    Why don't you try and tell him you have sent USCIS a letter cancelling your process since you won't be needing the visa anymore since he won't come and you will be moving to him. See how he react.

    The U.S. doesn't need you as bad as you think it does. Despite what you say or think, yes your kids are free to come and go. Just because you choose not to send them without you doesn't make mean the U.S. is keeping them out. Before you left the U.S. you could have easily filled out a re-entry permit.....you did not. Not everyone who comes and gets a green card chooses to become a citizen, there is no requirement or need for some....so no the end goal isn't always a citizenship as you yourself stated you didn't do. For those who do not choose citizenship they must maintain residency unless given permission by the government which you obviously didn't do....don't see what your beef is.
    In short the point of the maximum 1 year out is so that someone will be forced to maintain residency or give up their green card. What do you want it at? 5 years? 10 years? Perhaps there should be no limits and anyone who gets a green card may keep it forever no matter where they live and may apply for citizenship no matter where they've resided. Hell let's just offer anyone and everyone green cards with no restrictions or obligations.

    So basically, you think the rules shouldn't apply to you because you're rich?
    And yes, your children can go to the US any time they like, it's your choice not to send them, same as it's your choice to not maintain you PERMANENT residency.

    Not sure why you are complaining so much. You opted to stay out of US for a long time without obtaining re-entry permit. Your fault, not USA.

    Yes you can get student loans. My husband in fact has one and he has his two year greencard, just waiting now on the ten year one.

    July 2015 filer here for Vermont. There was just an update dated January 31, 2016 that Vermont is working on ROC for April 13, 2015, so a little closer to us. We are anxious here as well. Really hoping to hear something soon.

    My husband is not on the lease for our apartment. They would not add him when we moved in, as he was not a permanent resident and then when he received his 2 year greencard, his credit still was not established, so they would not add him still. We are now in the process of looking to buy a house or condo, so we don't have him added, as it will "change" the lease terms and stick us with another year in this apartment.
    What we did (for both AOS and ROC) was have the apartment management company write a letter with a current date stating he has lived at the apartment. For ROC we included both letters and awe also included a statement with the explanation above. We had no problem with AOS (had interview) and n ow are just waiting for his ROC to be approved.

    Yes you have to pay for the cards. You will need these for when you remove conditions and apply for the 10 year greencard,

    You posted before that you had an RFE. What was the RFE for and did you respond in the allotted time-frame for this? If you didn't provide what they were asking for or past the posted time, then this could be the reason for the denial. Once you receive the denial you can go from there to determine what your next steps are.

    AP can be a variety of things. They could be reviewing your paperwork, doing additional background checks, or just about anything.
    I would call the embassy on Monday to verify that you can pick up your passport/visa on Tuesday. When my husband(the fiance) had his interview in 2012(in Tunisia), he too was told he was approved and come back next week to pick up his passport/visa. I made sure he did not buy his plane ticket though, as I knew there was a chance for AP or even with say printing the visa. He went back on the day he was told and sure enough, he was told that sorry you are in AP now, here is your passport. We will call you when you can come back and bring your passport for the visa. It took almost 2 months for them to call him again and this was after us calling everyday to see if there was any news and also calling my senator(which we had done for the petition as it was past normal processing times). If you have already booked your ticket, and you don't have your visa, hopefully you can change the ticket.

    This could/would be considered fraud, as the intention it to stay and adjust status. A visitor visa is just for visiting, not immigrating.

    When you book your flight make sure you book only one flight, layover is ok to the USA, not two separate flights. Also make sure that once you are in the airport in France you stay in the international area and you shouldn't need a travel visa(schengen visa).

    You can send it in the 90 window prior to the expiration date, but it needs to arrive in that time period, not before and not after. If before it will be returned to you and if after, you risk it being denied for abandonment of your Greencard.

    Did you send in the evidence already, or you are still trying to gather it to send in? On the RFE there is a date that they need to receive the documents by. If this didn't happen, then they will consider it abandoned.

    I don't care if you think my response was silly, yours was stupid to begin with. Just because you don't agree with the law doesn't make it legal. You cannot come here on a tourist visa and work, doesn't matter what kind of work. Baby sitting is work, unpaid or not. With a tourist visa you can visit and visit only. End of story.

    You have no way of knowing whether the op will be "ok" or that their case "will" be approved, so you should not make blanket statements like that.

    You are married, so he does not have go back. No loopholes for the extension- that 90 days isthe time you have to get married in for when he first arrived. You filed AOS, and there wasn't a deadline to file. Now you just wait for the Biometrics appointment and then if approved he will receive his EAD(employment authorization card in the mail about 1-2 months after the biometrics are done.
