  1. As for their living here illegally, they were not; they came here with tourist visas, so they were living here legally. The only problem was her going to school. If they were given a 6-month permit and returned before the 6 months, it is not living here illegally.

Understand that you believe that this is a technicality, and to some degree, it is. But, you enrolled her in a school, you must provide a residence, here in the US, in the school district. Therefore, to us, and more importantly, Consular officers, they were living in the US.

    Good luck with the waiver.

Also, you seem to be a sharp guy. Understand that language can have a tremendous impact on things. Think like a lawyer, somebody cannot live in the US with a tourist visa. A tourist visa is for visiting, meaning that you come for an allotted period of time, visit, and then return to your residence, in your country.

    Catch my drift?

  2. CBP rarely hires people for their intelligence.

There are idiot doctors, idiot lawyers, idiot politicians, idiot law enforcement officers, and surprise surprise, idiot CBP officers. Doesn't mean that they are all idiots. Don't generalize. These people keep our borders safe. Do you keep our borders safe?

OP, it sucks that you were treated like that. But you know what, when I travel abroad, I keep my pride down and answer questions respectfully to the immigration officer. Keep doing what you did in the future.

  3. It could be a problem at the consular stage. Time spent together in person carries a lot of weight in the eyes of the consul.

Like TBone said, it could be a problem at the interview, but it's country specific. USCIS will approve your petition because you satisfied their requirement, the consulate can ask more at the interview and not be satisfied with just one meeting.

  4. Before you forcibly evict the brother (ie. change locks, cutting off utilities, remove belongings in front yard), find out the law says. In New York State it is illegal to forcibly evict a tenant that has been living in the dwelling for over 30 days. Even if he is not paying rent. The landlord can be arrested for doing this. They deserve their due process through landlord and tenant court.

Find out the laws for Michigan.

  5. sigh,

I never thought this would ever happen, but it did.

long story short, got into an argument with the missus, she got really loud and the cops showed up.

I was not taken into custody or none of that, neither was she.

she called to say sorry and i believe its over but i decided to go over to my uncle's for a few days, or weeks.

I just want to know if things like this( arguments, cops, me being away) will have some kind of negative impact on the process.. i already have an AOS interview.

Was a report taken by the police? I ask because in some states, just the fact that the police showed up would make it a domestic incident.

Cool off, make sure she is calm, talk about it. And try to go out for dinner or something, forget about this mess, and keep pushing forward.

  6. I was able to renew my passport via mail. The cat only got some pages, the page with the info was intact, so the clerk at the post office said it can still be renewed via mail. If it had been the page with the info that was mangled, then I would've had to renew in person.

In cat news, we are cat-sitting my best friend's cat while they go on their honey moon. This guy is bulimic! So I expect to clean up quite a bit of barf.
