    You've used an excellent example. However, many state's that don't allow first cousin marriage, have no problem allowing first cousins married elsewhere, to reside in their State. Texas is an exception. It all comes down to the meaning of "offends the laws of...". Evidently one Consular Officer has interpreted that first cousin marriage offends the laws of Texas. I don't know about Arizona. The problem sometimes with getting answers from attorneys or anybody is that you must first ask the correct question, providing all the relevant context. Since I don't know the questions actually asked, the answers may or may not apply.

    The adjudicator's manual states, "In some foreign countries, and some states in the United States, marriages between close relatives (e.g., cousins) are permitted under certain circumstances. In cases where such marriages do not offend the laws of the state where the parties reside, the marriage will be recognized for immigration purposes."

    That's right, neither of them have done anything illegal, provided they got married in good faith. They are not proposing to circumvent any laws or do anything else questionable. The OP has been pleasant and willing to listen. We may not agree with them, but we owe them every consideration.

    I think our job here as vj members is to help and guide not to judge. She is here requesting our help for her immigration process, I didn't read anything about she requestiong our opinion or our thoughts about her life desicions or why she married her husband. It's her business not ours. Even when is unusual it doesn't mean she entered in a fake marriage. I married my 3rd cousin and he is the love of my life.

    As to the address, use an attachment with the specifics just as they are used in CR...also add an explanation to the attachment that there are no street names or numbers in CR. We had our first attachment bounced back because we didn't explain the address situation.
    And it isn't just her current address--it includes past addresses as well as her work addresses.
    Also, there will be NO mail sent to her--almost no one in CR has mail delivery. The embassy works entirely by telephone and email. Be absolutely sure that you provide her cell phone number.

    This 'geezer' decided to ask an attorney friend about this for you.
    In his opinion
    "The petition would probably be invalid even if the marriage is valid because a minor would not be able to be held to the conditions of the I-134 affidavit of support. Under federal law and various state laws a contract with a minor is not enforceable. Someone who has not yet reached the age of majority cannot sign a legally binding contract, some exceptions are made in the cases where legal emancipation has been processed through the court. This is because a minor can disaffirm a contract made, no matter the case. The I-134 is a binding legal contract between the federal government and the petitioner with conditions, rights and responsibilities. When a contact is disaffirmed the entire contract must be disaffirmed. in this case it would require reversal of the entire immigration process without condition or penalty, which is also not permissible under federal law."

    Maybe I missed it but I didn’t see anyone call anyone a predator.
    There is MCUH more in question due to age than just the minimum age requirements for marriage.
    Unless legally emancipated a minor (under 18) cannot engage in a federal contract without the written consent of a parent or guardian. The nature of most of the CR-1/K-1 documents do not provide allowance for written parental consent. It will probably rejected even if the marriage is legal.
    Another concern is the financial ability and stability of the applicant. While a cosponsor can be used if the income requirements are very close to having been achieved the petitioner is still of primary responsibility and parental consent is not a factor.
    The interview will also primarily focus on validity and ability in the opinion of the interviewer. You’re working very hard to convince PRO-VISA people of the validity and ability of your situation, it will be a 1000 times harder to convince an interviewer.
    The advice to see legal advice is the best.
    As a group we are mostly against the need for legal help in the process. If people here are suggesting you do so then it’s a big issue and your only real option if you want it to succeed.

    On a hunch I just called the DOS. The nice operator told me that the NVC is seeing my payment as "Paid" and what I see on the payment status portal is different from that. She assured me that our case will not be delayed. Gee whiz!

    Just some observations about the CR-1/K1 process.
    The visa process can be seen as sort of a trial by fire.
    Consider this.
    If you are impatient… you should reconsider.
    If you are easily upset or angered… you should reconsider.
    If you have money problems… you should reconsider.
    If you have difficulties understanding legal documents… you should reconsider.
    Be aware of this.
    Expect the process to take a long time.
    Expect to be tested mentally and emotionally.
    Expect to pay repeated fees, travel expenses, as well as being able to support both yourself and the beneficiary for a long time even after they are here.
    Expect to be judged and scrutinized based on how you look on paper and in person.
    The view of USCIS and the embassy.
    You are guilty of visa fraud. You must now PROVE that you are not guilty and your relationship is real. If it’s real then you will wait as long as USCIS deems reasonable.
    You are guilty, belligerence or arrogance will not be tolerated, and your feelings are a moot subject and do not matter.
    You are responsible for ALL financial matters related to yourself and your beneficiary from now until the end of time. Your ability to support your family WITHOUT the assistance of the beneficiary MUST be proven. You will not be allowed create a potential burden for taxpayers by bringing a person into the county.
    Your age even at 18 will be viewed with suspicion. Your financial ability will be viewed with suspicion. The validity of your relationship will be viewed with suspicion. Your maturity will be viewed with suspicion.
    After all that… The entire process can come down to the OPINION of one person, who you may or may not be allowed to speak with for only a few minutes. Without the time or ability to plead your case.
    This is not a light decision. It will affect the rest of your life. It is expensive, time consuming, and painful. It is intended to be difficult. We choose this path because we have no other choice. We choose this trial of fire rather than losing a part of our soul. Even a man who displays absolute bravado will quietly admit that asking him to live without his wife/spouse/fiancée/asawa is like asking him to live without air.

    He comes you get married he leaves. The I130 gets filed ( you could do this before he leaves) the I130 takes about a year. He can visit but he must NEVER lie to immigration and he needs to show he will go home after each visit until he gets his CR1 visa.

    OP, are you the girl or the Irish guy this time? In each different thread you post, you what to know about either a K-1, VWP or CR1. Either you know you want to come to the states to marry or you marry in Ireland. It seems suspicious and as though you are just finding ways to get to the US and stay here. What are you both really after?
