  1. Hi MY VJ Friends !!!

    I am so happy and excited to share the good news with you guys. I received a text message and email confirmation that I am approved and no RFE yayyyyy :D . I have not received the hard copy of my NOA2 approval yet, but hoping by Monday I will. I can't tell you how happy I am :) . I was reading everyones good news and their approval message, it feels so great to finally it is my turn to share my happiness with you guys. Last night was a great night for me when I got the text and read the email, I immediately called my fiance and gave him the good news. I could not sleep the entire night because I was too excited and happy. :dance: I thank all of you guys for your help and guidance. VISA JOURNEY FELLOWS, you guys rock!!! :thumbs:

    Now, will you guys again help me with the rest of my journey and tell me what will be next? What I need to do now?

  2. Well he was unemployed.If he had no income then how can he be expected to pay taxes?We did send Irs transcripts of his 2009,2008,2007 tax returns.Do you think that will help? I expect them to consider the fact that I have a joint sponsor.When my husband applied for his citizenship ,he had no income ..Is it too late to try to solve this tax issue?An accountant said it would be a difficult process ..long story.I am hoping for the best & will stay positive.

  3. Freedove, I have been meaning to ask this. How were you able to get TPS for Haitian Citizens when you have Canadian citizenship? I understand you also have Haitian citizenship, but surely the fact that you have another, non-earthquake ravaged country to go to (Canada) would make you ineligible for TPS. No?

    And yes, to add to what Little_My and Cead wrote, going to NBC is NORMAL and not indicative of ANYTHING at this point. All I-485's go to NBC. You should be waiting for a notice that you I-130 was transferred to NBC. That will let you know that your case was made concurrent.

    Hi,I just saw your question ! First off,it was a headache trying to obtain TPS.I came to the US as a child and never left the country since then .I had to prove I never left and never resided in Canada.Since both my parents were born in Haiti ( my dad is a naturalized canadian citizen) , I am a Haitian national as well.My petition was rejected at first be because they thought I once lived in Canada .I applied in April 2010 and after being denied and having to appeal,I was finally granted tps last December. :dance: Although Im Canadian and had Canada to go to ,I guess they didn't mind.USCIS just wanted to see that I didnt reside in any other country after coming to the US from Haiti.I hope this answers your question:-)

    I was curious about this as well. I know in a 2009 case USCIS determined that a dual citizen from El Salvador and Canada was not eligible for TPS even though he had applied back when it was initially offered because an alien isn't eligible for TPS if the Attorney General determines they have resettled in another country before arriving in the US (in this case, the alien had been living in Canada and entered on a Canadian passport).

    I never resided or even been to Canada :wacko: I has to prove this to get TPS.Im a naturalized Citizen.I was a baby when I was granted Canadian citizenship.

  4. Like stated above you will get an RFE if no letter (or additional evidence if needed) was provided to explain the absence of your petitioning sponsor's (husband) tax filing in 2011 or 2010 (depending when you filed.)

    We submitted a letter stating he was unemployed in 2010 and we sent the Aos package before the tax filinf deadline.They received my aos package on April 16 th.Are we in the clear for rfe's ??

  5. Yes, it is possible to have it processed that quickly depending on where your local office is and how backed up they are. It has actually been almost four months for the ones that filed early in January.

    The biggest factor is your local office.

    One poster was a little off when they said it is being processed throughout the entire 4-6 months and that they are continually working on it. The processing of the form takes very little time. Running background checks, even extensive ones, takes only a couple days.

    The reason it takes this long is for multiple reasons. One is that they have a lot of files to process at the same time. Also, I believe they purposely slow it down try control the flow of immigrants with the current population...Once it is processed at the national center they also have to wait until your local office can fit you in for your interview.

    Again...be patient...it will get old hearing it, but you are looking likely between August and October which isn't too bad.

  6. Granted it was a different age, but my Mother had three names listed on her will as aka. There was her First Middle Maiden, First Middle Married, and Middle Maiden Married. For most of her adult life she used Middle Maiden Married even though her SSC had First Middle Married. Her death certificate was in First Middle Married, but most of her financial assets were in Middle Maiden Married. As long as we showed proper documentation there was not a problem. The problem was that most people think you must probate an estate or have court orders and like with the USCIS you have to educate them that no we have a will and trust that spells out how everything is to be divided--now just do it.

    Her passport and DL were in Middle Maiden Married until she turn 64 and started collecting SS. She decided to make them all match her SSC even though the SS check was deposited into an account with her name as Middle Maiden Last.

    No sure if this holds true today, but women can have several different legal names due to marriages and divorces--that is why there is the place for other names used :) .

    Just my $0.02 worth on this whole name issue.

    Very good point ,Dave.I made sure to indicate my married name under other names used.Can name changes be made on socials or does it have to stay the same indefinately?

  7. I use both names. Maiden for anything that requires an ID (since all my ID is Canadian and is still under my maiden name), Married for anything that doesn't.

    All my immigration papers were filled out in my maiden name (because I didn't know it could be done with my married), my ssn is in my maiden.. but my GC is coming in my married. Then I'll switch my SSN, and my DL to my married name. Still unsure what I want to do about my passport though since it's still valid for 4 years. Part of me says "renew it now, so that way you aren't renewing BOTH your passports in the same year" LOL.

    Yes,many people choose to use both names.What do you mean by both passports?Do you have more than one?

  8. I thought once you changed your name due to marriage, only your married name is legal name. They usually reapply drivers license, social security card with their new married name.

    It's not like you can use your maiden name here and use your married name there.

