    They won't get a flood of service requests if they keep holding back the processing date to keep very few people eligible =\ Filers in March and April are struggling with this now -- they've been waiting a hugely long time, but that date is set to Feb 13 so they have no recourse available. The average processing time says 8.7 months, so they've passed that, but USCIS will won't allow service requests because they're treating Feb 13 as the only bar they've set.
    Their official procedure is to process according to first in, first out. You can even find where it says so in the adjudicator's manual online. But that's blatantly not what's happening. Take a look at the CR1 timelines on VJ, you'll see approvals even within individual service centers are jumping around. The last 10 at NSC went from April, to May, to March, to May, to April. Texas is even more all over the place. There's no pattern discernible here, it's just chaos. That being the case, I don't think it's possible yet to predict what will happen for August. April filers are still significantly held up while May-July are seeing random batches of approvals. If some kind of rhythm or regularity emerges we can try to do some forecasting.
    As far as a letter goes, I've been involved writing the past two and I'm happy to help with future efforts. Whether or not they result in action directly visible to us, I for one couldn't bear simply sitting through the process without knowing I had exercised every option available to me. There is no stone I would leave unturned when it comes to ending this painful separation.

    Hi,
    We filed in December and on the cover letter I wrote "I-130 filing fee of $420.00 in the form of USPS money order." Everything went fine and we received our NOA1 shortly after.

    I believe it is because you are from Philippines. and uscis expedite them. Aren't you happy? it is a good thing. in few days you will get a snail mail, then send what they ask for and hopefully move on to next stage.

    NBC= National Benefits Center
    VSC= Vermont Service Center
    Nothing has changed. VSC is just the only service center not adjudicating transferred (from NBC) cases; it's only CSC, TSC and NSC.
    The Philippines were left our because of all the expedites. They were not relevant since Nobby was trying to find some sort of pattern, rhyme or reason for regular cases.

    Just a follow up on Nobby7's post - For any of you that were transferred to the Nebraska service center, I took it upon myself (I like doing these kinds of analysis), I took this thread that Nobby7 mentioned: http://www.visajourn...heets-in-order/ and put together all of the different months from March to July filers. I took out anything that wasn't transferred to the NSC, I took out RFEs and Expedites to get an accurate picture of a normal case. It's hard to know if the information is accurate or not, but I think the best points I feel confident about is this:
    For those who filed in March, they were mostly transferred around late October or early November(as of today it's been about 2.5 months) and about 75% of their cases have been approved. For the cases that have been approved so far it looks like the average time was about 6-7 weeks.
    For those who filed in April, they were mostly transferred around mid November (as of today it's been about 2.5 months) and about 67% of their cases have been approved. For the cases that have been approved so far it looks like the average time was about 4-5 weeks.
    The people who filed in May, it looks like they were transferred around early to mid december, so since only about a month has passed, the approval rate is pretty low, hopefully in the next couple of weeks these numbers pick up.
    Anyways, I did the best with what I could, hopefully this information is useful to somebody out there, it made me feel a little better since I was thinking I was going to have to wait another 6 months or so, now it looks like maybe in a couple of months I'll get some response. Good luck to everybody out there, we're going to need it!!

    I wanted to share some info that might be helpful for those who are being transferred to NSC (or any other center for that matter).
    Here is a list of recent approvals for those members who have filled out their timeline correctly by updating that they have been transferred to the NSC:

    You will see that there are 12 approvals for the month of January (while there have only been 8 for the CSC).
    You can play with the filters to study the information that is available on VJ and more or less gather a trend of what is going on. What you should find is that for the most part, the NSC is currently approving March and early April petitions. Sometimes you may see an approval for after April, but upon careful study of those particular petitions, you will normally find that those cases are expedited. Another good bit of info is to see how many petitions are being transferred to the NSC by month via this thread:

    With that, you can make a better educated guess of when they'll start approving July petitions.
    What I had noticed for the CSC was that for the months of May and June, there were not a lot of petitions transferred to the CSC compared to what was transferred to the NSC. Thus, when I noticed that the CSC was approving end of April petitions, it meant that July petitions were close to being next (which is why we're seeing some July petitions approved from the CSC). Unfortunately, for some reason NSC has been getting most of the transfers in May and June, so July petitions at the NSC will be waiting longer, but NOT because NSC is slow. There are just more petitions "in the way" of those of us who filed in July.
    I hope this helps paint a picture of what seems to be going on in the background, and sets some ease for those who are anxiously waiting.

