Perspective 2 - It's OK because the beneficiary returned to her country of origin it is considered visa fraud for the beneficiary (from ANY PLACE) to go to the US on a tourist visa to get married, then apply to adjust of status !!
Tourist visa is for temporary stay, if your wife adjust status, she already enter the country thinking to stay !
There is no problem to marry and come back...
But she cannot have anything related to marriage ceremony on her suitecase like
wedding dress, shoes, souvenirs, nothing that indicate she is going to marry. She runs the risk of being barred from the POE and sent back.

Hi there...am not pretty sure of my reply but I'll just try to keep you calm...Based on my own understanding, they will do the background check, like the criminal records, and check the records if you did petition someone prior to the existing petition...but don't worry much...stay calm and wait patiently...if problems arise, face it and resolve strategically...goodluck!

I can't say for sure that they are connected, but I was able to log in just fine yesterday, then this morning, no luck. Another person on the May NVC thread said that after she got her case complete on Friday she started getting the same error message, so I went ahead and called, and yes indeed, my case is complete. I would call NVC.

Don't worry, it's nothing to be alarmed. Just check back shortly and it will be back to normal.

someone in the may filers thread posted that they got the same message.. then people told her to call NVC, and she did, and was told she had a case complete It might have been a coincidence, who knows. You should call and see if there are any updates on your case, just in case

after reading your message, I tried to check my own status and I got the same message, it's probably something to do with the server, not our cases.

If you have already received the greencard (are you sure it has come?), then the best bet would be to go to the local USCIS office and explain the situation. You are legally in the country even if she is holding your greencard, which is a crime by the way. Opening someone else's mail is illegal and stealing it is worse! If you are sure she has done this and you are legally here, then go to the police and explain that she has stolen your greencard.

Exactly, a large part of the reason we had the problems we did was DACA and the workload redistribution in USCIS, first of I-130s from CSC and VSC to NBC and then out to the field offices. The field offices had not been trained on how to handle standalone I-130s and many of them were so swamped that they have yet to adjudicate cases from August. It is a bit of a nightmare, in my opinion, and one that could have been solved by giving USCIS time to prepare instead of pandering to votes.

I have seen people complain about the DACA cases, but not about the recipients of these cases. I do believe that the majority of the complaints are towards the way USCIS has handled this situation. I have not seen any personal attacks on "illegals", but I have seen complaints (and personally agree) that the influx of these cases by an agency that has significant resource constraints has caused unexpected delays in many people's lives. No one is blaming the "illegals"

While I have to give you some credit for explaining in open forum how you completely lied, it's pretty insulting to the community here to see how you took advantage of an officer who chose to give you the benefit of the doubt. It's exactly situations like this this that cause honest people to get more scrutiny.
Every day, people with genuine intentions with a slightly strange story get sent back, and then to see how people like you take advantage of CBP's _VERY_ sparse sympathy is quite difficult.
You can come here with the cats like you did, but you can't stay here. Whether your AOS will work or not depends on several factors, not least your convincing ability to be dishonest.
While there are people that get away with this, you're in the wrong place for the people here to tell you it's all okay and it will work. We foremost don't have enough information about your case, but many here simply have no respect for possible future citizens that make blatant dishonesty and disrespect for their newly adopted country as part of their very first interactions with it.

so - two petitions, leading to two different visas. OK - got it.
Pay attention to what happens at NVC in the next 45 days.
IF the two casefiles show up at the same time at NVC (I-129F and I-130), NVC will administatively close the I-129F and you'll be on the IR-1 path, with more paperwork to handle at NVC.
If the two casefiles somehow get unbundled - then is small possibility that the I-129F will move from NVC to the IV Unit at the Embassy, and they'll tell you what to do to apply for a K-3 visa.
If I were you, I'd focus on the IR-1 path, though (about 328 to pay at NVC) . It's going to be about the same amount of time for processing, maybe 1 month more, but is huge cost savings after you are IN USA - you get a 10 year green card. If you took the K-3 path (if it is available to you) then you have to pay more after arrival in USA - about 1040 usd or so, for a green card, plus you have to wait almost 6 months more where you can't work or participate in US Society.

We just had our baby back in August of 2012 and Blue Cross & Blue Shield helped out a lot in paying for the doctor and hospital. The total bill (doctor visits, and the hospital delivery bill) with out using the epideral came to a little bit over 26,000. Blue Cross & Blue Shield got it knocked down to where I only had pay 2619.00.

my suggestion for you is NEVER EVER stay alone with your wife, not even for 30 seconds, she just needs to be alone with you and call the cops and say you slapped her, or try to strangle her or you or hit her on the face hard and pushed her in the chest etc, when she realizes she doesn't have enough prove to ROC she can try to be alone with you just to call the cops and make her case strong to file I-751 waiver based in domestic violence. Report her to ICE.

She's setting you up for a VAWA claim, but she's stupid - she not need to adjust to a 10 year card later down the road with VAWA - a divorce, instead, will be helpful for her in filing the ROC bit.

ya, sorry - we've been seeing this exact RFE issued at SOME of the field offices.
it sucks, loads. It's as if the local offices are using different rules for adjudication than CSC or VSC or even MSC - and that's not fair to any of us, RFE or no.
There was probably no electronic notification of getting an RFE, as well, right ? Just the postal notice.

Make an infopass and officially pull the I-864 - do it in writing and mail letter to USCIS where you sent the AOS and your local office. That makes sure her AOS doesn't go through. Divorce and move on.
