    Your still legally married to your first husband and are married to another person?
    That is an IMMEDIATE red flag.
    Polygamy is ILLEGAL in the United States.

    Since you're married do NOT leave your house! If things can't be worked out stay there until a judge rules otherwise. You're married...you're equals...you have rights.

    He is not obligated to pay your rent or give any money to you. That is until and unless a judge says otherwise in your divorce proceedings.
    It is great that you found a job. Even without credit history, you can find a place to rent - look on the websites that advertise for roommates, or try to sublease from someone who wants to move out from their apartment before the end of the lease.
    On the other hand, you are not obligated to leave your current home, so if he wants you out, he could help you to find a place and put a security deposit down for that place (since you have no savings).

    With regard to the affidavit.... the petitioner is only responsible for repaying any means-tested benefits you may take out. Meaning he only promised you wouldn't be a burden to the American taxpayers.

    Hello gigi_a,
    We had the biometrics appointment as a "walk-in" although it was completely an accident. My wife's biometrics appointment letter was returned as "undeliverable" for some unknown reason. So, we scheduled an INFOPASS appointment at USCIS in Cincinnati to determine the cause of that problem. While there, the very nice woman told us that it was the biometrics appointment letter and we had missed the appointment already. So...she called downstairs to another level of the building to the biometrics area and explained our situation. They said, "send them down and we'll do it right now"! So, we went to that area and had NO WAIT whatsoever. The biometrics took about 15 minutes from start to finish.
    AS A NOTE: This was done on a Thursday when they are less busy. The early days of the week are very busy and I doubt if you could do it. Friday is also busy because people want to get it done before the weekend. We were just lucky, I guess. To allay your fears about the immigration process, we have had nothing but GREAT experiences and dealings with really nice people!!!! We started the "Adjustment of Status" part of the process in January, 2011 and yesterday (6/6/11) we received notification that "production of Elsie's Permanent Residency card had been ordered". She got her Worker's Permit & SSN about 6 weeks ago and has already obtained a job which she loves.

    i don't have an answer for you but i just want to say i am sorry things work out this way for you.i think it's a very wise and courageous decision you are making. i don't know him so i'm not gonna condemn him but as for you maybe it is the best thing for you because you will never trust him and you r gonna be suspicious of every little thing he does. like if he's out late r not answer his phone etc. so you are sparing yourself a lot of stress and pain. that's just a part of life, i hope you will be able to forgive and move on with your life, all the best.

    You can come to america and get married, then she can file the CR-1 you can stay on VWP or as a visitor but you have to return before your visitor status will expire. You cannot over stay your time. You certainly can visit back and forth during the process.
    When the CR-1 is approved (around 5 months ish) you must be in your home country to collect documents and have a medical and interview to get the visa.

    Then sounds like you just haven't supplied supporting information that they need to show it is a bona fide relationship etc. - agree that the form itself doesn't give you full guidelines. If you check the guides on the site here they explain what is required. You will know more when you receive their letter as to the options you have. Again, I'm sorry you have been through all the waiting to get to this point. I hope it all works out for you soon.

    the correct process is if you get married in USA the foreign spouse goes back to their own country while the visa application is in process. But you can try to adjust status otherwise...it does happen and plenty of people do it with good results and some bad results...doesn't always work out the way you think it will.... I'm just telling you there is always a risk of being considerd visa fraud. The decision you make is totally up to you and your own situation.

    For those of us who have an emotional stake in the outcome, the process can be excruciatingly difficult. For a casual observer, it's a bureaucratic bore. If they portrayed it the way it really is then nobody would be interested in watching it. It's not interesting, and it's certainly not funny.

    It would be great to see something (tv or movie based) that correctly portrays this process. The comical way they are always approaching it on tv and movies truly does give people the wrong impression. And now that I think of it, I don't think I have seen anything where the plot actually shows the characters doing it with good intentions (IE, for love), and that's really sad.

    It's funny 'cause you'll see it more and more. Movies with incorrect immigration stuff and I know they're just trying to be funny but people ACTUALLY think that's how easy it is and that's annoying 'cause they seem to imply you must be doing it wrong if it's not like in the movies :S

    I'd like to think watching a movie or a TV show about how the actual immigration progress works, would be something akin to reading all those long, drawn-out, boring camping chapters in Harry Potter and the Deathly Hallows; little to no action, and a whole lot of waiting. XD

    She can look for a job, but isn't likely to get an offer if she doesn't know when she will be able to accept it. And a person cannot volunteer to work for free if that job is a paid position.
    It's frustrating, but waiting is a part of the immigration process.

    It is such a knee jerk reaction to conclude that she married the green card. Depending on where she comes from, US may seem attractive or not... is she from Philippines, really?
    Is it possible that she is depressed and regretting her decision to come to the US? OP, did you ever ask her what she wants and what is the reason for her behavior? May be it would be kind to let her go back if that's what she wants... you said she no longer has a home or a job in her country, but this could be restored if that's what she really wants and you are willing to help.
    You mentioned that you had bad arguments. Is it possible that she feels she has no power because she does not work/has no income and you hold all the cards? Did you win those arguments? Is it possible she is holding the grudge?
    You know that "no childcare giver with child's native language" is a bogus excuse. The daughter is perhaps pre-school age (or else why is she not in school and learning the language) and young kids learn new languages pretty quickly.
    She will not have to leave the US if you divorce now. But as you seem to not have a firm idea as to why the two of you are so miserable... try to find out!