    This is incorrect.
    A foreign spouse of a USC can elect to be treated as a resident for tax purposes. Once they do that, they can file MFJ, but by filing MFJ worldwide income of both individuals is subject to US tax. The Foreign Earned Income Exclusion would apply to any income either one of them earned overseas.

    and this is only the first step.. then the nvc (3-4months at the moment) and then waiting for interview.. huh, I hope it will all move on, and we will not have to wait for so long, but let's wait for all the transfers to be done and when the October fillers will start to get approvals then we will know for sure that we are getting closer
    awww. I hope that the time before you are going to see each other again will pass fast. My hubby is coming to me in 33 days!

    I hesitated to make this post, I wish it could be more useful and less stressful to my fellow filers suffering through the process, but maybe it'll spread some hope anyway. Received my approval notice late last night and it was a very much needed bit of good news. USCIS didn't email me until almost 12 hours after my status updated, so I recommend you guys follow your status online and don't rely on their alerts.
    NOA1: June 12
    Transfer to CSC: Dec 23
    NOA2: January 7
    So this is after CSC approved a June 12 and a June 14 filer last Friday -- they're really running through their cases. I have no idea what will happen at Texas or Nebraska but I'm definitely sticking around to see (and to help). My fingers are crossed for all of you. Keep sharing updates here and I'll make sure everything makes it into our spreadsheet!

    I read these types of post over and over and over again.
    I challenge all men who are in this type of relationship to sit at home for 1 week.
    Here is the challenge. Ask your fiancee / wife what she watches on TV while she is at home.
    You will quickly find out she is watching day time TV shows about every preverse subject know to man kind. Men who are women, women who are men, men who think their men, brothers sleeping with sisters boyfriend, aye man the list goes on and on and on and on.
    Think I am kidding...take up my chanllenge.
    Remember what the Bible says..an idol mind is a dangerous thing.
    When your fiancee / wife get's to the United States, get her busy. Don't let her sit at home all damn day. This is not their nature. Ask her if she wants to go to school. Wanna know her answer. yep, that's right. SHE DOES!!!!!
    If she cannot work due to immigration status at this time, get her doing volunteer work and tell her you will match her hours at the volunteer work with a salary from your personal paycheck. Philippinos love to work. They hate being stagnent. It is a death sentence to them.
    The other thing the DO NOT appriciate...taking care of your elderly parents or your ill mannered children. Philippino children, believe or not, have respect for their parents and more importantly their elders. Something we do not see in American Children.
    Step back and take a good hard look at her day.
    Another thing, Philippinos are very private people. Yes, you can take them to a culture center or church, but unless she makes the first move to cultivate a freindship, it will not happen.
    Talk to your wife bro, tell her you want to enroll her is some classes. Just get her busy and OUT OF THE HOUSE!!!

    It's a good idea to always send the G-1145 on top of the WHOLE pile so at least you get an email or text message stating the case number and that it was received. Also after that sign up for an account if you can see your case online so that you're updated as to when the NOA2 comes in vs waiting for a paper copy (that's how I found out about ours.... )
    Also it's good to note that people who live abroad together may or may not get the hard copy NOA1. The USCIS is horrible at sending out the hard copies to non-USA addresses.
    The petitioner can certainly call the USCIS and find out what the number is though if you haven't gotten it yet but the check has been cashed!

    Ok, but you got the email with the information in it, right? I would wait until 30 days after they got it to start calling and asking for a duplicate because you didn't get a hard copy.
    Don't get nervous and upset yet. Even if you don't get the hard copy, you know where your file is going, and you have your information, right? That means you can track your case. (For what little good that is. I can't even tell you how much I hated that friggin' Initial Review message. And then the stupid Transfer message.) Good luck! I hope that your processing time is much improved the earlier 2013 filers!

    Ok, but ####### is with them losing all of these vital documents that were already sent to them. Seriously. Again, I know that the Ombudsman compiles information about the RFE's including whether or not they're being used appropriately. If you've gotten an RFE for something that wasn't originally asked for (like your spouse's birth certificate) or for something that you already sent to them, I urge you to shoot off an email to the ombudsman with your information and what happened.
