    If your divorce is final (i.e., you have the divorce decree) by the time you have to file, then you can ask for a waiver of the joint filing requirements based on your divorce. Just tick box "d" in part 2 of the I-751. As long as you can provide the normal proof of "good faith" marriage, you should be able to remove conditions and get a 10 year green card.
    Note that the divorce must be final - you can't ask for this waiver if you are separated or the divorce is still pending. If you can't get a final divorce in time, then you may be placed in removal proceedings, but you can always ask the immigration judge to postpone until you have your final divorce. These requests are almost always granted.

You can learn an amazing amount of information about the immigration laws and processes by researching answers to other people's questions. Besides, it's a lot of fun!

    VenusAngel, I'm very sorry to hear about your experience and hope that it gets sorted out soon. It is within the bounds of the IO to request further evidence, especially in the light of not filing joint returns which is apparently the holy grail of immigration. Hopefully you'll either get an oath update or a RFE soon and can move on to the next step - whichever it is. For now, at least you know that nothing has changed, and your permanent residency is still valid. That's the one saving grace of the citizenship process.
    Wilerao .. sorry, but you are wrong. Yes, I can fully expect that EVERY USCIS officer and in fact EVERY PERSON should be kind, professional and humble. I refuse to expect or accept rudeness and crassness in anyone. I don't read where VenusAngel made "so many statements" which would lead anyone to believe her marriage to be false, and it is not up to you to define the terms of their marriage or relationship with family.

    Yes, there are documents you will have to send for the DS230, but again please take the time to read the #1 and #2 posts, all the info you need is there. I had to send, passport ID page (copy), birth cert, wedding cert, police clearance and the DS230 signed by the immigrant (only part 1). You will also need to send supporting docs with the afff of support, pay stubs, tax transcripts, etc.
    I am getting a little stunned seeing people say "time to prepare for NVC" when they are VSC June filers getting approved, you guys have been waiting SOOOO long, I would hope all of you have the documents (or at least a list) needed for the NVC stage. I know I couldnt wait to have everything ready.
    If you guys submit (as soon as you know your NVC case number) the DS 3032 email template found in the wiki, then use the "supervisor review" (to send again a day or two after) subject line that is expalined in the NVC thread, you will be able to pay both the AOS and IV fees within the first week in NVC.
    In a perfect scenario you will have all your docs ready to be sent in a week or two after NOA2.

    Hey, she already started the process, let her continue .... if you guys can date while she does it fine ... if you can't that is also fine.
    So far you are on the sidelines. Just make sure it stays that way. Let her get her GC on her own, if she stays then you know its genuine.

    Just exactly as I said....CBP are the bad guys, every American's GF/BF/SO is the innocent victim....sounds like you don't care for the laws and regulations of the United States of America...there is no 'quota' for denying admission to arriving aliens...it's not some game played by bored CBP officials...denied admissions occur because the arriving alien gives CBP pause in some way...inconsistent answers, hestitant responses, followed by luggage inspections that often reveal the truth....so once again, I applaud the work of our CBP folks....and don't believe a word you say about them. Perhaps you believe that you could do a much better job sorting out bonafide tourists, etc when they get off the plane....if so, why not seek employment with CBP? In fact, why aren't they sending a car for you, begging you to completely manage the entire border system?
    What you might consider doing is have a heart to heart talk with the wife...and, ask her for the I-275 (yes, that's the written report those nasty CBP folks draft when they are denying admission to someone...see if they checked the "quota for the month" denial box...or, as is more likely, there will be a narrative full of evasive answers given by your wife to the CBP folks....

    Yeah I am just a Nosy Nancy. You turned to a community help forum which means we need to know things about your case in order to advise you. The reason for a denial of entry & deportation has a lot of bearing on how to proceed. If she did the VWP paperwork properly then indeed something must have tipped off CBP when they were questioning her that she shouldn't be allowed in. And for sure they told her why. I know how they operate. I know a guy who even got the reason for his refusal in writing. She was probably just too distraught to pay attention or remember. It happens. You weren't there so you'll never really know what went on. Have her apply for a tourist visa and make sure she follows all the requirements. Your residency in her country will probably help a lot. She will have to disclose her previous denial on the forms obviously. I think your questions have been adequately answered by several people.