    A legal immigration representative told me I can use my maiden name and I read several posts on here regarding people using their maiden name instead of their married name on their immigration documents with no problem.In New York,the law states that even though you change your name when you get married,you can still go by your maiden name as long as both names are not used for fraudulent activities.I renewed my passport after I got married and used my maiden name.Also,all of my educational records are under my maiden name and I intend to keep it that way.

  9. You keep the same SSN for your entire life.

    You should be using your legal name for all filings.

    They are both my legal names.I can use both as long as I don't try to commit any type of fraud.An immigration representative said that immigration doesn't care what name I use as long as I indicate other names I have used.I renewed my passport recently and its under my maiden name so that's one of the reasons why I applied under my maiden name.

As of last year,I was granted TPS and currently have a valid social under my married name.I applied for AOS under my maiden name.My Biometrics notice has my Alien Registration number but my social was omitted.Does this mean I will get a new social ? Also,if I have to fill out a form at my Bio. Appointment,should I put my social if asked even though USCIS did not include it in the notice?

  11. It's understandable. It's also possible you will be approved prior to September (5 months from now so it's definitely possible). What is your local office?

    I just checked on the USCIS website..It's the New York City Field Office.So is this where my interview will take place?Are there many field offices? My husband went to another location when he applied for his citizenship.EDIT : Never mind,we lived at a different location and it goes by zipcode.It was a headache going to the field office he was assigned to.Mine is a peace of cake to reach thank goodness. :dance:

  12. I made the same mistake when I joined the forums and couldn't understand it at first.

    Aosing from work, student or tourist ncludes us Canadians that entered on VWP (no visa).

    We still enter as tourists, we just don't need a visa.

    FYI this thread is irrelevant to your situation, as it has been established that you aren't looking at a January filing timeframe - you just filed your I-485 so you should link up with the April followers.

    Many of the January filers already have their green card approvals.

    You're right.I did take a look at the April followers forum.But really?? It's only been 3 months and some already have approvals ?

    I made the same mistake as well. This forum includes "other" so that would be you. Your process will be similar to those who came with a B-2 in that an interview will be required, etc.

  13. Because otherwise you would wait however long the I-130 takes to be approved (6 months or so), THEN submit the I-485 and wait ANOTHER 4-6 months. So about a year total. By now submitting the I-485 and making them concurrent you have only wasted 3 months waiting on the I-130 and now will be processed in the normal 4-6 months. So your total time will be 7-9 months instead of a year or more. So you DID speed up your process by filing the I-485 now but it won't be as quick as had you followed the directions from the start. Your January priority date is ONLY for your I-130 so at most that could be approved quicker but the I-130 is not your petition and gives you NO legal standing or authorization.

    I don't think I ever need to ask this question again :P It wasn't about not following directions.I didn't have all of the money for the AOS ,but I had enough for the I130.I didn't want to spend it so I went ahead and sent it.I had all of the money for the whole package before and I had to use it for an emergency.I didn't want the same thing to happen.Plus,when I read that I could make my case concurrent,I thought it would take 4-6 months from the time I sent the I130 to have the AOS petition approved.I know,thinking that doesn't make sense because they're two separate petitions...But thanks to you and some other members for clarifying !Now,I shall wait !

  14. You are looking at it just a bit off...

    Look at it this way.

    Say you filed seperately and waited for your I-130 to be processed before filing I-485. That could take you till June-July, and then you file the I-485...you could be as late as next January before having that go through

    Doing it as you have, you may very well have shaved a couple months off. Given a late April filing you could be anywhere from August to October depending on your location.

    That's a heck of a lot better than January, isn't it?

    Yes, you are in too much of a hurry. Chillax and enjoy the next few months.

    I have a much better understanding now.Thanks for the clarification.And yes,Aug-Oct. is much better than waiting till January.I hope to return to school soon and I am waiting on the greencard to do so,because I will need to apply for financial aid.I will miss the deadline to apply for next spring semester which is September 15th.I guess I should plan to go back next fall instead.I can't wait! I'll try my best to chillax during the AOS process :D

  15. I believe you posted in "family petitions." It is a bit confusing because you are AOSing based on a family relationship but the forums are sorted by the visa you arrived on. So, the family forum is for people who arrived on family visas - K-1, K-3. The work/tourist/other section is for people who came any other way - H1-B, B-2, VWP, etc.

    :D I see now...But what if you entered wiithout a visa? Is there a forum for that or should I just post in the forum you suggested ? I entered the US with my Canadian passport.

  16. Concurrent means they are together - now. If they have indeed already been put together; they may still be separated at this point. But as was mentioned before, the I-485 alone has 4-6 months of processing time. That starts the day it is received, regardless of what else was filed.

    I think I read somewhere that both forms are approvable at the same time.A decision is considered for both at the same time.Whats the point of making a case concurrent if it has no affect on the speed or the way a petition is processed?

  17. We don't normally delete posts unless they are duplicates or against TOS (in the later case, you'd be notified). We do merge topics that are regarding the same/ similar topics, by the same OP, or move them to the correct forum if posted in the wrong one.

    I believe standard view on looking at "My Content" and similar only goes back 3 months, so maybe that is the problem in your case? You should still be able to find all your posts if you use Advanced Search by author.

    Even posts that are dated less than a 3 months old have been removed.Its okay though.I was just curious as to why some posts were no longer there.I havent tried using advance search.I'll try that.Thanks !

  18. I noticed that New York is slower than other places. I have no idea where you're located. Sometimes the process is slower/faster depending on which office the case goes to. Maria TH is right - at any time you may get an RFE.
