My husband filed for the I 130 in January and we sent the I485 in April.I attached the I 130 receipt notice and my priority date is January 23,2012.Since my case is now concurrent,which I believe means that my petitions are combined together as if I filed them at once,why would I have to wait an additional 4-6 months till the process concludes? I know they are separate petitions,but doesn't having a priority date of jan 23,2012(the date my I 130 was filed) mean that my case is now concurrent? And doesn't concurrent mean I filed everything together ?

  2. You can get RFE at anytime during the process even at the interview.

    For the timeline of each steps, have you visited this part of the forum Adjustment of Status Case Filing and Progress Report.

    You can find people posting their timelines there, many of them have their timeline posted in their signature. That can give you some ideas.

    I spent a lot of time reading those posts and they helped me to guesstimate what will happen next and when. (F)

  3. Hello to everybody here on this forum. I have some questions about filing for Adjustment of Status.

    I'm a US Citizen, my wife is out of status already but she came here legally, inspected with her I-94.

    We got married last year after 3 years of being together here in US. We filed the I-130 last February and we got our Notice of Action (receipt number)

    after 1 week.

    We haven't filed the I-485 because we are waiting for the Approved I-130, because we followed the instruction that you have to attach a copy of

    the Approved I-130 when you are filing the I-485. However, it says there that you can also apply concurrently so I'm confused how can you file it concurrently

    when you don't have the Approved I-130 yet.

    Now my question is do I have to wait for the Approved I-130 to send the I-485. And I found out that she has to take medical exam as well but she

    doesn't have immunization records as well. How can she get immunization records?

    If you are a US citizen then you don't have to wait for the I 130 to be approved.Just attach a copy of the I130 receipt and write a brief letter requesting that USCIS make your case concurrent.This is what I did.My husband filed the I 130 in January and I sent the I 485 this month(April).It seems like my case is concurrent because my priority date is Jan.2012.I received my appointment letter for biometrics less than two weeks after sending my I485.Oh and your wife must complete the medical exam and receive the necessary immunizations.Hope this answer helps.Good luck.

So I received the appointment letter for my biometrics.I was wondering if the RFE phase is over or can I still be asked to send more evidence anytime during the processing of my case,even after receiving this letter.What happens after the biometrics? An approximate guess on the amount of time between upcoming steps would be appreciated ! My Priority Date is January 23,2012

    The most reliable way to do it is entering your receipt number into the USCIS.gov website. I dont believe their texting/emailing system is quite as good...

    I only check two - The I-485 receipt number will show when they have receive your application and when they set your interview appt, and the I-765 receipt number will show when they receive your app and when they have ordered production of the EAD card...dont even bother checking the I-130 receipt, from what I understand that won't change until you are approved at/after the interview.

    I just check each morning...now that I saw they have ordered my EAD the only thing I check is the I-485 to see if there are and RFE's coming, which I am believing in faith that I won't get.

    Yes ,I check online.My phone isn't even in service so I cant get text :wacko:

  6. Here *pulls up a chair*... welcome the the crazy house of Basee! I do the same. First I worried that others were getting their bio appts and I wasn't, then I get my interview date and worry that I haven't gotten my EAD, check the status update couple of times a day... constantly have my phone super glued to my hand in case I get notification... I'm a basket case, driving my husband up the wall and myself insane. BUT... one way or another it will be done and dusted in less than a month... hopefully, I'll still have some hair and fingernails left by then!

    Reading this made me laugh so much !!! I wonder if USCIS have any idea about the stress we're experiencing :whistle: I will celebrate when this is over.

    No, it won't. They will most likely want to take the biometrics again, and I don't think there's any reason to assume that your TPS status or having a SSN will change your process in any way. I had an SSN - many people have SSNs when they AOS. It doesn't change anything -except that once you get your GC, you won't have to wait for the SSN number too since you already have one.

    I thought my case would be easier to process..I guess not.