    CBP does not deny admission to people 'just for the fun of it'....the arriving alien has to give them a reason (it doesn't take too much of one)..such as ....not telling the truth to the CBP officer, when they asked her.."what is the purpose of your trip?..' or..'who are you planning to visit?'..and the answers given were, ahem, something other than correct...they may have inspected her luggage and found love letters or things that told them her 'friend' was something more than a friend...or other clues that suggested she was not being forthright with them...and such actions usually result in a swift U-turn back to the plane and back home...it's is amazing how anyone retelling the story of a denied admission of their spouse/fiance or 'family friend' (all one and the same!) always cast the CBP folks as the bad guys, whereas the foreign significant other was always innocent of any wrongdoing and only told the complete truth....odd I don't quite buy that as often as this story has been told...when the denied BFs or GFs (or SOs) get back home and on the phone, of course they are going to re-tell the story to make it appear as though CBP plucked them from the line of arrivals, whisked them to a dark room, beat them with sticks, threw water in their faces, made them sign papers they could not understand and whose contents were totally false....yep...happens every day...sure....what has usually taken place is that the arriving GF/BF/SO has given incomplete, innaccurate answers initially, and then, if taken to secondary, there is other evidence in their luggage, purse or other belongings that tell the true tale...the one that the unhappy American BF/GF/ SO never hears...I've worked alongside CBP twice (one day each time) in an earlier career, while they were screening arriving aliens from other countries, and they have highly tuned senses when they are working the line, sniffing out those who have other plans with remarkable accuracy....I applaud them for doing a truly thankless job..but their decisions benefit of all American citizens living in this country, and keep our borders much safer....and not just from terrorists, but from those who are trying to circumvent our laws...

    I have a feeling that the timeline searches don't work 100%, I was looking to check NOA2 vs. Case Closed @NVC and interview date. When I searched for timelines I would see people that completed their case but had no interview date, but when I looked directly at their timeline you can clearly see that they had entered all their information. Looked like the timeline search wasnt able to see/use the people timeline. Had to look at everyones timeline one by one.
    Still wishing you guys the best, some good news before X-mas would be great, just remember that NOA2 is not the end but rather the beginning to another process in which you will need to be much more proactive in order to get speed!!
    Take a few minutes to read/re-read the NVC december thread post #1 and #2, make sure you have all your docs in order and the NVC phone number on speed dial.

    I saw a couple of people start topics as "Approved", the latest one was this morning I think, said he was NOA1 of 6/12, I will look for them and post the links. But I am sure I have read at least two June filers who got approved this week.

    Let's assume for the moment that NVC schedules the interview for Caracas.
    For an interview to be scheduled, the final review has to be complete and the casefile has to be IN the queue for scheduling,
    and the IV unit has to have told NVC what the open slots are.
    Usually, the IV Unit releases 'the next month of slots' during the 1st or 2nd full week of the month, and those casefiles in the scheduling queue are assigned interview dates for that next month of open slots.
    Anyway, that's what USUALLY happens. We do get reports, as well, of scheduling occuring NOT during that 1st or 2nd full week of the month, as well.
    So, now you have a 'case complete' email. If you'd like to know more, call INTO NVC, and ask if your casefile is getting into the scheduling queue, and ask if the scheduling for Caracas is finished for the month of December (and let us know what you learn, ya? - helps other folks coming up behind you)..
    Caracas IV won't know of your casefile till you are scheduled at NVC. If you are seeking an earlier appointment date - you can't get one UNTIL you have been assigned a date first ; you then email the IV unit asking for an earlier appointment. If they can accomodate you, they will. If not, well, they'll tell you that also.

    Okay, everyone has let you know their opinions about your age and that it is too young to get married. That is not immigration advice though.
    You need to be legally free and able to marry at the time you file the I-129F petition. Since you are 17 and plan to marry in Washington, you will need to send in the parental consent that is required for that state when you send in your petition. OR you could wait until Feb. 1st and not need the parental consent.
    The I-134 affidavit of support would not be signed until months later after you get the I-129F petition approval and you would be 18 by then. The stuff about not be old enough to sign a contract will not matter. You will be 18.
    The problem is you need to find a co-sponsor that is domiciled in the US. It can be any US citizen or permanent resident in any state that meets or beats the 125% income requirement for their own household size plus your fiance. You will need to fill out another affidavit of support(I-864) once you are married and the foreign spouse is filing for adjustment of status. Read all about the affidavit of support including info about domicile: http://travel.state.gov/visa/immigrants/info/info_3183.html Also, read through the I-864 instructions. These are the guidelines the consulates follow even when using the I-134 for a fiance(e) visa: http://www.uscis.gov/files/form/i-864instr.pdf
    When will your fiance be needing to return to his own country? If he is still legally residing in Spain after the petition is approved and it is time for him to apply for the K-1 visa, then he can interview at the consulate in Spain. Otherwise he will be interviewing in Casablanca, and as you have been told, it is a tough place to get approved through.
    Research about the differences between the K-1 and CR-1. http://www.visajourney.com/content/compare Research all about what will be required and all the steps you must go through for each one. Decide which path you want to take, and then research everything about that specific visa until you think you cannot possibly learn anything more on the topic. Then, ask questions if you still get stuck on something.

    Yup, getting the police reports and stuff as well as the DS230 signed part 1 would take time if it comes from abroad, (I brought it with me when I made a trip down there). IRS tax transcripts also take a few weeks to arrive, if you are planning on submitting tax return copies you will also need to include the forms used to file them (i.e. W-2). I recommend getting the tax transcripts, they are from the IRS directly.
