  1. I don't know a lot about the I-864. But if I'm asked what my current income is, I take my current rate of pay and multiply by either 52 weeks, 12 months, or 2080 hours (full time employment hours).

    For unemployment, I believe they pay bi-weekly? In which case I would take the total unemployment check and multiply by 26. That would be current annual income on unemployment.

    I don't know for sure that's what you are supposed to do, but that seems logical to me.

    Was curious about if income on unemployment can be used to show one's annual income?(that you clarified already):

    Am i correct in understanding... :bonk:

    for ex:

    so, income on unemployment for 6 months + your salary for 6 months = Annual income you can report to them?

  2. I would.

    If I were you, I'd calculate what his annual income on unemployment is. If it's enough, fill out a new I-864 with that income on it and just have it ready to go at your interview. If they never ask, great. If they do, you'll be ready.

    Partial calculation is possible ?

    for ex: in 1 year:

    15K on regular job in first 8 months + 7K on unemployment in last 4 months = $22K annually

    Can we calculate like this way?

The IO escorted us in hes office and asked for our ID's he took my passport and remove the I-94, he didnt asked us about our relationship, he just look on my birth certificate, our daughter birth certificate and the marriage certificate thats it and he said he's satisfied with our 4 yrs relationship with daughter together i am so shocked that our interview last for 5 mins only and i was approved!

    This was your biggest evidence the reason he didn't look at anything else. :whistle:

  4. My interview is in 5 days and I don't even have a joint sponsor. My thing is, if it was a big deal they would have RFE'd me. Hubby is still on unemployment and still searching for jobs. I'm just praying that they don't ask about it. If they do, we'll just be honest about it. Ill update once I get through my interview. If they RFE'd me at the interview, I have a few people I could ask but don't wanna bother anyone if its not necessary...

  5. Hello all.. We just went earlier at aos interview.. We had a good time everything was fine and smooth.. The IO was really nice.. At the end of our interview, she didnt told us that we are approved, she just told us that's it we're finish then when i asked her if we got approved and she said yes.. :dance: Thank God...

    My tip is just have faith in God.. Trust him and pray all the time... :).. Also bring your complete documents.. :)

  6. hi hi, i copy all my visa stamps in my passport (i have 2 passports cuz one has expired), i-20s, my hubby's pay stubs (he has 5 payments in July :innocent: ), our photos in a plastic bag, our friends affidavit (i also attach their pictures with us, bbq, hang out..), our 4 month financial statements highlight with our trip to ohio, sesame place and las vegas, also my birth certificate (3 pages)..I also a cover letter for my petition, 3 cover letters actually should be checklist for each form we filled out.... well, maybe less than 5lbs.. but it is truly thick..

    i used a very thin but very strong bag, it is very large. express mail bag i believe.

    Anyway, good luck to you!! i am exhausted to prepare all the materials!!!!! i am also happy today i got offer!!!!! haha

  7. Hello everyone,

    I am a German citizen and in the USA with an H1B visa. I just got married to a US citizen and now we want to file for I130 and I485. My H1B is about to expire, but we filed a petition for an extension which is still pending.

    Can we go ahead and file I485 now or should we wait for the extension to be approved? If we file now, do we need to include additional documentation?

    When you're filing AOS based on marriage, it doesn't matter if your H1B is still valid or not(unless you want to include your income for the purpose of I-864).

    So, go ahead with AOS process (its' so long anyway.... :) )

  8. In this case, reprint the signature page only and sign on the correct block, as you are filing on her behalf.

    Same is case with me.

    I am filing for my kid under 14.

    As you explained above, so i'll sign for my kid.

    a. Do i need to PRINT my name or KID's name in the next block asking to PRINT Name ?

    b. Do i need to write anything in In Q6: Signature of the person preparing the form OR just NA?

  9. I have applied for AOS through my USC spouse. My question is the case got tranferred to California Server center for faster processing. The reciept starts with MSC.

    Is this normal one office tranfers cases to CSC but they don't change the receipt number to CSC. Does this mean now that CSC owns the case and will stay there till they make a decision?
