  1. Yes, he is expected to provide the information and divorce decrees for all three prior marriages. You do NOT get around it. Certified Copies of Divorce Decrees can generally be ordered from the court clerk or other method. Google "Certified Copy of Divorce Decree, ST" with ST being the abbreviation for the State in which the divorce was granted, and you'll find the how.

For this process, there is no "get around" if something is needed and you don't have it, you obtain it.

Agreed for divorce decrees but what can be done if someone doesn't have 'date of birth' details of former spouse?

  2. Listen - this is not rocket science. Just put the information down in what ever way you think makes sense, as long as it is correct and matches the I-94s you have. You'll attach copies of both I-94s anyway, and the IOs at USCIS are not dumb. They'll figure out your H1-B was extended and the new I-94 issued without you leaving the country. Just fill out the paperwork and send it out - I think you are starting to over think this a little bit.

May be you're right, i am over thinking :)

    Thanks for your help !

  3. Thanks Newbie 608

I am in the US. My friend, who went through the same situation, appealed the case on her own actually got it settled and they got approved. However, everything went pretty fast for them while it's dragging out for me. That's why I am even more confused and do not know if this is abnormal.

For my friends' case, they got separated at the interview. USCIS officers showed up at their place the next day with none of them presented at home. One of the roommate told the officers that my friend did not live there with her husband. The next day, they got called in the office, told that their case was denied and they had 30 days to appeal. It was like click click click. My case has been dragged out for more than 4 months and I do not know what is going to happen now. I am so worried. Do you know anyone who had to go through the same process as I do?

You already have example in front of you, Your friend.

So, how it went for your friend later?

Best advice is get immigration lawyer working with you before its too late, a really good one.

Did you post your interview experience? Do you feel any pointers those brought your case at this stage?

Keep posting, and in the mean time search for lawyer.

Still its not end of the world. You can appeal the decision(if they deny you) and then take it from there.

  4. Filling up I-485 for my kid. Wondering how it'll go for Part 5 & Part 6.

Part 5: for my kid's AOS (under 14), On the last page of the I-485, which of the below should be checked?

Neither one literally and 100% applies, Pls help to figure out:

    Applicant’s Statement

I can read and understand English, and I have read and understand each and every question and instruction on this form, as w ell as my answer to each question.

    OR

Each and every question and instruction on this form, as well as my answer to each question, has been read to me in the [________________] language, a language in which I am fluent, by the person named in the Interpreter’s Statement and Signature. I understand each and every question and instruction on this form, as well as my answer to each question

    .

    Signature............. Print Name.............

I’m sure there is someone out there who has had this situation. How did you respond?

  5. Another question regarding fee:

    For myself:

    Fee/check: Two checks: one - $420, and 2nd check - $1070 ($985 + $85). Both payable to "Department of Homeland Security"

    For Kid:

Fee/check: Two checks: one - $420, and 2nd check - $985. Both payable to "Department of Homeland Security"

  7. You have 30 days to wait, if their are not issues you will receive your card. Possible a supervisor needs to review, it is standard for them to take your I94. if you don't do an info pass appointment.

May be you can post your interview experience. That might indicate something.

If i may ask, what was your local USCIS office for AOS?

Don't stress, looks like standard process. May be others can chime in who had similar experience

    All the Best !!

  8. How about you put down the I-94 number and date that match, and right next it, or on an additional sheet of paper, write "New I-94 issued on xx/xx/xxxx in connection with H1-B extension. Number xxxx-xxxx, copy attached".

    That makes sense. Thanks !!

    In "Arrival/Departure record(I-94) Date Arrived"

I can provide "First Time" details

Below that next line is: Date authorized stay expired or will expire as shown on Form I-94

Here i can write the "CURRENT" I-94 details:

    expiry date (I-94 number)

    What you guys think? :)

  9. Mate... just answer the question. When did you arrive in the US? Ignore slips of paper. When did you arrive here? Put that date.

confused, as in that case it doesn't match the date on the I-94 i put( Current I-94 & date arrived is in 2007)

    its like:

Arrival/Departure record(I-94) Date Arrived (...in front of each other)

I first arrived on B1(2006), went back & then after a year arrived on H1B(2007) and never went out of country after that.

Remember, i had H1B extension (not stamped in passport as never went out of USA) which was done being in USA.

  10. Q:14. - arrived as: (i came on HIB) what should i put; WORKER/HIGHLY SKILLED WORKER/H1B

    I use H1B

    Arrival/Departure record(I-94)

The I-94 i entered with was expired long time back, Never went out of USA after that, i got new I-94 after H1B extension which is expiring in Dec 2012. Which one i should use?

    I use Latest I-94

    Date Arrived

If i use latest I-94, what should i use for 'Date Arrived' as it was H1B extension i never went out of US and arrived again.

Shall i use the date when i entered US first time on H1B?

    Please help :)
