  1. I used to be a go-getter.Being out of status did not stop me from reaching certain goals a few years ago. Before I even graduated High school,I began taking class at the community college that I graduated from in 2008.I even started working towards my Bachelors while I was pregnant.I had to stop pursuing my goals not because I became a mom but because of a lack of resources.Without a greencard or legal status, there's no way someone could reach their fullest potential.I just got granted some "freedom" last December when I was granted temporary protected status( long story for those who dont already know) .I finally found a job at a retail store after 4 momths of getting my work permit and I already want to quit.I miss being home all day.I did go out though, dont get me wrong..But I miss being spoiled and taken care of by my husband and mother .I never worked a day in my life and im 25.Having to stay home for 4 years and take a break from pursuing my goal made me lazy ! i also didnt have enough contact with the outside world and feel uncomfortable being so out there.I love to talk to people and meet new people, but its overwhelming.I also feel like I didnt develop my personality and didnt grow much.I still feel like im in High school  Im doing things now I should have done as a teenager if I had my green card sooner in my life..things like applying for 1 st job, driving, etc.Should I quit my job and do what im used to ?? its a partime..working for 2 days and today is my second day.I miss being home with my baby ! I know I should grow up,but spending my whole life without a legal status and not being able to live freely has really stunt my growth.Put yourself in my shoes for a minute.I need advice.

  2. I agree with pooky  Look your not alone when alot of people start a new job they get nervous it's normal.Your going to be okay just smile and relax all will be okay and if you don't like this job try something that you know you will love  Good luck

I am so nervous ! Nervous is an understatement, actually. Thanks for the advice and the luck.

  3. My advice? Don't try being something other than who you are. Be yourself.

Enjoy your job. Find out the good things about what you are doing and get to know the people you will be working with. At the end of the day, if you're not enjoying what you do, you're in the wrong job.

I hope I enjoy it because I need the money ! I never worked a day of my life and I think it will feel great to earn my own money for once. Its always noticeable when people aren't being themselves but then again, sometimes you just want to feel accepted and fit in.The best thing to do is be yourself though and everything will fall into place.

  4. Well...SMILE! It doesn't matter if you do it often, if that is what your employer wants, then that's what he/she should get

Other advice, always arrive on time, never complain about your job at work or to your co-workers, and have fun!

    Congrats on the job

Thank you so much for the advice !

*** Moving from AOS to Off Topic as not AOS process related *****

    Thanks !

  5. After getting my work authorization last December,I finally got a job at a retail store.I am so nervous ,because this is my very first time working. If my immigration status was fixed when I had just arrived in the US as a child,I would now have work experience. But Im in my 20's and it feels like life has just begun.Im not sure if I could do this job.I will be dealing with customers and im not so much of an extrovert.I have been a stay at home mom for 3 years and graduated from college 4 years ago.I haven't had much contact with the outside world  My soon to be manager said he wants his employees to smile .Well I dont smile often :hehe: :hehe: and I blame that on life's blows.Advice or uplifting words, anyone ??

  6. Read, have fun in life, and check updates once a day. Don't stress too much. Check my signature. You will get one of the following:

    a. RFE

    b. EAD card production

    c. Interview notice

    Good luck!

I don't want to see the acronym : RFE !! Keep it away from me  b or c will do

ok, thanks. was caught off-guard by the OPs signature which states only filed for I-130.

guess dont expect an EAD then ;)

I already have an EAD with the TPS and I requested another one along with my AOS package.

  7. I am not as familiar with an adjustment from TPS, do you not need to file I-485 in this scenario, only I-130?

Both...My husband is the petitioner for the I 130 and I am doing the I 485 status adjustment.

Like any other person that entered the US legally, TPS can adjust status based on marriage to a US citizen while in the US by filing I-130 and I-485, separately, or concurrently.

    Yes,that's what I am doing :)

    Wait?

    :D I guess you're right.

    And then wait....

Seriously though - look at my sig and you will see what is next.

:D You received your interview notice about a week and a half after your biometric appointment??

  8. I am not positive on children, but it should say on your notice something to the affect of not bringing people because of space etc. I know you can bring your spouse but they are not allowed in past the waiting area...so this may depend on the age of your child?

You don't have anyone that can keep him/her for an hour?

Well I could get someone to stay with her. Thanks for replying so quick. My child is a toddler..So I guess it won't be wise to take her along.

