  1. Freedove, both of you have to think long-term. First of all, your husband cheats himself out of retirement benefits. Second, if he has no sound reasoning behind it, it might be a problem at the interview. Also, in two years both of you have to go to another interview - what if he gets caught not paying taxes? You gonna tell USCIS he couldn't make the interview because he is in jail? I think this is a bit short-sighted. You might want to reconsider filing at least for last year - the taxes won't kill you - instead it might make you sleep better...

    You're right .I spoke to him and he agreed to file . I have no idea why he didnt do so for the past two years.

  2. i heard that once you have a joint sponsor, your petitioners financial information is no longer of concern to them, the big issue they have is who is gonna take care of you if you need help? the answer is the joint sponsor, thats all they wanna know, they know that all types of people fall in love and get married, unemployed and poor people, so they shouldnt hold that against a couple once they have the joint sponsor

    This is the only issue that is worrying me right now.However I do have a joint sponsor who is willing to sponsor me.I can't wait till this is over.What do you suggest we do.Does he still have to fill out the affidavit? Do we put his income or leave it blank ? He doesnt get a paid a fixed amount of money every week.It varies.Do we just put the least amount

  3. Who will he have a hard time explaining to? If you are referring to the IRS then I agree, but they are not involved here the USCIS is.

    The USCIS will simply be looking to see if they have a qualified sponsor and ultimately an approvable I-485. They will not be making judgement calls about someone's tax filing compliance or non compliance, it is not there job.

    You've just lifted so much weight off my shoulders right now! Im such a worrier,but now Im feeling more optimistic :-)

  4. I am guessing you came here and you guys got married ....then doing AOS. But he willhave a hardtime explaining why he has a job and not filing taxes. we all have to file individually...he would get a 1099 and file if he is a contractor and they pay him without taking taxes. Him getting letters from his employers may raise questions as to why he doesnt file taxes. I would get ajoint sponsor....if i was you!

    Well we didn't just move here recently.I have been in the U.S. for 18 year since (I came here at a young age)and he has been here for about 12 years.We got married almost 4 years ago.I hope my chances of finally getting my green card doesnt get jeopordize by the fact that he doesnt pay taxes.Your saying getting a co sponsor will solve this issue right?

  5. It depends on how much he's actually making. For self-employed people like your husband, he must file for income over $400. Does he receive 1099's? He's also cheating himself on social security and, not to mention, the rest of the American people.

    You will have to justify why he hasn't been filing returns. If you do anything other than file the back taxes, you and your husband could be getting into some serious trouble.

    Your joint sponsor does not matter.

    He says the company files for taxes.What is the purpose of a Joint Sponsor? He became an American Citizen this year with no problem,why might him not paying for taxes pose a problem with my AoS application ?

I posted another question in regards to this.My husband,the petitioner for my AOS, doesnt file for taxes.He gets paid with checks and cash and works as an Event Planner for a company.He says the company files taxes .Im confused...Anyhow,will him not paying taxes prevent me from being approved ?Can we just send a copy of his checks and a letter frm his employer ?what if I just get a Joint Sponsor ?

  7. Many people receive cash for employment. Such a waiter getting tips, or a mechanic taking on extra work on the side, or your husband. It is only considered "under the table" when it is not declared and no taxes are paid.He needs to file. If this means he will owe taxes that he cannot pay right away, he can make payment arrangements with the IRS. The USCIS does not care so much that he might be paying off this debt,as much as he can show he can support you.

    I will have a joint sponsor with good income and who does pay tax.Will it still matter that my petitioner doesnt file for taxes ?

    I thought it was optional to show proof of filing for the last 3 years? atleast thats what it says on the application.It says to show proof of filing for the most recent tax year.

    No tax filing nothing will proceed, a filing is needed for three years.

    What if I have a joint sponsor ?

  8. I will be adjusting my status in the U.S.My husband is a freelance and doesn't pay taxes.He gets paid with checks but I think this is still considered working "under the table." Will they deny my application because my petitioner doesnt pay taxes ? I will get a joint Sponsor, but I'm afraid that since my husband is the petitioner and doesnt have a way to prove his income,this might be an issue.Any thoughts ?

  9. I've been waiting 18 years for this ! Well not really because I didn't know that about my immigration status till I entered H.S.I couldnt work and drive like my peers and thats when it hit me that I was living a very restricted life.Living in the U.S. with so many limitations due to being out of status was and still is very difficult.I was fortunate enough to have been able to do all my schooling here and even obtain an Associates Degree 3 years ago,but after that , I have not been productive at all.Im in my 20's and never worked.So even socializing was difficult to di with no money in my pocket. .It's like my life has been on hold for practically my whole life.I had to be dependent on others for EVERYTHING.I tried adjusting my status twice ,but to no avail.This is my 3rd try and I hope everything goes well.My permanent resident father tried petitioning for me a few years ago ,but I got married before the process was over.Funny thing was,I got rejected right when a visa number became available.I was honest and notified immigration of my marital status and thats when my case was rejected.So now my American Citizen husband is petitioning for me.I hope all goes well.Wish me luck ! :-)

  10. I think you are fine sending it now. In any case you should not use USPS (in my opinion), but FedEx or UPS to mail it, and they tend to have a pretty good track record in getting packages to the right destination. If you have everything ready now, just mail it our and you will probably get your first NOA before Christmas. Just keep in mind that due to your overstay, you cannot leave the US until you have the physical GC in your hands, so no visiting Canada for the holidays..

    LOL I haven't left the U.S. ever since I came 18 years go :-O..I can't wait to take my first vacation out of the U.S.Im excited.I would never ever leave without that document in my hand.No way.I think I will still be nervous leaving the U.S. even when I have my green card though .I've been out of status for so long !

  11. the question is would you rather delay it by over a month? i personally would send it in now, just make sure you have it track able to the lock box and all should be good, as soon as it enters the USCIS system you should be OK as you can keep on them on what is taking so long. I do think you're being slightly exaggerated on the humanity of bureaucracy employees :P i kid, but sending now you should be good

    Well I still need to get my medical exam done,so I'm not ready to send it just yet.My appointment is December.I will send it as soon as my medical is complete.

I was thinking maybe I should wait till after New Years to send my adjustment of status application,because things usually get hectic during the Holidays.I wouldnt want my application to get lost ! Plus the post office might be a mess.I just feel like people are usually in a party mood during this time of year and forget to stay organized and professional.Any thoughts. am I exaggerating a bit ?

My American citizen husband will be petitioning for me.We plan on sending out the package by January 2012 ,because I still have to get my medical exam completed,Birth certificate translated,etc.I want everything to go right so we're not rushing.So say I send out my package in January,when should I be receiving my Work Authorization,Interview notice and the actual " Green Card?"We will be mailing out the applications from New York,where I have resided practically my whole life.I've waited so long for this !! Wish me luck :-)