  8. Oh, sorry - I know you are on TPS but I thought you had a tourist visa originally. No matter - everyone except those on K visas (because they have already had interviews at the consulate before getting that visa) is required to have an interview. So your application going to NBC is just a normal part of that. :)

    :-) No,im a Canadian citizen so I didnt need a visa when I came here as a kid.Its reassuring to hear that this is a normal part of the procedure,:-)

    I agree with the other members , it's a normal procedure. Later on, they will transfer your case to the local office . Good luck

  9. aaahhh way back when we did a K-1 things were an issue if they were sent off to NBC. (but that was YEARS ago, back when you sent apps to your closest service center, and not to lock boxes.)

    But AOS from marriage to a US citizen from a visitor visa, always requires an interview. Period. The OP has an extensive over stay (18 years) and is under TPS, that can raise some red flags, and her interview might be tough.

    Red Flags?? What might they be questioning ?

  10. Erm.. Unless I am totally mistaken, there is some wrong information in this thread. ALL AOS cases go through NBC, formerly known as the Missouri Service Center. It has absolutely nothing to do with the case being complicated or not complicated, nor does it have anything to do with your overstay. NBC does the preliminary check of the application, makes sure all the necessary papers are there, all the forms are properly filled out, and sends out NOA1. After that, the case is forwarded to whatever is your local USCIS field office, which is where your interview will be held. This is standard procedure.

    Transferring to NBC is normal and not a sign of an issue. It'll be transferred to your local office later. You are adjusting from a tourist visa so an interview is required. That is the "path" that applications needing an interview generally take.

    Im not on a visa..but I guess the interview is required because im getting the Green Card through my spouse.

  11. It's going to take a long time since you filed the I-130 and I-485 separately and four months after the other.

    Even some K-1 and K-3 visa holders have to have interviews. It's because of complications, or just luck of draw. Being married to a US citizen, having TPS and having an EAD doesn't make things less complicated. It only means you can stay here and try to lead a normal life until you have a green card in your hands.

    Even though he is a US Citizen, and your over stay will be forgiven, AFTER the AOS is granted, you will still have an interview. You will get the 10 year card if approved.

    What probably triggered the NBC being involved is the 18 year over-stay, your husband is a brand new (maybe a year now) naturalized US Citizen, and you filed your packages seperately.

    Do I think you'll have an AOS issue? Probably not. You'll probably be fine, have your 10 year card, naturalize in a few years and life will be grand!

    My case is now concurrent though.They matched up the two applications ( I130 and I 485).It's been less than a year since my husband became a citizen.Why might that be an issue ? I hope everything turns out fine and I certainly can't wait for life to be grand ! I waited so long :)

  12. The complication is probably your overstay as a minor child and then as an adult until you filed your AOS.

    Not necessarily 'bad' but you will probably have to go for an interview.

    "The NBC will complete all necessary pre-interview processing of I-485 Adjustment of Status cases, including conducting background security checks, initial evidence review, adjudication of associated I-765 and I-131 applications (filed with the I-485 or separately), denial of adjustment of status cases for applicants who are statutorily ineligible, and forwarding scheduled cases to the USCIS Field Office for adjudication."

    As far as I know, you will go through additional security/back ground checks and mostly, after a while, your case will be transferred from NBC to your lo.cal office for interview.

    Sounds like this might take longer than expected.Since my husband is a US citizen,I didn't expect my overstay to be an issue.Well as of December I was granted temporary protected status and I currently have a valid social and work permit.If anything,I thought my current status would speed up my green card application or make it less complicated.Im hoping for the best.

  13. How do you have a social already? Did you already have work status or something?

    You shouldn't have any issues adjusting, from what I can tell...providing your original entry was legal and you have not claimed to be a US citizen on any papers...

    they may very well ask for your husbands 2010 tax returns at this point...they received the application before the filing deadline but that doesn't mean anybody actually looked at it until later...I would plan on being asked for it just to be safe...some people have been asked for them, but not all.

    Im currently under temporary protected status and have been since December.My husband wasn't employed in 2010.But we sent his tax returns for 2009,2008 and 2007.I have a co sponsor also.
