  1. Thats good. Actually i was also confused regarding PCC, whether i should send PCC to NVC or not. but then i went to an Visa Agent who told me that In Gujarat, passport office is not issuing PCC without showing PCC CHECKLIST from NVC.

    so at that time i get relaxed and i sent in my IV package without PCC. To confirm by myself, i sent an Email asking about PCC, within only 4 hours of sending Email, i got a reply saying that PCC is not required for NVC to complete the case, bring it at interview directly.

    Did they ask original marriage certificate to obtain PCC? How did you get your PCC as you already submitted your original marriage certificate to NVC?

  2. I suggest this (and it's worked before... )

    when submitting the ds-230, have a one page letter clearly stating that you cannot obtain the PCC without the check list letter asking for it, so you are prepared to wait for it and instead of NVC keeping the file open, to complete the review and close the case without the PCC, clearly stating that you will present the PCC on interview day.

  3. So now that I'm awake I reread your entire post again. I agree with Darnell and you should call and make sure your attorney isn't attached anymore and just pay the bills since they are there.

    I called them twice to ask who is the choice of agent on file and they said its petitioner. So I guess I am ok there. I even received an email from NVC stating same.

    I will just go ahead and pay the bills.

    Now one more question... :)

    Will I get any check list from NVC? to obtain PCC from India(Gujarat in particular - Mumbai consulate) they need check list stating PCC and beneficiary's name.

  4. That is the ds-3032 acceptance. I don't recall a formal email about it... No I just spent a minute and my head hurts but I don't recall a formal email. Lol.

    AOS & IV bill generated on payment portal but yet to receive any email.

    Have not received DS3032 accepted email but I see IV bill generated. Is it normal?

    I had send an email to remove lawyer from the case and appointed petitioner as a choice of agent and received an email confirming that Lawyer has been removed from the case, further communication will now be directed to petitioner. is that a formal 3032 acceptance confirmation or I should have separate email?

  6. I wanted to summarize our experience for the forums incase anyone runs into a problem similar to ours. This information may help you save time that my wife and I lost.

    Our I-130 was approved on March 25, 2013. We knew it would take about a week or two to arrive at the NVC but called the USCIS just to make the I-130 had been sent to the NVC. They said it had. About a week after our I-130 was approved, other members with similar cases I had subscribed to on the Immigration Timeline had begun updating their timelines and a lot of their I-130's had been received by the NVC. By the 3rd week we were starting to get a bit suspicious as the NVC had received nearly all their cases.

    So we called the USCIS who continued to state that our documents had been forwarded to the NVC. We asked to speak to a Tier 2 representative who were not helpful at all and would not give us ANY information regarding our case. We called nearly everyday and also checked with the NVC. We decided to send an email to NVCinquiry to find out what happened to our I-130 and at the same time submitted a service request at the USCIS. We even sent a service request to the Ombudsman. None of this helped. We got the standard "Allow us 90 days...". I checked with the forums here and often got suggestions from others to just keep calling. This too is not a good solution.

    The ONLY way you can get your application back on track and find out more information about it, is to contact your Senator or Congressman. In our case we got assistance through my wife's local Congressmans Office. They have a higher clearance and can get further information as to what has happened to your application. It was week 5 (after the I-130 had been approved) when we learned that our application was mistakenly sent by the USCIS to the NATIONAL RECORDS CENTER (NRC) and not the NVC. We were informed by the Congressmans office that it would take 3-4 weeks to get the application sent back to the USCIS from the NRC.

    By May 17th, our application had been received back from the NRC and the USCIS forwarded it to the NVC. The Congressman's Office constantly followed up with their own contact within the USCIS and this designated person within the USCIS handled the retrieval of our documentation from the NRC and made sure it was forwarded to the NVC.

    This probably will not happen to most of you but should your approved I-130 not be received by the NVC after 3 weeks (mind you this is just receipt, I am not talking about getting a case number) you should start to be a bit more vigilant. I really recommend getting assistance from the Congressman/Senators office rather than try to gather information yourself particularly when the USCIS or the NVC have no clue where your I-130 is.

    On a seperate note, one of the Warning Signs for a "lost" I-130 application, which in hindsight is now more apparent, was that a week after our I-130 was approved (March 25, 2013), our case status was changed and updated to "Inital Review" (April 2nd, 2013). This may be a coincidence but I remember getting a little bit concerned when this happened. Thats when we called the USCIS to make sure I application was sent to the NVC, which of course, it wasn't....As of today, our case status on the USCIS portal still shows "Initial Review"

    Congratulations on finally getting your NVC case #. no doubt its a frustrating process, especially when no fault of yours. I feel your pain. I don't understand why so much harassment to USC's and special status given to Non immigrants.

    Quick questionon I-864 vs 864EZ:

    My income from 2012, and 2011 came only from W-2s. My 2010 incomes came from W-2s, and 1099s. This is the only requirent that could preclude me from using the I-864EZ because it says all incomes must be documented in IRS Form W-2s. I am wondering based on your experince, if you would suggest that i use I-864 or I864EZ. I filed I-130, and my wife is the only person which is being sponsored on th AOS.

    I-864 is the standard form - one must be filled out by the petitioner no matter what, and one is filled out by the co-sponsor if one is needed.

    I-864EZ is only used if the petitioner meets the income guidelines by him/herself and needs no additional sponsors

    I have similar situation with W2 and 1099. If anyone please suggest.

    I just want to let you guys know that the people at the USCIS, and the local offices, sometimes give you the information that are not the same.

    I went to Newark last week and the Lady told me they are in the process of sending my file to Mount Laurel.

    So, yesterday I went to Mount Laurel and the Lady over there told me my file will be there, not there yet, but will be there. I asked when, she does not knows, but it will be there.

    So, I called USCIS this morning and the Lady told me my file was send from NBC to Newark on Feb. 11, 2013.

    and from Newark, they sent my file to Mount Laurel on April 22, 2013. How come the Lady at USCIS know exactly the date that my file was send to Newark, and from Newark to Mount Laurel, but the people at Mount Laurel said my file is not there yet? This is confuse me!rolleyes.gifunsure.png

    I suggest you try to contact your congressman and see if that helps... I believe that is the only way you can get an accurate location of your case.
