  1. No, this is not true.

    There was a couple on this board who mistakenly sent their concurrent case in two separate packages and when it got to the mailroom, the I-485 was rejected. The couple got the I-485 back and then made numerous infopasses, etc, and were told to send the I-485 with the NOA1 from the I-130 and the case would get matched up. The I-130 was at CSC and everything. They were successful in getting the cases matched up and getting it turned into a concurrent case. The I-130 got transferred back to NBC.

    The OP can do this too.

    Thanks for the link.I will take a look.The USCIS website states that I could send the AoS anytime after getting the receipt notice or letter of approval . Im confused as to why some are suggesting that I wait for the approval letter.I will send the Aos as soon as I get the NOA 1...

  2. As I said before, you can send your NOA1 from the I-130 with the I-485 package and they will match them up and turn it into a concurrent case. There is no advantage to splitting up the parts.

    Yes..I also read on the USCIS website that I could go about doing that...why are some people saying I have to wait for the approval notice ?? This is why I had to ask again :-/

  3. You chose 2 steps process. It takes about 4 - 5 months to approve I-130 (if you don't have any RFE) + another 3 months to get an interview after filing AOS (you don't have any RFE and your local office isn't full) -> you should look at 8 months at least. And yes you need the approval of I-130 to file I-485 along with I-131 and I-765.

    Ok I see.How soon after the interview do they approve the I 485 and grant premanent residency ? I filed the I 130 on Jan 20th 2012...you're saying I'll get approved in May or June..I'l file for the Aos in June..So by September I should have my greencard in hand ?

As some of you may know,my US citizen husband and I sent the I 130 last week.Im in the US and have been here for quite a long time.I was informed by many on this forum that I have delayed the greencard process by not sending the I 130 along withthe I 485 package.Now,can I get my case to become concurrent by sending the AoS package soon after I get the notice of receipt for the I 130? How long have I delayed the process by not filing everything together? how long will it take to have my greencard in hand after sending AoS with the receipt notice ?

  5. i did the same thing last year january and did not get an approval until august. you did it the long my friend. now im waiting on an approval on AOS that i sent in october. the way it works is like standing in line for milk as an example, when you get to the front of the line and only ask for the glass and now u have to go at the back of the line and wait for the milk next. it would be a lot quicker if you just ask for both glass and milk at the same time..... best of luck too you.

    Why did you wait for the approval and didnt just send your AoS with the receipt notice ?

Once you get your NOA1 (receipt of initial acceptance) in a few days, you can send in the I-485 package and documents with a copy of the NOA1 from the I-130, and they will match them up and turn it into a concurrent case (you want this). There are zero advantages to separating the process, and only disadvantages. It will make the process around a year instead of a few months.

  7. I also came here a decade ago and i have a social etc. Just adjusting my status. I was also informed to do them together and not separately as doing them together is quicker and is less of r headache. So i listened and now i have the money to do both. Good luck.

    How is it less of a headache ? Can someone please explain?? I could adjust anytime after I receive the notice of receipt which I expect to get in just a few short weeks..Anyhow,im in no rush to get the greencard.Everything happens right on time.Plus I have a social security number and I am authorized to work ....no rush ;-)

  8. You are uninformed on how this process works, and seem to have a bad attitude against those here trying to help. PS. The visa you entered on is quite relevant here. Not sure why you felt it so necessary to be a smart #### about it.

    Wow.You're the only one on here who has ever noticed my "bad attitude." I have posted on here many times and appreciate all of the helpful advice that I received.How is trying to clarify something by asking questions a bad attitude? And can you please tell me what visa I entered on because I dont remember requiring one 18 years ago lol. Lastly,I dont believe I am uninformed about the process.Ive been dealing with immigration for about a decade now.I know that I was able to send the I 130 and the AoS package all together but I didnt have enough money to do so.I wanted to get the process started ,however,so I went ahead and sent the I130.It's fine if it takes a little longer than if I had sent everything together.I have a social sec. # and work authorization....Im sorry ,what was your advice again ?

  9. no, without the i-485 they will assume a visa. you did it wrong by doing it in two steps. you have severely delayed your process

    Well I could adjust anytime after receiving the receipt notice right ? Why will they assume a visa when my application states that my husband is a US citizen and that I live in the US ?

    what are you adjusting from?

    Lets just say I have a legal status,a social security number and work authorization lol

    Why didnt you send the AOS application after receiving the receipt notice from them ? Dont they send it within a few weeks of receiving the I 130 ?

    I did it in two steps because I didnt have all of the money for the medical exam and AOS application .I wanted to get something started.How is it a disdavantage if I could send the AOS anytime after getting the notice of action? Say I send the AOS 2-3 months from now,when should I expect to have my greencard in hand ?

  12. Hi guys ! so I chose to do this in two steps.I sent the I 130 yesterday (Jan 20th)... When will I get an aproval letter ? Does USCIS instruct you on the next steps or do I just send the adjustment of status package after I get the notice of action or approval for the I 130 ? And for those who dont know,im in the US and will be adjusting here.

  13. I just did some more reading and re-read your post and I now notice you said you "had your name changed". What do you mean by that? My marriage licence has name before and name after marriage on it. Is yours the same? Does it list your husbands name?? If so then as Anh said you will either need to get divorced, or change your name via deed poll.

    I took my husbands last name when we got married.The certificate shows my new legal name and also shows my maiden name.Even though I took his last name,the law in my state says that I can still continue to use my maiden name.

  14. Yes that fast :-) Now remember the mail is a little slower this time of year with Christmas mail and vacations. My letter that I got was a welcome letter to permanent residence status in the US. Also telling me that I will have to do ROC several months before it expires.

    I checked my mail just now and guess what ?? I got the letters.Im happy :)

    A week to 10 days, but it is Christmas.

  15. Personally, no your married this is your new name. This might be and issue later with Aos and considered a fake marriage. Plus you might be unmasculating you husband how do you thing that might make

    him feel.

    Fake marriage ?? I've been with this guy since I was a teenager and we've been married for almost 4 years AND we have a kid together.Does that sound like a fake marriage to you ? lol

    Completely wrong. USCIS couldn't care less. it's a personal choice and not an indicator of a "fake marriage".

    Well you are either going to take your husbands name or you're not. You can't have it both ways. You can keep your maiden name in your home country if you want or you can change your passport. Your school documents aren't an issue because you have your marriage certificate to prove the name change. You can also just "go by" your maiden name if you like, but have your legal name as your married name.

    Keeping your maiden name isn't a problem for USCIS but if you've already put it on your forms you might have trouble stopping the change. if you get an interview you can request it then. You could try making an INFOPASS to change it back to maiden. But I don't know for sure if that will work because I've never tried.

  16. How about when I go back to school ?? I have a student ID (which is my Canadian Social) on file with my former schools.I was out of status and had no social.Now that I have one and its under a new name (my married name ) do you think this will create a confusion ? I would like to return to school to finish my degree.Would it be possible to keep my maiden name even though my social will be under my married name ? Or can I just carry around my marriage certificate for verification?

  17. I got my EAD/AP card about a week after I saw it was in production. It will come in a priority post envelope, I did not have to sign for it, it was left in my mail box. My green card just went into production on the USCIS site on the 22nd, it also says to allow 3 weeks. Watching the mail closely now :-)

    Wow it came that fast ? That's awesome.I have been checking my mail everyday after getting those notifications from them :D ..Anyway,congrats !!