  9. I think you are getting a bit too worked up by this process.. At this rate, you will drive yourself absolutely nuts by the time you have your interview. I don't mean anything bad by this, but I just think you would be doing yourself a favor by just taking a breather, and trying to pass a day or two without thinking about the process at all. I know it is hard - I went through it too - but after the papers have been filed, all you can do is wait for USCIS to make the next move. You have your NOA, you've sent both forms and your case is now concurrent, and if I remember correctly you have received your biometrics notice - if not, you will soon. Don't try to guesstimate what your chances are of getting or not getting an RFE, don't spend hours looking at processing times because they are only an estimate too - every case is different, and though other people's timelines can give you a general idea of how long each step takes, in the end your situation might be entirely different.

Again, no judging intended - I just think you could be spending your time doing something nice in this beautiful city of ours instead of obsessing over every little detail :) You still have a long way to go.

Lol!You are so right.I try to keep my mind off the process by planning things I will do once I get the green card.My biometric appointment is tomorrow! What should I expect afterwards? You said "our city."Are you in NY aswell ?Thanks for you words of advice!! I really do need to relax.:-)

  10. You're welcome. Yep, it's worth the wait. Luckily, I was able to drive around in car for some of the time while waiting around until the i-94 expired. With an EAD, I'm out driving again(and working) and not really anxious to have a greencard in hand right-away because I'm not as limited anymore. Lots of visits to the License Branch though :D

Absolutely.I know what you mean.A little freedom is a great thing :-) I know the feeling.I was super happy to get a social and work permit last year when I was granted temporary protected status.I live and was raised in the US but I still qualified for the tps they granted to Haitian nationals after the earthquake that occured in Haiti.

  11. Hi,guys ! Is anyone living and adjusting their status in the U.S. ? I was raised in the U.S. and finally, I am working towards adjusting my status.Good luck to you all. Please wish me luck as well !! :)

  12. As a USC you are require to file an income tax return every year from age 18 to death (if you have income you must file even if under 18 as I had to file when I was 14 YO and your decendants file your last tax return typically the year after your death). If I was your husband I would file a tax return for 2010 to show that he owed no income tax. Get a transcript of that return and one for 2011--you will be asked for it is my bet. Some people who are unemployed have investment income that has tax consequences. That is the pain of becoming a LPR and being a USC is filing US taxes on world wide income.

The co-sponsor is on the hook to repay the US government should you accept any means tested benefit from the US government until you reach 40 quarters of income (10 years), become a USC, leave the US abandoning your LPR status, or die.

    Good luck with the AOS,

    Dave

Hi ,Dave. Can this still be done even though the deadline to file taxes has passed? Im getting a bit nervous and disappointed that a simple matter like this can actually prevent me from being granted permanent residency. You know what,I will let things be..Whatever happens ,happens.

  13. That actually is not true...there are exceptions to being required to file, although even when not required you can file as there could be credits you can receive even though you weren't required to file because of having no income or some other thing that precluded you from filing.

For the reason that even with no income you could be required to file you do have to sumit along with your I-864 an explanation and attach the portion of law from the IRS that displays why you would be exempt.

But...I am getting into what I already said, so read my previous post. ;)

In the instructions it said to attach an explanation.Thats what we did.Now if they want to deny me because my husband was unemployed then so be it.I have lived here for almost 20 years and never used or even qualified for mean contested benefits. If they don't take my co sponsor's contract and promise to provide support me or repay the government for helping me ( I strongly believe I wont rely on government assistance) then oh well. There's nothing I could do about that.

  14. NYC usually has longer average wait times from filing to interview than most other field offices due to the high volume of applications here - but for example, ours didn't take any longer than the national average of 4-5 months. We filed in March, and my interview was in July last year. Don't know what the situation in NYC is now though, but I would just try to sit back and relax - you can drive yourself crazy with this process. Nothing you can do to expedite it, so better just try to relax and keep yourself busy with other things in the meantime.

My husband 's citizenship application process also took the usual 4-6 months. He applied in March and by August,he was a citizen.Im not so much worried aout the length of time anymore, but rather about getting rfe's .Im really hoping all goes well.

  15. The taxes thing is a bit sticky... i really thimk he should get something from irs for 2011 or 2010 at least. my money is on you getting an rfe.

Its impossible to get something for 2010 because he had no income. We filed for aos before the tax filing deadline so I heard 2011 tax return might not be needed...I hope I dont get a rfe because my co sponsor makes more than enough...

Like stated above you will get an RFE if no letter (or additional evidence if needed) was provided to explain the absence of your petitioning sponsor's (husband) tax filing in 2011 or 2010 (depending when you filed.)

How could he have filed for taxes last year if he was unemployed ? Also,we filed before the tax filing deadline. We wrote a letter explaining why he didnt submit 2010's income tax return..He had no income. He was unemployed...So what role does a co sponsor play ?
