we promised we would grow old together. I remember that day as though it had been yesterday. I was 19, now I'm 25 and I still think the same way. It feels so good to have a chance.

    It's been 3-1/2 years since we were there but I, the USC fiancé (at the time), just accompanied my now-wife to the embassy and showed my U.S. passport. No problems getting in...

    Applying and getting a K1 visa will eventually lead to a green card and US permanent residency for you.
    If you don't intend to live with her in the United States, maybe you should look into acquiring Indian residency for her.

    You'll need the I-693 once you're in the US and want to become a permanent resident. He's talking about that.
    My fianceé went with Dr. Roa in Bogotá. He gave vaccination records in English so that we could use them in the US. This was helpful.
    My fianceé had some vaccination records but she only had shots for things that were not relevant, like Yellow Fever.
    She got all the shots at Dr. Roa's office after speaking with the doctors. All those shots costed about 350mil. This was a number of months ago.
    It was expensive this way but it seemed to help facilitate other parts of the process.

    Packet 3 & 4 were sent out years ago by the US embassy in Bogotá to the beneficiary before the interview. The process has changed a few times and it is now called the "Appointment Package" or Interview Package". You get it via email from the embassy once they receive the case from the NVC but you can speed things along by downloading it from their web site: http://photos.state.gov/libraries/colombia/231771/PDFs/iv-pkt3-4inst-interview-medical-exam-nov2013.pdf
    Follow the instructions listed on the package and you should be fine.

    Yes, it does vary from consulate to consulate. And that info posted above from Nov. 2012 is very out of date. Those forms are not used any longer. The DS-160 replaced all the other DS forms on Oct. 7, 2013.

    There is no "Packet 4" for the Bogota embassy. Packet 3 gets sent by email, as far as I know. It's a long list of instructions for the forms you need to fill out and what you need to take to the interview.
